Attached for your staff's review and further action is a copy of the request and petition for
abandonment of a portion of a Drainage Easement (DE) along with plats delineating the subject
area. Mr. Starr proposes to confine the drainage in an 18" diameter culvert on his property and
work with the adjoining neighbor to fill the existing swale improving the usability of both lots.
Currently there is a 5' wide drainage easement on the adjoining lot, which will remain, the
proposed abandonment would result in a total drainage easement 12 feet in width. The $2,483
abandonment-processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our. department will further
process the abandonment with County counsel and the Board of Supervisors.

approximately 1,550 feet north of royal Oaks Drive,Kelly Ridge, Oroville. (ABAN 05-01)

Mr. Michelena gave a brief summary of the project.
Commissioner Lambert asked if seven feet of easement would remain,but there is five feet on the adjoining
parcel and that will still be there, but it will be.filled in.
Mr.Michelena said that is correct,the applicant will not be able to build structures inside the easement,but
will be able to use it for other purposes.
Chairman Marin asked if the drainage has been taken care of. "
Mr. Edell said his staff reviewed the engineering and the site prior to issuance of the encroachment permit.
The hearing was opened to the public.
Mr. Starr said the drainage will be attached to the existing culvert.
The hearing was closed to the public and comments confined to the Commission and staff.
Mr. Wannenmacher pointed out that this was a recommendation to the Board and that the Board would make
the determination that this item was categorically exempt from environmental review.
It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and unanimously carried to
find this abandonment consistent with the General Plan.

EXECUTIVE SUMMARY:
The'project would allow the abandonment of a portion of a Drainage Easement. State law requires that
the Planning Commission find that an abandonment such as that proposed will not be in conflict with a
General Plan. Staff has analyzed this abandonment request and recommends that the Planning
Commission recommend approval to the Board of Supervisors.
PROJECT DESCRIPTION:
• This easement was created in 1978 as part of the Kelly Ridge Estates Unit 4C Subdivision (Book 66
of Maps,Pages 9-13) for drainage purposes.
The drainage easement is 20 feet wide and approximately 100 feet long and follows the project
site's southern property line. The applicant is requesting to abandon 13 feet, along the northerly
portion of the easement, for the entire length of the easement(approximately 100 feet).
.•' The remaining easement on APN 069-280-053 will be 7 feet by approximately 100 feet.
i A letter was received from the Kelly Ridge Estates Owner's Association stating that they have no
objection to the abandonment of thirteen feet of the drainage easement.
�t• Currently there is a 5-foot wide drainage easement on the adjoining lot, which will remain; the
proposed abandonment would result in a total drainage easement 12 feet in width.

ANALYSIS:
According to California Government Code Section 65402, the abandonment of property must be in
conformance with the General Plan.
The request is consistent with the Butte County General Plan because it does not conflict with any
adopted or proposed element of the General Plan. The Land Use Element Policy 5.3(b) on page
LUE-38 requires adequate drainage improvements for new development.
• The existing natural drainage will be converted to an 18 inch diameter culvert and energy dissipater
to maintain proper drainage for the area.
•'" The existing drainage swale improvements will include filling the swale and improving the
usability of both lots.
• Butte County Public Works Department reviewed the proposed changes and determined the
proposed improvements will be more than adequate to handle the drainage.
The old drainage channel, including the 5-foot portion on the parcel to the south, will be filled and
graded.
• Construction of these facilities will require issuance of an Encroachment Permit based upon Public
Works approved plans
ENVIRONMENTAL REVIEW:
This project has been determined to be categorically exempt from the requirements of the California
Environmental Quality Act under Section 15305 (Minor Alterations in Land Use Limitations). This
exemption consists of minor alterations in land use limitations in areas with an average slope of less than
20%, which do not result in any changes in land use or density.
ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Find that this project is exempt from the provisions of the California Environmental Quality Act
under Section 15305. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14
CCR 753.5 is not required.
H. Report to the Board of Supervisors on the General Plan consistency of the request by John Starr to
abandon 13 feet by approximately 100-foot long of a 20-foot by approximately 100 foot drainage
easement on the southern portion of APN 069-280-053 as shown on Attachment C, subject to the
condition found in Exhibit A and the following findings:
A. The proposed abandonment does not conflict with any goal or policy of the Butte County
General Plan.
B. The abandonment of a portion of the drainage easement will not have an impact because the
improvements, changing the drainage way from a meandering ditch to a culvert, will
sufficiently handle the drainage flow.

Stuart,
At the last IDR meeting 2/2/05, 1 was to request additional information from you regarding the drainage culvert. I
know you gave me this information before, but I can not seem to locate it. Is there any chance you still have a
copy? If not,what I'm looking for is information that state the new drainage system will meet standards and is
handled by a culvert.
Also, how does it effect adjacent parcels? No change What is happening with the 5-foot easement on the
adjacent parcel? Nothing
One concern of County Counsel is how we know the drainage culvert is adequate. The Department of Public
Works Civil Engineers are satisfied that the proposed culvert is adequate.
I understand that they already obtained the encroachment permit.. Do we want to remove that portion of the
Condition? Not until after construction has been completed to the satisfaction of the Department of Public Works.

I have reviewed the agenda report and have the following comments.
I remember discussing this matter at IDR.
We called Stuart over to address the issues.
I asked that he prepare an explanation of what was involved and what impact it would have.
You do not really describe it in your report, and there is no indication that you were given anything by Pub Work. You need
this information.
For Attachments, I believe you should include an explanation from Pub Work.
In Proj Desc,:first bullet, delete the first comma and which, as well as the comma after the parenthesis.
(Fifth bullet, if you put a culvert on the 7 ft part, what will be done on the adjoining 5 ft part and how will it be impacted?
In Anal, second bullet, indicate that the land use policy is on page LUE-38. What about the conservation element and
pages CON-2 and CON-3?
Third bullet, how do we know? Explain why it is adequate.
In Cond 1, after"effective" add "and any work being done in the drainage easement area".

John Starr has requested abandonment of a portion of a 20 wide drainage easement in order to
construct a residential structure. Currently this easement is occupied by a meandering natural
drainage channel. In order to provide for adequate storm drainage, he will need to replace this
natural drainage channel with an adequately sized storm drainage culvert and energy dissipater.
Construction of these facilities 4ill require issuance of an Encroachment Permit based upon
Public Works approved plans. Due to the expense involved he would prefer to know that
approval is recommended prior to construction.
The Department of Public Works recommends approval of this abandonment subject to the
following condition.
1. Prior to this abandonment becoming effective, obtain an encroachment permit from
the Department of Public Works and install an adequately sized storm drainage
culvert and energy dissipater in conformance with County approved plans and the
terms of said encroachment permit.

EXECUTIVE SUMMARY: -
The project would allow the abandonment of a portion of a Drainage Easement. State law
requires that the Planning Commission fmd that an abandonment such as that proposed will not
be in conflict with a General Plan. Staff has analyzed this abandonment request and
recommends that the Planning Commission recommend approval to the Board of Supervisors.
PROJECT DESCRIPTION:
• This easement, which was created in 1978 as part of the Kelly Ridge Estates Unit 4C
Subdivision(Book 66 of Maps,Pages 9-13), for drainage purposes.
• The drainage easement is 20 feet wide and approximately 100 feet long and follows the
project site's southern property line. The applicant is requesting to abandon 13 feet, along
the northerly portion of the easement, for the entire length of the easement (approximately
100 feet).
• The remaining easement on APN 069-280-053 will be 7 feet by approximately 100 feet.
• A letter was received from the Kelly Ridge Estates O ery ssociation stating that they
have no objection to the abandonment of thirteen feet of the drainage easement.

• The parcel to the south, APN 069-280-052 has a 5-foot drainage easement that is adjacent
to the 20-foot easement that will not change.
ANALYSIS:
• According to California Government Code Section 65402, the abandonment of property
must be in conformance with the General Plan.
• The request is consistent with the Butte County General Plan because it does not conflict
with any adopted or proposed element of the General Plan. The Land Use Element Policy
5.3(b)requires adequate drainage improvements for new development.
• The existing natural drainage ch el will be replaced by an adequately sized storm
drainage culvert and energy dissipate .
• Construction of these facilities will require issuance of an Encroachment Permit based
upon Public Works approved plans
ENVIRONMENTAL REVIEW: — -
This project has been determined to be categorically~exempt;from the requirements of the
California Environmental Quality Act under Section L5.305 (Minor Alterations in Land Use
Limitations). This exemption consists of minor.-alterationz-in land use limitations in areas with
an average slope of less than 20%,which do npt4:es_ur#--y changes in land use or density.
ACTIONS FOR CONSIDERATION.=:
Staff recommends that the Planning Commission take the following actions:
I. Find that this project is exempt=from the provisions of the California Environmental
Quality Act under Section 15305' The payment of fees pursuant to Fish and Game Code
Section 711.4 and 14 CCR 753.5 is not required.
II. Report to the Board of Supervisors on the General Plan consistency of the request by John
Starr to abandon 13 feet by approximately 100-foot long of a 20-foot by approximately 100
foot drainage easement on the southern portion of APN 069-280-053 as shown on
Attachment C, subject to the condition found in Exhibit A and the following findings:
A. The proposed abandonment does not conflict with any goal or policy of the'Butte
County General Plan.
B. The abandonment of a portion of the drainage easement will not have an impact
because the improvements, changing the drainage way from a meandering ditch to a
culvert, will sufficiently handle the drainage flow.

It seems like some comments from Pub Work would be required before this matter should be given to the Plan Comm.
How does the easement relate to easements on adjoining parcels, not just the one next to it lengthwise, but at the two
ends.
Also for the entire area.
What might reasonably be required in terms of drainage in the area?
Stuart asks you to have the Plan Comm do CEQA, but it is only making a GP consistency finding.
The most it could do is recommend appropriate CEQA action to the Board.
What does the GP say about drainage?
Identify the area of the GP that discusses it so the Plan Comm can look at it to prepare for the hearing.
Does the GP indicate when or why a drainage easement should be abandoned?
Give any information that would help the Plan Comm.

Attached for your staff's review and further action is a copy of the request and petition for
abandonment of a portion of a Drainage Easement (DE) along with plats delineating the subject
area. Mr. Starr proposes to confine the drainage in an 18" diameter culvert on his property and
work with the adjoining neighbor to fill the existing swale improving the usability of both lots.
Currently there is a 5' wide drainage easement on the adjoining lot, which will remain, the
proposed abandonment would result in a total drainage easement 12 feet in width. The $2,483
abandonment-processing fee has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity, to be considered in regard to the findings that the project is categorically exempt
from environmental review and the proposed abandonment is in conformance with the Butte
County General Plan. Following Planning Commission action our department will further
process the abandonment with County counsel and the Board.of.Supervisors.
Please advise us of the schedule of processing by your department and provide us a copy of the
Planning Commission minutes documenting the Commission's action.
