Marsha Christopher, (Item determined to be categorically exempt from environmental review),Abandonment of a portion of Crown Point Road(old Highway 32). The property is zoned"U"(Unclassified)and is located about 4 miles south of Forest Ranch on the east side of Deer Creek Highway and about 750 feet east of Deer Creek Highway in the Chico area. APN 056-040-022 (MM) (ABAN 03-01) Mr. Michelena said that Counsel informed him that the Agenda Report,that does say this item is in conformance with the General Plan, needs to state where the abandonment conforms with the General Plan. Counsel asked Mr. Michelena to add the policies and goals from the General Plan that this abandonment is in conformance with. Mr. Michelena said LUE Policy 5.Lb "Provide a circulation system and plan that is consistent with and will support existing and proposed patterns and densities of land use." He said the proposed abandonment is serving three parcels. Access to the property to the north would still be allowed if the aband6nment was approved. Circulation Element Goal#4 states"Provide for a road and highway network that meets the need of existing and anticipated the movements of people and goods." Policy 4.1.13 "The County will on an on going basis evaluate which roads are needed in the County road system and which roads should revert to private owner." Policy 4.1.14 "Proposals to abandon or close County roads and all right-of-way shall address the impacts of abandonment on local land uses identified in the General Plan and shall address the impacts of alternative public uses of the right-of-way, such as bike ways, riding trails, and hiking trails." Vice Chairman Lambert added that an abandonment was approved for Mr. Elliott in this area just a little while ago. Mr. Michelena said the Elliott abandonment is to the north and the road that services that private road, Crown Point Road, is a small section of private road and they split to the south as a private road and just this small section to the north, 1200 feet is public. Commissioner Leland asked when a road is abandoned, to whom is it abandoned, and where does the road go? Mr.Michelena said that there will be an access easement for the two parcels directly to the north and for public services also. Mr. Edell said Crown Point Road was old Highway 32. He said Crown Point Road goes to the Elliott property. He said he does not expect anymore abandonments of any part of Crown Point Road. He said the Abandonment Resolution reserves an easement for the property owners to the north and for public utilities to still be able to access the road. The reason for the abandonment request is to stop illegal dumping on the County portion of the road. There was a discussion on the Commission sending a report to the Board on this item. Mr. Edell explained the posting, noticing, and reporting requirements that are done at the time the item goes to the Board and not at this level. He told Mr. Wannenmacher that there was nothing in the Code to notice this consent item. It was moved by Commissioner Leland,seconded by Commissioner Marin,and unanimously carried to submit the report to the Board of Supervisors concerning Abandonment 03-01 for Marsha Christopher with the supplemental information submitted today as follows: I. Determine this project to be Categorically Exempt under the California Environmental Quality Act, Section 15301(c). II. Recommend approval to the Board of Supervisors the Abandonment request by Marsha Christopher of that portion of Public Crown Point Road lying within APN 056-040-022 as shown on Attachment A, subject to the following findings: A. The proposed abandonment is in conformance with the Butte County General Plan. B. An easement for ingress, egress, and road purposes will be reserved over the area proposed for abandonment for use by the properties (APN's 056-040-019 and 056- 040-018) to the north of the applicant's property (APN 056-040-022). The $262.00 abandonment-processing fee has been paid. Please have the proposed abandonment submitted to the Planning Commission at the earliest opportunity, to be considered in regard to the findings that the project is categorically exempt from environmental review and the proposed abandonment is in conformance with the Butte County General Plan. Following Planning Commission action our department will further process the abandonment with County counsel and the Board of Supervisors. Note that there is a public services easement reservation for utilities. Copies of the letters from the utilities are also attached. Please advise us of the schedule of processing by your department and provide us a copy of the Planning Commission minutes documenting the Commission's action.
