referenced abandonment was Categorically Exempt and recommended that the Board

Supervisors adopt a Resolution at their regular August 27, 2002,. meeting, setting a
public hearing for this abandonment at 11:00 a.m., September 24, 2002.

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed will
not be in conflict with the General Plan. Staff has analyzed this request and recommends
approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS:
The applicant proposes to abandon the westerly seven(7) feet of width of a twelve(12) foot wide
easement. This 140 foot long easement was created over lot 1 of the "Green Acres Subdivision"
Official Map of which was recorded in the Office of the Recorder of the County of Butte, State of
California, in Map of Records Book 35, Pages 6 and 7, on November 3, 1966.
ANALYSIS:

The remaining five (5) feet of easement area is used by the California Water Service Company,
Pacific Gas and Electric and AT&T Broadband. These utility companies have each submitted a
letter consenting to the abandonment. An existing pole sign will not be affected by the
abandonment.

ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Determine this project to be Categorically Exempt under the California Environmental Quality
Act, Section 15305.
IL Recommend approval to the Board of Supervisors the Abandonment of a seven (7) foot
portion of a twelve (12) foot wide easement as shown on Attachment A, subject to the
following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The abandonment area is not required for any public purpose.
C. The remaining five (5) feet of easement area serves the needs of the public.

abandonment of the northwesterly 7-feet of that certain 12-foot Public Utility Easement
over Lot 1 of the Green Acres Subdivision along with plats delineating the subject area.
The $262.00 abandonment-processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the
earliest opportunity, to be considered in regard to the findings that the project is
categorically exempt from environmental review and the proposed abandonment is in
conformance with the Butte County General Plan. Following Planning Commission
action our department will further process the abandonment with County counsel and
the Board of Supervisors. Copies of the letters from the utilities are also attached'.

Dear Mr. Delligatti:
We have reviewed your request for the abandonment of a portion of the 12 foot wide
public utility easement located along the easterly boundary line of the above referenced
parcel and find that we cannot abandon the easement as described in you request due to
necessary clearances and possible future needs.
However, PG&E has no objection to the abandonment of the westerly 7 feet of this same
easement.
You may use this letter in your further negotiations with the County of Butte.

Upon approval of the subject public utility easement reduction request and supporting
documentation, AT&T Broadband does not object to reducing the existing Public Utility
Easement located on APN 042-320-031 from twelve feet to five feet, resulting in the
abandonment of seven feet of easement. We agree that rights to total remaining five-foot portion
of the Public Utility Easement shall be reserved for our future use. See attached map for specific
locations.

Pacific Bell Telephone Company's Engineer has reviewed your recent request for
the abandonment of an additional two feet. This would leave Pacific Bell with a
total of Five feet for their facilities. Therefore, Pacific Bell Telephone Company has
no objection to the abandonment of the additional two feet.
We agree that the Rights to the aforementioned Five feet (5) of the PUBLIC
UTILITY EASEMENT shall be reserved for our future use.
