It was moved by Commissioner Lambert, seconded by.Commissioner Cage, and unanimously carried to
recommend approval of the abandonment for Tal Nahir and Jean Wallace with the following findings:
I. Determine this project to be Categorically Exempt under the California Environmental Quality Act,
Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment for Tal Nahir and Jean Wallace
of the 3,520 square feet of right-of-way on the southwest corner of Hildale Avenue and Edgewood
Drive as shown on Attachment A, subject to the following findings:
A. The proposed abandonment is in conformance with the.Butte County General Plan.
B. The public right-of-way is not required for access to any affected parcel.

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed will
not be in conflict with a General Plan. Staff has analyzed this request and recommends approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The County right-of-way
proposed for abandonment includes 3,420 s.f of area identified as Parcel A on Abandonment Parcel
Map A-521. The proposed abandonment is 1.70 feet in length, and 42 feet wide at the apex of the
corner. This public right-of-way was created in 1929 as part of the Oroville-Wyandotte Fruit Lands
Unit No. 6 Subdivision (Map of Records Book 10, pages 3A, 4A & 5A).
ANALYSIS: The original map of the Fruit Lands Unit No. 6 Subdivision indicated an intersection
design very similar to the current intersection design. Subsequent development, in 1979, resulted
in an intersection designed with Edgewood Drive joining Hildale Avenue at an angle greater than
90 degrees. The County has since redesigned the intersection to be a 90 degree "T" intersection.
The petitioners are requesting the County to abandon the identified portion of the right-of-way on
the southwest corner of the intersection. The property owners at this location have indicated there
exists a safety hazard in this right-of-way. Instead of using the paved portion of the realigned."T"
intersection, a number of drivers are taking a"short-cut" across the unpaved portion of the corner,
and continue to use the old road bed to avoid the stop sign at the corner. A number of these drivers
accelerate their vehicles over the gravel road bed resulting in increased noise, dust, and possible
safety hazards.

Approval of this abandonment will result in the applicant(s)being able to expand their front yard,
revegetate the acreage, and eliminate the existing unsafe driving practices of those drivers currently
speeding across the old gravel road bed.
According to California Government Code Section 65402,the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted element of the General Plan. The General Plan Land
Use Element supports the project with the following Goals &Policies:
Goal 1.7 Orderly Development
Policy 1.7.b. Promote the full utilization of sites served by; exisiting public facilities.
Goal 5.1 Circulation System
Policy 5.l.b. Provide a circulation system and plan that is consisstent with and will suprt existing
and proposed patterns and densities of land use.
The Butte County General Plan Circulation Element supports the project with the following Goals
& Policies:
Goal-1 Develop a transportation system in a manner that envourages efficient land
utilization.
Policy 1.2.1 Road system-planning . . . working to increase the efficiency . . . of the existing
network.
Goal-4 Provide for a road and highway network that meets the need of existing and
anticipated movements of people and good.
Policy 4.1.6 Usable road easements of adequate width shall be located as to most beneficially
serve the needs of all parcels..
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Determine this project to be Categorically Exempt under the California Environmental
Quality Act, Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment for Tal Nahir and Jean
Wallace of the 3,520 square feet of right-of-way on the southwest corner of Hildale Avenue

Edgewood Right of Way along with plats delineating the subject area. The $262.00
abandonment-processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed-abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action, our department will further
process the abandonment with County Counsel and the Board. Note that there is an easement
reservation for utilities. Copies of the letters from utilities area also attached.
Please advise us of the schedule of processing by your department and provide us a copy of
the Planning Commission minutes documenting the Commission's action.

The undersigned, being ten or more freeholders, at least two of whom are residents of the Road District in
which some part of the highway affected is situated; and who are taxable therein for highway purposes, do
hereby petition your Honorable Board of Supervisors in writing, in accordance with provisions of Section 8321 of
the Streets and Highways Code of the State of California, to ABANDON the following-described COUNTY
HIGHWAY of the COUNTY OF BUTTE:
All that certain real property situate in the County of Butte, State of California, described as follows:
Being a portion of the Southwest one-quarter of Section 15, Township 19 North, Range 4 East, M.D.M.,and also
being a portion of Lot 241, as shown on that certain Official map of ORO'IIIrLE-VtIYANDOTTE FRUIT
LANDS UNIT NO. 6 which map was filed as of record March 8`h, 1929 at the request of B.N. Paxton in Book 10
of maps at Pages 3A, 4A & 5A in the Office of the Recorder, County of Butte, State of California, and also being
adjacent to and Easterly of Parcel 1, as shown on that certain Parcel Map for GLENN E. WIlVTERROWD which

INTERSECTION OF HILLDALE AVE. & EDGEWOOD DR.
Dear Mr. Phillips:
We have reviewed the proposal for an abandonment at the intersection of Hilldale
Avenue and Edgewood Drive and find that PG&E has existing company facilities
within this area. We have no objection to the abandonment of this area provided that
it is retained as a public utility easement pursuant to Chapter 5, Section 8340 C of
the California Street and Highway Code. We request that the following language be
used in the County resolution:
"Reserving, however, to Pacific Gas and Electric Company the
permanent easement and right from time to time to construct,
reconstruct, maintain, repair, operate, replace, remove and renew lines
of pipes, wires, poles and other structures, equipment and fixtures, both
above ground and underground, for the operation of gas, electric, and
communication facilities, including the right to trim and cut trees and
brush that may be a hazard to said facilities and also the right to keep
the property free from inflammable materials or any buildings or
structures.

RE: Request for Abandonment
Dear Sirs:
My husband and I would like to buy the abandoned "nose" of land next to our property at 17 Edgewood
Dr. in Oroville,CA (AP#068-343-025): This area was created when Edgewood Dr. was recently
realigned to intersect with Hildale Ave. at a perpendicular angle,rather than a"Y" intersection. Enclosed
is the current copy of the AP map with our parcel highlighted in yellow,and the piece we are requesting
for abandonment in orange. We have also enclosed our deed of trust and a nonrefundable check for
$262.00, as required.
We want to control this land'primarily because many people are still using the old road bed to avoid the
stop sign,and hot rod over the gravel at great speed causing too much noise and dust. It is obviously still a
safety hazard. Others use it as turn-around point and a neighbor uses,it to enlarge the turning radius for
entering his,driveway with his big semi truck. We would also like to use the land for enlarging our front
yard.
As you can see from the map,the piece we are requesting to be abandoned,does not abut any other
property,so no one else has a practical claim or use for it.
In the event that we cannot afford,or believe the cost of this parcel is too high,or if the Planning
Commission or you decline to grant this request,will you please consider putting up white guard rails, as
soon as possible,to effectively accomplish your own goal of redirecting ALL traffic? I have seen a similar
situation at the comer of Hildale and Glen St.,just up the road,where white delineators every 3-4 feet on
center successfully keeps traffic out of the area.
