It was moved by Commissioner Nelson, seconded by Commissioner Marin, and unanimously carried to
recommend approval of the Abandonment for Deborah Ingvoldensen and Candice Grubbs as follows:
I. Find that this project is Categorically Exempt from environmental review under Section
15305,as defined by CEQA. The collection of fees pursuant to Fish and Game Code Section
711.4 and 14 CCR 753.5. is not required.
11. Recommend approval to the Board of Supervisors the Abandonment for Deborah Ingvoldsen
and Candice Grubbs, File # ABAN 04-03, of the public right-of-way as shown on
Attachment B, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The proposed abandonment provides a reservation clause in the County's Resolution
of Abandonment for public utilities.
C. The resulting width of the Oroville-Bangor Highway right-of-way will be consistent
with County standards.
D. The area to be abandoned is not needed for public bikeways or hiking and riding
trails.

Attached for your staff s review and further action is a copy of a petition for abandonment of a
portion of Oroville Bangor Highway south of Oroville, along with plats delineating the subject
area and letters from the utility companies. The $262.00 abandonment-processing fee has been
paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County counsel and the Board of Supervisors. Note that there is a
public services easement reservation for utilities. Copies of the letters from the utilities are also
attached.
Please advise us of the schedule of processing by your department and provide us a copy of the
Planning Commission minutes documenting the Commission's action.

Portion of Orville Bangor Highway in the Oroville Area, Butte County
Dear Mr. Edell:
In order to meet current and future telecommunication needs for our customers, SBC must request that
a permanent easement be retained prior to this street vacation. To protect SBC's rights for existing and
future telecommunication facilities, please incorporate the following language in any resolution or
ordinance of vacation:
"EXCEPTING AND RESERVING THEREFROM PURSUANT TO THE PROVISIONS OF Section
8340 of the Street and Highways Code and for the benefit of Pacific Bell Telephone Company(dba
as SBC West), the permanent easement and the right at any time or from time to time to construct,
maintain, operate, replace, remove, renew and enlarge lines,of pipe, conduits, cable wires, poles
and other convenient structures, equipment and fixtures for the operation of telegraph and
telephone lines and other communication facilities, including access and the right to keep the
property free from inflammable materials and wood growth, and otherwise protect the same from all
hazards, in, upon, over and across the portion of Orovil/6 Bangor Highway to be abandoned.
Upon receipt of a certified copy of the vacating ordinance or resolution to the address above, which
should include the foregoing language, this company shall have no objection to the proposed vacation.

Dear Mr. Edell:
Please be advised that PG&E has electric pole line facilities extending along Oro-
Bangor Hwy,portions of which may extend into the proposed abandonment areas.
PG&E has no objection to the proposed abandonment provided that a reservation
clause and or P.U.E is inserted in the County's Resolution of Abandonment, to protect
I any existing.facilities that extend into the abandonment areas. Should it be determined
that our facilities are clear of the abandonment areas then no reservations would be
required.
If any construction activities are proposed within the subject area, the contractor
needs to contact the Underground Service Alert(U.S.A.), telephone 1-800-227-2600,
at least two working days prior to such work.
Any required alteration of our existing facilities to accommodate private project
development will be at the developers expense, and should be coordinated with
PG&E as soon as possible so that there is adequate lead time with our Service
Planning Department.
