H-C (Highway Commercial), R-1 (Residential), and A-R (Agricultural Residential) located on
Lower Wyandotte Road at Ophir Road, in the Oroville area. APN 036-310-164 and 036-190-003
(SH) (ABAN 01;01)
It was moved by Commissioner Lambert, seconded by Commissioner Cage, and unanimously carried to
approve the Abandonment for Shirley Prusia, Mooretown Rancheria subject to the following findings.
I. Determine this project to be Categorically Exempt under the California Environmental Quality Act
Section 15305 Class 5(a).
II. Recommend approval to the Board of Supervisors the Abandonment for Shirley Prusia, Mooretown
Rancheria, of the public services right-of-way as shown on Attachment A, subject to the following
findings: .
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The proposed abandonment provide a reservation clause into the County's Resolution of
Abandonment for any public utility provider in the County.

Attached for your staffs review and further action Is a copy of a petition for abandonment of
Lower Wyondotte Road R/W, .along with plats delineating the subject area. The $262.00
abandonment processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project Is categorically exempt
from environmental review and the proposed abandonment is In conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County Counsel and the Board. Note that there Is an
easement reservation for utilities. Copies of the letters from utilities are also attached.
Please advise us of the schedule of processing by your department and provide us a copy of
the Planning Commission minutes documenting the Commission's action.

We received a copy of your letter to Shirley Prusia of Mooretown Rancheria
regarding the subject abandonment.
Please be advised that PG&E has no objection to the proposed abandonment provided
a reservation clause and or P.U.E: is inserted into the.County's Resolution of
Abandonment to protect our existing gas and electric facilities at the subject locations.
If any construction activities are proposed within the subject area,please contact the
Underground Service Alert(U.S.A.), telephone 1-800-642-2444, at least two working
days prior to such work.
Any required alteration of our facilities to accommodate development should be
coordinated with PG&E as soon as possible so that we can provide adequate lead time
with our engineering department. Please contact us at 894-4749 regarding this issue.

1 have received a copy of your proposed abandonment on Lower Wyandotte Road. When 000
facilities were extended to serve the Rancheria,a 12°domestic water mainline was constructed on
this portion of right of way. The location of our facilities can be found in the plans your engineer
submitted to OND.
If you plan to proceed with the riga of way abandonment procedure,OWiD wit require a twenty foot
easement, ten feet on each side of any facility we own and operate in the affected area. The
district wi assist you in locating the exact alignment of the constructed facilities for ft necessary
survey work in establishing an easement.

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed will
not be in conflict with a General Plan. Staff has analyzed this request and recommends approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public services right-of-way
proposed for abandonment is approximately 1.14 acres in size, extending north 1200+/- feet on
Lower Wyandotte from Ophir Road, and east 500+/- feet on Lower Wyandotte Road from Ophir
Road. The General Plan land use designations for the properties involved include LDR (Low
Density Residential) and C (Commercial).
ANALYSIS: Pacific Gas and Electric (PG&E) and the Oroville-Wyandotte Irrigation District
commented on this project and do not object to the abandonment of the public services right-of-way.
Abandoning the right-of-way will not result in any impacts to these utility providers.
According to California Government Code Section 65402,the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted or proposed element of the General Plan.

Staff recommends that the Planning Commission take the following actions*
I. Determine this project to be Categorically Exempt under the California Environmental
Quality Act Section 15305 Class 5(a).
II. Recommend approval to the Board of Supervisors the Abandonment for Shirley Prusia,
Mooretown Rancheria, of the public services right-of-way as shown on Attachment A,
subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The proposed abandonment provide a reservation clause into the County's
Resolution of Abandonment for any public utility provider in the County.
