ADDITION TO CHICO NO. 1
DATE: APRIL 11, 2000
Attached for your staff's review and further action is a copy of a petition for abandonment of said
alleyways along with plats delineating the subject area. The $262.00 abandonment-processing
fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County Counsel and the Board. Note that there is an easement
reservation for utilities. Copies of the letters from utilities are also attached.
Please advise us of the schedule of processing by your department and provide us a copy of .
the Planning Commission minutes documenting the Commission's action.
If additional information is required, contact me at your convenience.

The undersigned, being ten or more freeholders, at least two of whom are residents of the Road District in
which some part of the highway affected is situated;. and who are taxable therein for highway purposes, do
hereby petition your Honorable Board of Supervisors in writing, in accordance with provisions of Section 8321 of
the Streets and Highways Code of the State of California, to ABANDON the following-described COUNTY
HIGHWAY of the COUNTY OF BUTTE:
Being a portion of Section 2,Township 21 North,Range 1 East,M.D.M.,Butte County, State of California and also being a portion of
Lots 10 and 14 as shown on the " Map showing Subdivisions of the McIntosh Tract, Butte County,Cal." which map was filed in the
office of the Recorder of the County of Butte, State of California October 27, 1900 in Book 2 of Maps at Page 164 and described as
follows;
Being those 16' (foot)wide public alleys as shown on the official map entitled, "GLENDALE Addition to Chico No. 1", which map
was filed in the office of the Recorder of the County of Butte, State of California, April 11, 1907 in Book 6 of Maps at Page 45, and
also being shown on that certain Record of Survey for John P.Jeffries,Robert C. Walters,Patrick S.Bernedo and Kevin Moretti,which
map was filed in the office of the Recorder of the County of Butte, State of California March 27, 1992 in Book 124 of Maps at Pages 77
and 78 and being more particularly described as follows;

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed will
not be in conflict with a General Plan. Staff has analyzed this request and recommends approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The three public alleys proposed for
abandonment are 16 feet wide, and range in length from 290 to 821 feet. These public alleys were
created in 1907 as part of the Glendale Addition to Chico No. 1 Subdivision(Map of Records Book
6, Page 45).
ANALYSIS: The alleys have never been used for public access.. Access to the affected parcels will
be via Polk Street. Abandonment of the alleys will not have an impact on vehicle circulation in the
area. An easement for public utilities will be reserved over the area proposed for abandonment.
According to California Government Code Section 65402, the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted or proposed element of the General Plan.
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:

I. Determine this project to be Categorically Exempt under the California Environmental Quality
Act, Section 15305.
H. Recommend approval to the Board of Supervisors the Abandonment for Patrick Bernedo of
three.public alleys as shown on Attachment A, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The public alleys are not required for access to any affected parcel.
C. An easement for public utilities will be reserved over the area proposed for
abandonment.

Attached for your staffs review and further action is a copy of a petition for abandonment of the
proposed abandonment along with plats delineating the subject area. The $262.00
abandonment processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County Counsel and the Board. Note that there is an easement
reservation for utilities. Copies of the letters from utilities are also attached.
Please advise us of the schedule of processing by your department and provide us a copy of
the Planning Commission minutes documenting the Commission's action.
All correspondence should be addressed to Butte County Public Works. If additional
information is required, contact me at your convenience.

RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC RIGHT OF WAY
RE: Proposed alley abandonment
Glendale Addition to Chico No.l
WHEREAS,this Board has received a petition from ten or more free-holders, requesting
the abandonment of a public right of way as described below, and at least two of the petitioners
are residents of the road district in which said public right of way is situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and
Highways Code (commencing with Section 8320) this Board shall set a date, hour and place for
a hearing on the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That this board hereby gives notice that at its regular meeting on
1999, at a.m., in the Board Chambers, Butte County Administration Building, 25
County Center Drive, Oroville California, a hearing shall be held to hear all persons interested in
the abandonment of that certain right of way located
Being a portion of Section 2,Township 21 North,Range 1 East,M.D.M.,Butte County, State of California and also being a portion of
Lou 10 and 14 as shown on the " Map showing Subdivisions of the McIntosh Tract, Butte County,Cal." which map was filed in the
office of the Recorder of the County of Butte, State of Califomia October 27, 1900 in Book 2 of Maps at Page 164 and described as
follows;
Being those 16' (foot)wide public alleys as shown on the official map entitled, "GLENDALE Addition to Chico No. 1", which map
was filed in the office of the Recorder of the County of Butte, State of Califomia, April 11, 1907 in Book 6 of Maps at Page 45, and
also being shown on that certain Record of Survey for John P.Jeffries,Robert C. Walters,Patrick S.Bemedo and Kevin Moretti,which
map was filed in the office of the Recorder of the County of Butte,State of Califomia March 27, 1992 in Book 124 of Maps at Pages 77
and 78 and being more particularly described as follows;

said GLENDALE Addition to Chico No. 1 and lying between the Southerly prolongation of the Easterly right of way line of Oak street
and the Westerly right of way line of the Southern Pacific Railroad as shown on said maps.
EXCEPTING AND RESERVING,as may be necessary,any existing public service easement and/or rights at any time,or from time to
time, to maintain, operate, replace, remove, renew or enlarge the existing public service facilities and facilities incidental thereto,
including access to protect the property from all hazards in,upon,and over the highway herewith to be abandoned.
The above described lands are hereby combined with and become a part of these lands as described in the deed to Patrick S. Bemedo
and Jill Bemedo, husband and wife as community property as filed for record in Butte County Officials Records at Serial Number 90-
07958.No additional lots or parcels are created hereby.
