APN 030-360-082, 083, 084 (SB) (ABAN 04-03). Continued from earlier in the meeting. i i Mr. Baker gave a brief summary. This item was opened to the public. John Christofferson, GDA, said when they first circulated the request for abandonment to the utility companies there was a response that they have utilities within the areas proposed to be abandoned and upon inspection of the areas he found that there are only two areas that had utilities in place. He said one area is along the centerline of 16th Street and the other was along the south side of Feather Avenue, easterly of 16th Street. He said after reading staff analysis, he took it to mean that the reservation for public utilities was to be made blanketed for the abandonment. He said that is not the case. Chainnan Leland asked if the purpose of reserving the areas for the easement for utilities is only to accommodate existing infrastructure or is it in anticipation of future utilities being added. Mr. Christofferson said it could be both. He said the Code is not that specific. He said all the responses from the utility companies indicate that they do not need the strips along 18th Street or along Feather Avenue. Eric Schroth, Public Works, said he did not have copies of the letters from the utility company stating that they do not desire the reservations on 18th Street and Feather Avenue for future utilities. It was moved by Commissioner Evans, seconded by Commissioner Lambert, and unanimously carried to move this item to the second item on the agenda to give Public Works a chance to look at the letters in the file. - ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 22, 2004 ■ PAGE 5 ■ 0 Chuck LaFlamme, (item determined to be Categorically Exempt from environmental review), Abandonment of a portion of the 16`h Street, 18`h Street, and Feather Avenue right-of-ways. APN 030-360-082, 083, 084 (SB) (ABAN 04-03). This hearing was continued from earlier in the meeting. Ms. Christopher said the issue was with Page 2 of the Staff Report and bullet 3. She said the statement reads that the utility reservation was all of the abandonment area, and that was not ,accurate. She said the only area to be reserved is by PG&E on the two sections of 16`h Street. Commissioner Evans asked that the Agenda Report be amended to reflect PG&E only according to the exhibit. It was moved by Commissioner Evans,seconded by Commissioner Marin,and unanimously carried to recommend to the Board approval of the Abandonment for Chuck LaFlamme, subject to the findings listed below, adding"for the areas where utilities are existing as shown on the exhibit"to Item E. at the end of the sentence. I. Find that this project is Categorically Exempt from environmental review under Section 15305,as defined by CEQA. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5. is not required. Ii. Recommend approval to the Board of Supervisors the abandonments for Chuck LaFlamme, File#ABAN 04-02,of the three public right-of-ways as shown on Attachment B, subject to the following findings: A. The proposed abandonments are in conformance with the Butte County General Plan. B. The resulting width of the right-of-ways for 181h Street and Feather Avenue will still exceed the minimum right-of-way width of 60 feet required by the Butte County Subdivision Ordinance. C. The abandonment of the right-of-way for 16`h Street will not cause any significant impacts to future development or traffic circulation in the Thermalito area. j D. The areas to be abandoned are not needed for public bikeways or hiking and riding trails. E. The proposed abandonments provide a reservation clause in the County's Resolution of Abandonment for public utilities for the areas where utilities are existing as shown on the exhibit. F. Under "analysis", third paragraph, you state that the utility agencies request that a reservation be withheld for their utilities. This is not totally correct. There is only one utility agency that has made such a request, PG & E. Their,request is for an easement to cover their utilities within those areas as specified on the abandonment plat. Please refer to Note "C" on the abandonment plat. Please be sure.that the information provided to the Commission and the Board of Supervisors properly reflects the proposed abandonment. ANALYSIS: • After the abandonment, the remaining right-of-way for 18`h Street and Feather Avenue would still be in excess of the County standard of 60 feet in width. The abandonment of the 4.5-foot strip along 18`h Street would result in both sides of the right-of-way having an equal distance from the centerline. The Resolution of Abandonment will provide a reservation clause for public utilities. • According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. APPLICATION TO P.E.R.S.: The administration committee had asked that the District make preliminary application to P.E.R.S.,as suggested by Consultant Fred Davis. The cost for doing so is$700.00 per application. Director Huston motioned,seconded by Director Thompson to make application. Motioned carried by all ayes. SC-OR REPORT: President Reynolds stated that SC-OR had renewed the contract with Attorney Battle and there was a 15%savings on solar. SCHULMAN REQUESTED REFUND ON EDU: A letter was included in the packet from Scott Schulman requesting a refund on edu's. A rental house had burned and he was requesting a reduction on edu's for the second unit. Manager Bird explained to the Board that the 2"d edu had been removed from his account after receiving the letter but he did not recommend a refund for the past months as that was Mr.Schulman's'responsibility to notify the District in a timely manner. Director Thompson motioned,seconded by Director Medford to deny request. Carried by all ayes. REQUEST FOR VARIANCE: Chateau Mobile Estates had requested a variance to place a mobile home 2"over the sewer line. Manager Bird had responded with a letter of denial stating it was impossible for the District to responsibly grant such a request since the line in question is the Ruddy Creek line. CITY OF OROVILLE RAISING SEWER RATES: Manager Bird had received a call from the City of 0roville stating they were raising their sewer rates and asking if TID would be raising their rates also? LOAPUD will be raising their rates in July,too. There was no discussion regarding TID raising rates. SUPERINTENDENT'S REPORT: 1.) Operations Report for the month of May 2003 shows production of 7,535,160 cubic feel of water with a net loss of 3.54%.Concow Reservoir was 81.8 feet and spilling.The rainfall for May was 5.69"and the cumulative to date was 54.70". The normal biological sampling was done with no problems. Jet rodding on sewer main had been completed.Leaks.werc repaired and the meter change out program continued. Weed abatement had been done. Preventive maintenance was done at treatment plant. 2.) A mainline leak at Grand Avenue,between 7"&10",had been repaired. It was caused by failure of steel main welded joints. 3.) A copyr of a Sacramento Bee newspaper article concerning water districts,not necessarily favorable,was placed in the packet. • 1268 ° 4.) Two direct-access bills are before the Assembly and if passed,larger power users would be able to choose their electrical supplier. 5.) The vac-truck being used for demonstration was proving to be extremely useful. Field operations recommended to purchase it as soon as possible. 6.) Included in the packet was the monthly agenda minutes for the Board Members to review. BOARD ITEMS: Director Huston suggested staled all people in his division that he had talked to were interested in the solar project. He was also stated it was a pleasure to be working with Mr.Davis. CLOSED SESSION: President Reynolds adjourned the meeting for a short break and resumed in closed session for Public Employee MOU and performance evaluation of Manager Bird. The Board reconvened in Open Session at 4:25 p.m. The president announced.that with respect to Ilcnm X1.1.,"Personnel ConsultanUEmployce MOU Negotiations,"that the Board had provided further directions to its labor negotiator Fred Davis. With respect to the Item X1.2.,"Public Employee Evaluation-General Manager;'the president asked Attorney . Jeff Carter to discuss the proposed annual evaluation procedure unanimously approved by the Board. Carter stated that he and Fred Davis had been asked by the Board to prepare a written general manager annual evaluation form which would be distributed to each director for his completion. He stated that in conjunction with the evaluation form,the Board requested that Manager Bird provide a written statement as to his goals and objectives for the 2002-2003 fiscal year of the District as well as his assessment of how well they were met,and a statement of his desired goals and objectives for the 2003-2004 fiscal year. Carter suggested that the evaluation form and the statements of goals and objectives should be distributed to the board members by July 15,2003 and the completed forms should be returned by the board members to the personnel committee in care of Carter's office no later than August G, 2003. The administration committee would then synthesize the evaluation into one form and submit it to the Board by August 13,2003 in order that the Board may act upon time administration committee's recommended evaluation form at its board meeting on August 19, 2003. Once approved,the evaluation form will be distributed to General Manager Bird who will be asked to review it and provide comments no later than September 5,2003. The Board will than act to finalize the annual evaluation at its regular meeting on September 16,2003. Any adjustment in salary will be retroactive to July 1,2003. ABANDONMENT REQUESTED: The Ruddy Creek Partnership had requested an abandonment of approximately 4'of public right-of-way on the East side of 18"Street,between Feather Avenue and Alma Street and 10'along the South side of Feather Avenue between 18"'S 16"'Streets. There arc no TID utilities within the proposed abandonment area. Director Huston motioned,seconded by Director Medford,to grant request of abandonment. Carried by all ayes. APPLICATION TO P.E.R.S.: The administration committee had asked that the District make preliminary application to P.E.R.S.;as suggested by Consultant Fred Davis. The cost for doing so is$700.00 per application. Director Huston motioned,seconded by Director Thompson to make application. Motioned carried by all aycs: SC-OR REPORT: President Reynolds stated that SC-OR had renewed the contract with Attorney Battle and there was a 15%savings on solar. SCHULMAN,REQUESTED REFUND ON EDU: A letter was included in the packet from Scott Schulman requesting a refund on edu's. A rental house had burned and he was requesting a reduction on edu's for the second unit. Manager Bird explained to the Board that the 2nd edu had been removed from his account after receiving(he letter but he did not recommend a refund for(lie past months as that was Mr.Schulman's'responsibility to notify the District in a timely manner. Director Thompson motioned,seconded by Director Medford to deny request. Carried by all aycs. REQUEST FOR VARIANCE: Chateau Mobile Estates had requested a variance to place a mobile home 2"over die sewer line. Manager Bird had responded with a letter of denial stating it was impossible for the District to responsibly grant such a request since the line in question is the Ruddy Creek line. CITY OF OROVILLE RAISING SEWER RATES: Manager Bird had received a call from the City of Oroville stating they were raising their sewer rates and asking if TID would be raising their rates also? LOAPUD will be raising their rates in July,too. There was no discussion regarding TID raising rates. SUPERINTENDENT'S IZEI'ORT: 1.) Operations Report for the month of May 2003 shows production of 7,535,160 cubic feet of water with a net loss of 3.54%.Concow Reservoir was 81.8 feet and spilling.The rainfall for May was 5.69"and the cumulative to date was 54.70". The normal biological sampling was done with no problems. Jet rodding on sewer main had been completed.Leaks were repaired and the meter change out program continued. Weed abatement had been done. Preventive maintenance was done at treatment plant. 2.) A mainline leak at Grand Avenue,between 7ih&10",had been repaired. It was caused by failure of steel main welded joints. 3.) A copy of a Sacramento Bee newspaper article concerning water districts,not necessarily favorable,was placed in the.packet. 0 0 1268 • 4.) Two direct-access bills are before the Assembly and if passed,larger power users would be able to choose their electrical supplier. 5.) The vac-truck being used for demonstration was proving to be extremely useful. Field operations recommended to purchase it as soon as possible. G.) Included in the packet was the monthly agenda/minutes for the Board Members to review. BOARD ITEMS: Director Husfon suggested staled all people in his division that lie had talked to were interested in the solar project. He was also stated it was a pleasure to be working with Mr.Davis. CLOSED SESSION: President Reynolds adjourned the meeting for a short break and resumed in closed session for Public Employee MOU and performance evaluation of Manager Bird. The Board reconvened in Open Session at 4:25 p.m. The president announced that with respect to Item X1.1.,"Personnel Consultant/Employce MOU Negotiations,"that the Board had provided further directions to its labor negotiator Fred Davis. Willi respect to the Item X1.2.,"Public Employee Evaluation-General Manager,"the president asked Attorney Jeff Carter to discuss the proposed annual evaluation procedure unanimously approved by the Board. Carter slated that lie and Fred Davis had been asked,by the Board to prepare a written general manager annual evaluation form which would be distributed to each director for his completion. lie stated that in conjunction with the evaluation form,the Board requested that Mauiager Bird provide a written statement as to his goals and objectives for the 2002-2003 fiscal year of the District as well as his assessment of how well they were met,and a statement of his desired goals and objectives for the 2003-2004 fiscal year. Carter suggested that the evaluation form and the statements of goals and objectives should be distributed to the board members by July 15i 2003 and the completed forms should be returned by the board members to the personnel commnitlee in care of Carter's office no later than August G, 2003. The administration committee would then synthesize the evaluation into one form and submit it to the Board by August 13,2003 in order that the Board may act upon the administration committee's recommended evaluation form at its board meeting on August 19, 2003. Once approved,the evaluation form will be distributed to General Manager Bird who will be asked to review it and provide comments no later than September 5,2003. The Board will than act to finalize the annual evaluation at its regular meeting on September 16,2003. Any adjustment in salary will be retroactive to July 1,2003. Manager Bird indicated that his slated goals and objectives were set forth in the Capital Improvement Plan that he and the staff had worked upon. He indicated that such process was acceptablclo him. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one-year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 1 . 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit G" and.date-stamped March 28, 2002 and is incorporated herein by this reference. 2 . Prepare a Best Management Plan to address erosion control during site preparation, road construction, and home construction. The erosion control methods proposed shall be methods accepted by professional civil engineering practices. The plan shall make provisions to stabilize all disturbed soil that is subject to erosion, prior to the onset of the rainy season (November 15) and if work is to be done during the winter, to provide for interim measures for periods of rain. The plan shall address stabilization of disturbed soils resulting from the phasing of the project. The plan shall be submitted to, and approved by, the Department of Public Works and the Water Resources Board prior to any clearing or land disturbance. (Mitigation Measure) 3 . The area within the AE Floodway and AE Flood Zone, as shown on the latest adopted version of the Federal Emergency Management Agency's Flood Insurance Rate Map for the project area, shall be designated as a"No Development Zone." With the exception of drainage improvements and/or retention/detention ponds, no structures, dumping, and/or fill material shall be allowed within the"No Development Zone." (Mitigation Measure) 4 . All outdoor lighting shall be fully shielded downward and contained on-site so as to prevent adverse impacts on adjacent properties and aircraft flight activities. (Mitigation Measure) 5 . Follow the recommendations of BCAQMD with regards to fugitive dust emission control. 6 . Meet the requirements of the California Regional Water Quality Control Board including, but not limited to, water quality certification and solid waste disposal plan prior to start of construction. 2 7 . Prior to establishment of use, provide a covered bus stop, in accordance with Butte County Public Works standards, along the 18th Street frontage to be used by the Thermalito School District, Oroville Union School District, and public bus service. The location and type of shelter shall be approved by the Public Works Department. 8 . Prior to establishment of the use, the property owner shall sign an avigation easement granting the right of continued use of the Oroville Municipal Airport in the airspace above the subject parcel and acknowledging any and all existing or potential airport operational impacts. 9 . An advisory notice shall be written into the rental agreement for all future tenants which notifies them of the project's location in proximity to the Oroville Municipal Airport and the potential for noise related impacts associated with flight operations. A signature line shall be provided which indicates the tenant's acknowledgment of the notice and waiver from initiating future litigation against the Oroville Municipal Airport. The advisory notice shall be submitted to and approved by the Planning Division prior to establishment of the use. 10 . All dwelling units shall be designed and constructed to achieve an interior noise level of 45 dB. 11 . Prior to establishment of the use as a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of issuance of the Use Permit. 12 . Prior to establishment of the use, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area(See Chapter 23A of the Butte County Code). 13 . A fence and a 10-foot wide irrigated landscaped area shall be installed along the Feather Avenue frontage of the mobile home park prior to the installation of any mobile home. The fence and landscaping shall be similar to the existing fence and landscaping located on the west side of 18th Street. The fence and landscaping shall be properly maintained. A plan showing the fences and landscaping shall be submitted to and approved by the Planning Division prior to issuance of the improvement plans by the County. 14. Prior to installation of the first mobile home, a six (6) foot tall concrete block wall shall be installed and properly maintained along the south property line and the western boundary back of the mobile home park. Installation of the wall may be in conjunction with the phase development of the site. The type of wall shall be approved by the Planning Division. 3 15. A plan showing the interior open space landscaping shall be submitted to and approved by the Planning Division prior to issuance of the improvement plans by the County. 16. Prior to establishment of the use, remove all junk from the site to the satisfaction of the Directors of Development Services and Environmental Health. 17. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 18. Prior to issuance of the improvement plans by the County an application for either a parcel map, lot line adjustment, and/or parcel merger placing the single family home areas, as shown on the approved site plan, into separate lots shall be submitted and approved. The final exhibit for the lot line adjustment or parcel merger, or an additional map sheet or separate document to be recorded seperately for a parcel map, shall contain a note stating "The lands covered by the parcels created by this (parcel map, lot line adjustment or parcel merger) shall not be subdivided into more than five legal lots and no more than one dwelling unit shall be permitted on any lot. No second dwelling units, Aunt Minnie dwelling units, or other type of second dwelling units provided for under Chapter 24 of the Butte County Code shall be permitted." Public Works Department 19. Construct 18th street frontage to RS-2-A standard with vertical curb, gutter, sidewalk, and necessary road section along property frontage. 20. Construct one-half street section on Feather Avenue to RS-2-A standard with vertical curb, gutter, sidewalk, along property frontage plus 12 foot section on north side of centerline of Feather Avenue with 8" CL I1 aggregate base and 2"Type B AC, %2"max. 21. Prior to start of construction, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be retained/detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be a 10%reduction in the peak flow runoff to said channel or facility. 22. Obtain the necessary easements for any drainage facilities that are on properties other than the mobile home park and provide an entity responsible for the operation and maintenance of the system. 23. Pay Thermalito Storm Drainage fees of$6,030.00 per acre. 24. Provide typical section for interior private roads. 25 . Place a street light at the intersection of site access road and Feather Avenue. 26. Deed to the County of Butte a one-foot no-access road strip along 16th Street or, if 16th Street is to be used, construct to RS-2-A standard. 4 27. Clean Ruddy Creek channel downstream from project, where possible. Cleaning to include removal of trees and brush. Cleaning is subject to obtaining easements and permits from the Department of Fish and Game and associated agencies. The primary goal is to increase the overall efficiency of the drainage system. 28. Prior to the. issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 29. North Oroville/Thermalito traffic impact fees shall be paid prior to establishment of use. Fire Department 30. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the County Fire Warden. 31. A pressurized community water system for fire protection is required. The specific locations and fire flow requirements shall be in accordance with the Fire Department specifications and to the satisfaction of the County Fire Warden. Average required hydrant spacing 500 feet, hydrant size 6.inches, and residual fire flow 1,000 gpm. Submit plans to the Fire Department for review and approval prior to construction of facilities. 32. The emergency access on Feather Avenue shall be approved by the Butte County Fire Department/CDF prior to establishment of the use. 33. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and be posted at the beginning of construction and maintained continuously thereafter. Environmental Health Department 34. Prior to issuance of an approval of any plans by the.Department of Public Works, obtain a will serve letter for sewer and water from the Thermalito Irrigation District. 35. Any existing septic tanks or wells that are to be destroyed must have a permit from the Environmental Health Department. 36. Pool and spa to be operated under permit from the Environmental Health Department. County Counsel 37. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the 5 approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing.
