Vicinity Map B: General Plan/Zoning Map STAFF COMMENT State law requires that the Planning Commission find that an abandonment such as proposed will not be in conflict with a General Plan. Staff has analyzed this request and recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public services right-of-way proposed for abandonment is approximately 1.14 acres in size, extending north 1200+/- feet on Lower Wyandotte from Ophir Road, and east 500+/- feet on Lower Wyandotte Road from Ophir Road. The General Plan land use designations for the properties involved include LDR (Low Density Residential) and C (Commercial). ANALYSIS: Pacific Gas and Electric (PG&E) and the Oroville-Wyandotte Irrigation District commented on this project and do not object to the abandonment of the public services right-of-way. Abandoning the right-of-way will not result in any impacts to these utility providers. According to California Government Code Section 65402,the abandonment of property must be in conformance with the General Plan. This request is consistent with the Butte County General Plan because it does not conflict with any adopted or proposed element of the General Plan. Determine this project to be Categorically Exempt under the California Environmental Quality Act Section 15305 Class 5(a). II. Recommend approval to the Board of Supervisors the Abandonment for Shirley Prusia, Mooretown Rancheria, of the public services right-of-way as shown on Attachment A, subject to the following findings: A. The proposed abandonment is in conformance with the Butte County General Plan. B. The proposed abandonment provide a reservation clause into the County's Resolution of Abandonment for any public utility provider in the County.
