The property is located about 4 miles south of Forest Ranch on the east side of Deer Creek
Highway and about 1,500 feet north of Crown Point Road,in the Chico area. APN 056-040-
019 (CD) (ABAN 02-01)
It was moved by Commissioner Leland; seconded by Commissioner Nelson, and unanimously
carried to approve the Consent Agenda. Each hearing subject to individual findings and conditions
for that project.
I. Determine this project to be. Categorically Exempt under the California Environmental
Quality Act, Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment request by Hollis Elliott
of that portion of Public Crown Point Road,lying within APN 056-040-019 as shown on
Attachment A, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. An easement for ingress, egress, and road purposes will.be reserved over the area
proposed for abandonment for use by the property to the north of this property.
C.. An easements for public utilities will be reserved over the area proposed for
abandonment.

Sirs:
We have complied with all the requirements to have the northerly section of public Crown Point Road that runs
through APN 056-040-022 included in ABN no. 262.023, as set forth by Stuart Edell at his June 26, 2002 meeting
with Dan and Marsha Christopher, Carl Durling, Tom Kikkendahl and Bob Jones. We have stated our
expectations regarding County stipulated access across our property to utilities and all property owners to our
north, thus satisfying all the stated objections of Elliott and Colleran. We request your office proceed with the
joined abandonment.
Were the County to abandon as a public right of way that portion of Crown Point Road extending from our
northerly property line to it's intersection with the ridge access road without first securing a grant of access
easement from Elliott and Colleran to Mahan, Simms and the Christopher's, it would substantially prejudice and
place an undue burden on us to secure such an easement through litigation were Elliott and Colleran unwilling to
grant such.
Your review of the ridge area should readily confirm the ridge access road is the only existing road to the top of
the ridge and our planned building site. As we have previously pointed out to you, a substantial portion of this
road is on our property. Elliott and Colleran have stated the road existed prior to their purchase of APN 056-040-
019. Based on the obvious geography of this road and it's history,we contend the ridge access road was
constructed for the benefit of access to and from Crown Point Road for all properties it traverses. A determination
of specific property owners rights to access any and/or all portions of this road is still pending. We strongly object
to any version of ABN no. 262.023,joined or separate,that does not contain stipulated access for us,the property
owners of APN 056-040-022 and our successors in interest for access across APN 056-040-019 to the
intersection of Crown Point Road and the ridge access road.
If the County cannot secure stipulated access to all interested parties across Crown Point Road to the intersection
of the ridge road we request the County take a neutral position at this time and postpone abandonment
proceedings for ABN no. 262.023 until such a time as ridge road rights of access have been determined.
We respectfully request to be kept apprised of any and all proceedings that may be undertaken by the County to
abandon any part of Crown Point Road. Until further notice, kindly direct all future communications with us to

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed will
not be in conflict with a General Plan. Staff has analyzed this request and recommends approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The area proposed for abandonment is
part of Old State Highway 32 renamed Crown Point Road as a public road when it was relinquished
by the State to Butte County.
ANALYSIS: The public right-of-way portion of Crown Point Road extends east from Deer Creek
Highway about 1,200 feet through a privately owned parcel to a point where it turns north for about
650 feet to the point of beginning of the abandonment. Where Crown Point Road turns north is also
the beginning point of a private road also named Crown Point Road which road extends further east
then switchbacks down into a canyon. The north extension of Public Crown Point Road serves only
two properties. The portion proposed for abandonment is at the end of this extension. The road
right-of-way has been used as an illegal dumping area which is the reason for the requested
abandonment.

Pacific Gas and Electric Company and the Pacific Bell Company have supported the abandonment if
their existing easement rights are maintained.
According to California Government Code Section 65402,the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted or proposed element of the General Plan.
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Determine this project to be Categorically Exempt under the California Environmental
Quality Act, Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment request by Hollis Elliott
of that portion of Public Crown Point Road lying within APN 056-040-019 as shown on
Attachment A, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. An easement for ingress, egress, and road purposes will be reserved over the area
proposed for abandonment for use by the property to the north of this property.

Dear Ms. Christopher:
We have discussed your request to have your proposed abandonment of Crown Point Road
included with Mr. Elliott's abandonment request, with Mr. Elliott. Mr. Elliott's attorney has
responded indicating that he does not want the two proposals combined; therefore we will
process your request as a separate application. Please note that the only involvement by the
County is related to the abandonment of the current Countymaintained portion of Crown Point
Road. We are not involved in and will not resolve private property issues such as driveway
locations and use. The abandonment of a County road cannot cut off the sole source of access to
a property, therefore if you proceed with your request, we will require retention of an easement
for the benefit of the Elliott (AP 056-040-019) and the USA (AP 056-040-018)parcels. Also the
letters you have provided from the utility companies request reservation of an easement to allow
maintenance of their facilities.
In order to process your request for abandonment we will need the following information:
1. A legal description and map or plat of the proposed area to be abandoned, which
conforms to the map submitted to the utilities. We requested Sierra West Surveying
correct errors in their legal description on July 26, 2002, and will need those errors
corrected before we proceed with your request.
2. The attached "PETITION FOR ABANDONMENT OF PUBLIC HIGHWAY"
with a copy of the corrected legal description (per item 1 above) on page 1 and original
signatures and address information of ten free holders (owners 10 different properties) on
page 2, returned to this office.
3. A check in the amount of$262.00, payable to the County of Butte, for application
fees.

4. A separate check in the amount of$25.00, payable to the Butte County Recorder,
for filing of the Notice of Determination, if the abandonment is approved. If the
abandonment is not approved the check will be returned to you.

complete request will be processed through Public Works and the Planning Commission. If
abandonment is recommended by these entities we will request the Board of Supervisors set a
public hearing date and take action on your request.

Dear Mr Edell:
I am the attorney for Hollis Elliott and Elizabeth Colleran who reside east of Highway 32 on Crown Point
Road. They have pending before the County an application for abandonment of that portion of Crown Point Road
that crosses their property,being application ABN no. 262.023.
They have informed me that the owners of that parcel adjacent to them immediately to the south,Marcus
Mahan, Tina Simms, and Dan and Marsha Christopher,have recently tacked onto their application their own
application for abandonment of that stretch of Crown Point Road traversing their property extending from the
road's intersection with Highway 32 to the Elliott-Colleran property line. My clients object and do not consent to
either this application being tacked on to their application or to any abandonment of Crown Point Road from its
Highway 32 intersection to the Elliott-Colleran property line without provision of an access easement to them.
Your review of a parcel map of the property should readily confirm that Crown Point Road is the only
means of access that my clients have to their property. Were the County to abandon as'a public right of way that
portion of Crown Point Road extending from its intersection with Highway 32 to the Elliott-Colleran property line
without first securing a grant of an access easement from Mahan, Simms and the Christophers to Elliott and
Colleran would substantially prejudice and place an undue burden on Elliott and Colleran to secure such an
.easement through litigation were Mahan, Simms and the Christophers unwilling to grant such.
It goes without saying that Hollis Elliott and Elizabeth Colleran respectfully request that they be kept

Thank you for your assistance in the matter of this abandonment. I appreciate your phone
call and the information you provided. Not being experienced in matters such as these, I
rely on the help of qualified people.
If it is not an imposition would it be possible for you to send me a letter clarifying the
points you shared with me on the telephone. I'm not sure I clearly understood your
explanation about the letters the County would be sending the Elliott's and us nor when
they would be sent. Also, did you say the Abandonment would include a stipulation
providing reciprocal access for the Elliott's and us over each other's portion of the
abandoned road? We only need access on the abandoned road.to the point where the
private ridge road intersects. You mentioned the issue of the locked gate. I became a
little confused when we started talking about the County's position before and after the
abandonment. Could you clarify that for me?
I regret asking for more of your time; especially at what I am sure is a busy time of the
year for you. Please be assured it will be appreciated.

I spoke with Stu Edell regarding a response to Marsha Christopher. I also followed up
with her by phone. The issue of the gate blocking Old Hwy 32 is a public works issue,
but will be resolved by the abandonment. The Christophers have not been successful in
communicating with Hollis Elliott, the property owner who first requested the
abandonment.
In order for Elliott to gain access to his home, and the Christophers to gain access to their
future home site, each party must traverse the others property via Old Hwy 32 then a
private drive. I explained to Marsha Christopher that a condition would be placed on the
abandonment that a reciprocal private road agreement be recorded allowing each the use
of the Old Hwy 32 right-of-way. However, we could not place a condition on the
abandonment that reciprocal access agreement to the private drive be created.

Dear Mr. Crump,
I am sending this request to you on the advice of Tom Kikkendahl in Land Development
because Stuart Edell is on vacation for the next two weeks. Tom said you might be able
to help us resolve a problem. By way of background information, I've enclosed copies of
all the information I have on the subject of the proposed Abandonment of a portion of
Crown Point Road, including my letters and a map/diagram.
Referring to paragraph's three and four in our letter to Mr. Edell dated July 8, 2002, my
husband and I requested Mr. Edell's assistance gaining access through the gate, short of
having it removed. Until all the abandonment issues are decided, do the Elliott's have
permission from the County to lock us out? If not, would you contact the Elliott's and
ask them to let us through the gate?
I know it is the practice of our various County departments to mediate or help resolve
problems between neighbors when possible. Therefore, I'm sure Mr. Edell must have
been unaware, at the time he gave the Elliott's permission to install the gate,that they
would use it to block our only access to the top of the ridge

Dear Mr. Edell,
Pursuant to the instructions received from you, Mr. Carl Durling and Mr. Tom
Kikkendahl at our June 26, 2002 meeting we have engaged a surveyor and contacted the
two primary utility companies. The discrepancy in the County description of the Petition
for Abandonment dated April 8, 2002, did cause confusion,-however, we concur that the
point of beginning should be, " at a point on the Centerline...known as Crown Point
Road... being 1/10 of a mile+ easterly of State Highway 32. Thence, northerly 5/10 of a
mile+along said Centerline of Crown Point Road to a point...designated as APN 056-
040-018...". That beginning point would be on our parcel and the northerly direction
would cover the portion of Crown Point Road in question. Tom Winkle at Sierra West
Surveying will provide the legal description you are requiring in order for that portion of
Crown Point Road to be included in the current Petition for Abandonment submitted by
Hollis Elliott+Please see enclosed map/photo detail. We have spoken with Bob Redd at
Pacific Bell and, because time is of the essence, faxed him as he requested all the
information we have on the subject plus a written request for a letter from his agency.
Donald Chambers at Pacific Gas and Electric was not in when we called so we left a
message and faxed him the same packet of information and letter as sent to Mr. Redd.
We appreciate the waiver of the abandonment processing fee by Carl Durling and found
his and Tom Kikkendahl's comments and suggestions enlightening and helpful.
Mr. Edell,the road that intersects the northerly portion of Crown Point Road on APN
056-040-019 and leads to the top of the ridge is the only access to the top of our property.
We view this road as a reciprocal access for ourselves and the Elliott's. Fifty percent of
this road is built on our property and, indeed, the Elliott's could not access their home
without using the entire road. Please see enclosed map/photo detail. Based on comments
in your letter to Fred Davis dated May 29, 2002, concerning the proposed abandonment,
we fully expect the County to stipulate written access to utility companies and all
property owners to our north. Likewise, we expect a written stipulation by the County
allowing us access on the abandoned portion of Crown Point Road where it crosses APN

056-040-019 to and including the point of intersection with the ridge access road. Kindly
contact us as soon as the access stipulations have been determined.
We have not forgotten your offer to require Mr. Elliott remove the gate you granted him
permission to install across Crown Point Road prior to County approval of his
Abandonment Petition. We sincerely hope it will not come to that. So far, however,the
Elliott's will not let us through the gate. As we mentioned at our meeting, illegal
dumping is a problem along Crown Point Road and we were sorry that the gate was
removed from the original site because it helped control the problem. It seems drastic to
have the Elliott's remove their gate, again, when all that's needed is their cooperation.
Short of having them remove the gate, isn't there any way you can help resolve this
problem?

This letter is a follow-up to our telephone conversation on April 2, 2002 regarding the
portion of Old Highway 47 that transects our property(APN 056-040-022-000). In that
conversation I conveyed our concerns about the history of illegal dumping at certain sites on
this portion of the road. I expressed dismay over the removal of a gate across a section of
the road, installed prior to our ownership by the property owner next door to help to
discourage dumping. I mentioned being told about a petition being circulated by this same
property owner, Hollis Elliott (APN 056-040-019), requesting the County to abandon a
portion of Old Highway 47. And, finally, I asked for help/suggestions to eliminate the
dumping including, but not limited to,County abandonment of a certain portion of this
Highway.
We are taking what steps we can to discourage illegal activities like dumping. We've posted
signs that include our telephone number and are making an effort to meet as many canyon
residents as possible in order to encourage open lines of communication. We have left
several messages for Mr. Elliott•to give us a call because,among other things,we support
the suggestion that the County abandon part of the old highway if that will enable us to
install a gate and fence on our property to prevent dumping. Unfortunately,•ns of the date
of this letter we still have not heard from him.
If a County representative plans to make a site inspection we would like to be present. My
husband, Dan,and I will be away from Butte County until April 30, 2002. However, we can

Pursuant to the instructions received from you, Mr. Carl Durling and Mr. Tom
Kikkendahl at our June 26, 2002 meeting we have engaged a surveyor and contacted the
two primary utility companies. The discrepancy in the County description,of the Petition
for Abandonment dated April 8, 2002, did cause confusion, however, we concur that the
point of beginning should be, " at a point on the Centerline...known as Crown Point
R
Road... being 1/10 of a mile+easterly of State Highway 32. Thence,northerly 5/10 of a
mile +along said Centerline of Crown Point Road to a point...designated as APN 056-
040-018....". That beginning point would be on our.parcel and-the northerly direction
would cover theportion of Crown Point Road,in question.+ TomWinkle at Sierra West
Surveying will provide the legal description you are requiring in order for that portion of
Crown Point Road to be included in the current Petition for Abandonment submitted by
Hollis Elliot&Please see enclosed map/photo detail. We have spoken with Bob Redd at
Pacific Bell and, because time is of the essence, faxed him as he requested all the
information we have on the subject plus a written request for a letter from his agency.
Donald Chambers at Pacific Gas and Electric was not in when we called so we left a
message and faxed him the same packet of information and letter as sent to Mr. Redd.
We appreciate the waiver of the abandonment processing fee by Carl Durling and found
his and Tom Kikkendahl's comments and suggestions enlightening and helpful.
Mr. Edell, the road that intersects the northerly portion of Crown Point Road on APN
056-040-019 and leads to the top of the ridge is the only access to the top of our property.
We view this road as a reciprocal access for ourselves and the Elliott's. Fifty percent of
this road is built on our property and, indeed, the Elliott's could not access their home
without using the entire road. Please see enclosed map/photo detail. Base&on comments
in your letter to Fred Davis dated May 29,2002, concerning the proposed abandonment,
we fully expect the County to stipulate written access to utility companies and all-, .•
property'owners to our north. Likewise,,we expect of writtemstipulation by the County

contact us as soon as the access stipulations have been determined.
We have not forgotten your offer to require Mr. Elliott remove the gate you granted him
permission to install across Crown Point Road prior to County approval of his
Abandonment Petition. We sincerely hope it will not come to that. So far, however, the
Elliott's will not let us through the gate. As we mentioned at our meeting, illegal
dumping is a problem along Crown Point Road and we were sorry that the gate was
removed from the original site because it helped control the problem. It seems drastic to
have the Elliott's remove their gate, again, when all that's needed is their cooperation.
Short of having them remove the gate, isn't there any way you can help resolve this
problem?

This letter is a follow-up to our telephone conversation on April 2, 2002 regarding the
portion of Old Highway 47 that transects our property (APN 056-040-022-000). In that
conversation I conveyed our concerns about the history of illegal dumping at certain sites on
this portion of the road. I expressed dismay over the removal of a gate across a section of
the road, installed prior to our ownership by the property owner next door to help to
discourage dumping. I mentioned being told about a petition being circulated by this some
property owner, Hollis Elliott (APN 056-040-019), requesting the County to abandon a
portion of Old Highway 47. And, finally, I asked for help/suggestions to eliminate the
dumping including, but not limited to, County abandonment of a certain portion of this
Highway.
We are taking what steps we can to discourage illegal activities like dumping. Weve posted
signs that include our telephone number and are making an effort to meet as many canyon
residents as possible in order to encourage open lines of communication. We have left
several messages for Mr. Elliott to give us a call because,among other things,we support
the suggestion that the County abandon part of the old highway if that will enable us to
install a gate and fence on our property to prevent dumping. Unfortunately, as of the date
of this letter we still have not heard from him.
If a County representative plans to make a site inspection we would like to be present. My
husband, Dan,and I will be away from Butte County until April 30, 2002. However,we can

expectations regarding County stipulated access across our property to utilities and all property owners to our
north,thus satisfying all the stated objections of Elliott and Colleran. We request your office proceed with the

Were the County to abandon as a public right of way that portion of Crown Point Road extending from our
northerly property line to it's intersection with the ridge access road without first securing a grant of access
easement from Elliott and Colleran to Mahan, Simms and the Christopher's, it would substantially prejudice and
place an undue burden on us to secure such an easement through litigation were Elliott and Colleran unwilling to
grant such.
Your review of the ridge area should readily confirm the ridge access road is the only existing road to the top of
the ridge and our planned building site. As we have previously pointed out to you, a substantial portion of this
road is on our property. Elliott and Colleran have stated the road existed prior to their purchase of APN 056-040-
019. Based on the obvious geography of this road and it's history,we contend the ridge access road was
constructed for the benefit of access to and from Crown Point Road for all properties it traverses. A determination
of specific property owners rights to access any and/or all portions of this road is still pending. We strongly object
to any version of ABN no. 262.023,joined or separate,that does not contain stipulated access for us,the property
owners of APN 056-040-022 and our successors in interest for access across APN 056-040-019 to the

SUBJECT: PROPOSED ABANDONMENT OF CROWN POINT ROAD,

Attached for your staff's review and further action is a copy of a petition for abandonment of
Crown Point Road in the northwest quarter of the southeast quarter of Section 24, Township 23
North, Range 2 East, M.D.M., along with plats delineating the subject area. The $262.00
abandonment processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte .
County General Plan. Following Planning Commission action our department will further
process the abandonment with County counsel and the Board of Supervisors. Note that there is a
public services easement reservation for utilities and access for the property to the north. Copies .

The undersigned, being ten or more freeholders, at least two of whom are residents of the Road District in
which some part of the highway affected is situated; and who are taxable therein for highway purposes, do
hereby petition your Honorable Board of Supervisors in writing, in accordance with provisions of Section 8321 of
the Streets -and Highways Code of the State of California, to ABANDON the following-described COUNTY
HIGHWAY of the COUNTY OF BUTTE:
All that certain real property situate in the County of Butte, State of California, described as follows:
Being a portion of that certain County of Butte road known as "Crown Point Road", lying within the Northwest
one-quarter of the Southeast one-quarter of Section 24, Township 23 North, Range 2 East, M.D.M., and also
being a portion of the County of Butte Assessor's maps in Book 56 of maps at Page 40, being Parcel 19, and also
being shown on that certain State of California, Division of Highways ABANDONMENT MAP and
RELINQUISHMENT MAP for Relinquishment to the COUNTY OF BUTTE under Relinquishment Request No.
24145-X approved August 20, 1971, and recorded September 1, 1971 in State Highway Map Book No. 4 at Pages
27 & 28 in the Office of the Recorder, County of Butte, State of California, and also being more particularly
described as follows;
Beginning at a point on the Centerline of said County of Butte road known as "Crown Point Road", said point
also being on the south line of said Northwest one-quarter of the Southeast one-quarter of Section 24, and also
being 1/10 of a mile± easterly of State Highway 32.
THENCE, Northerly 5/10 of a mile± along said Centerline of"Crown Point Road" to a point lying on the North
line of said Northwest One-quarter of the Southeast one-quarter of Section 24, said point also being on the most
southerly boundary line of that certain parcel of land currently owned by U.S.A., and designated as Assessor's
Parcel number 056-040-018, and the end of the County of Butte maintained portion of said Crown Point Road.

PG&E has been requested to provide'a letter stating our concerns, if any,regarding
the subject abandonment.
Please be advised that PG&E has the need and the rights to utilize said road to operate
and maintain our existing pole facilities in this area. PG&E has no objection to the
proposed abandonment provided that a reservation clause is inserted in the County's
Resolution of Abandonment, to protect our existing rights to use said road when
necessary.
If any construction activities are proposed within the subject area,please contact the
Underground Service Alert (U.S.A.),telephone 1-800-227-2600, at least two working
days prior to such work.

On March 2, 2002, we received your letter concerning your request with Butte County for
abandonment of a portion of Crown Point Road, A.P.N. 056-040-019, Office File # (262.023).
Butte County had rejected your request because they felt the subject portion of the county road was
the only access to federal lands described as M.D.M., T.23N., R.2E.,Section 24. A field visit was
conducted to determine whether adequate access could be retained or if an easement would be
required prior to county abandonment of the road. It was discovered that Crown Point Road
continues north from your property through federal lands and then joins State Highway Route 22.
Although the portion of Crown Point Road across federal lands may be abandoned, it still traverses
across federal lands and therefore remains public access. Therefore, adequate access exists without
use of the portion of Crown Point Road across your private land. It is the opinion of this office that an
..easement would not be necessary and we have no concerns with abandonment of the portion of
Crown Point Road across A.P.N 056-040-019.
