Vicinity Map Zoning: A-R B: General Plan/Zoning Map APN: 031-275-001, 003, & 004 STAFF COMMENT State law requires that the Planning Commission find that an abandonment such as proposed will not be in conflict with a General Plan. Staff has analyzed this request and recommends approval. j PROJECT DESCRIPTION/SITE CHARACTERISTICS: The County right-of-way proposed for abandonment includes a 10 foot wide by approximately 1132 feet long the north side of Feather Avenue, Thermalito. This right-of-way was created in 1901 as part of the Thermalito Map (Lots 11, 12, 13, 14, & 15, Block 80, Thermalito Wall Maps 4 & 6). ANALYSIS: The original application requested an abandonment of a 10 foot wide strip along 10th Street and 12th Street, from Feather Avenue to Corona Avenue, as well as the 1132 feet along the north side of Feather Avenue. The applicant submitted a subsequent letter requesting an amendment to the original request, seeking only an abandonment along Feather Avenue. The County is going to maintain a reservation of easement for utilities on 10th Street and 12th Street. The right-of-way is 80 feet in width, while current County road standards require a 60 feet wide right-of-way. Approval of this request,while reducing the County right-of-way to 70 feet in width, will not result in any impacts to the right-of-way. Pacific Gas and Electric (PG&E) and Thermalito Irrigation District commented on this project and do not object to the abandonment of the portion of the right-of-way. According to California Government Code Section 65402,the abandonment of property must be in conformance with the General Plan. This request is consistent with the Butte County General Plan because it does not conflict with any adopted or proposed element of the General Plan. ACTIONS FOR CONSIDERATION Staff recommends the Planning Commission take the following actions: I. Enclosed is a copy of our electric plat map showing the approximate location of our electric-facilities in the subject area. Please be advised that it appears PG&E has overhead electric facilities within a portion of the subject area to be abandoned. PG&E has no objection to the proposed abandonment, provided a right of way easement or P.U.E. or P.S.E. is provided to protect our existing facilities. If however, you are able to determine that PG&E is clear of the proposed abandon area, we have no objection without reservation. If any construction activities are proposed within the subject area, please contact PG&E Co., telephone 1-800-743-5000 and the Underground Service Alert(U.S.A.), telephone 1-800-642-2444, at least 48 hours prior to such work. Dear Mr. Evans, We.are.in receipt of your correspondence 6f-40/,l.4/99,regarding the above referenced subject,.The abancionment.of,aportion of,10th Street is not.in the.best interest of Thermalito Irrigation District,.due.to the fact.the Districts water main is located within the area you wish to annex. T.I.D. is opposed to the abandonment of a portion of 10th St. Abandonment of a portion of 12th Street poses much the same problem with the exception, in this case, a sewer main line is involved. Once again T.I.D. is opposed to the abandonment of a portion of 12th Street. It is difficult for the District to address the issue of the abandonment of a portion of Feather Avenue without additional information such as: 1.) Your letter or drawing does not address the exact amount of abandonment you are requesting. 2.) Location of the Feather Avenue right-of-way centerline must be established before the District can make a decision regarding this portion of your plan. In conclusion, we would point out, Thermalito Irrigation District utility easement is well established, and.as far as we.are concerned.inviolate;since they have existed for 100 years.
