Dear Mr. Stout:
At the regular meeting of the Butte County Board of Supervisors held May 11, 1993,
Resolution No. 93-66 was adopted which abandons a public utility overhang easement,
Lot 76 of Paradise Pines Unit No. 5, identified as AP 064-400-041, Paradise Pines.
Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January
1, 1991) requires that the.Department of Fish and Game impose and collect filing fees
as specified to defray the cost of managing and protecting fish and wildlife trust
resources. These filing fees are collected during the environmental review process and
are to be paid at the time the County files a "Notice of Exemption" with the County
Clerk of the County in which the project is located. This procedure is required pursuant
to Section 21152 of the Public Resources Code.
To increase administrative efficiency, the statute delegated the collection of filing fees
to the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee for the filing of a Notice of Exemption is the $25.00 documentary
handling fee. A check made payable to the County in the amount of'$25.00 should be
submitted to the County by May 17, 1993.
Project applicants should be aware Section 21089(b) of the Public Resources Code,
provides that any project approved under the CEQA is not operative, vested, or final
until the filing fees required under Section 711.4 of the Fish and Game Code are paid.

REQUEST/RECOMMENDATION
Wayne Stout % Eden Roc Realty. Inc. - (Item determined to be categorically exempt
from environmental review) Abandonment of a Public Utility Overhang Easement on a
portion of Lot 76 of Paradise Pines Unit 5, identified as AP 064-400-041, Paradise Pines.
Staff recommends the Board concur with the Planning Commission and subject to the
findings listed in this report, approve the request.
ANALYSIS:
This is a request for the abandonment of a public utility overhang easement to the rear
of the above referenced parcel.
The proposed public utility overhang abandonment will not conflict with the General Plan
or any element of the General Plan. This portion of the easement is not needed for any
County Public Works projects or any public utilities facilities.
PLANNING COMMISSION ACTION:
The Planning Commission heard testimony regarding this project. The Commission took
an action recommending that the Board approve the abandonment. The Planning
Commission minutes are attached.

A. Find that this project is categorically exempt from environmental review; and
B. Find the abandonment in conformance with the Butte County General Plan; and

Being that certain Public Utility Overhang Easement lying within a portion of
Section 23, T23N, R3E, M.D.M. as shown on the on the map of Paradise Pines Unit No.5
recorded in Book 35 Maps of Record at Pages 88 to 91, County of Butte, State of
California, more particularly -described as follows:
Beginning at the Northeasterly lot corner of Lot 76 of said subdivision; thence
N 63° 37' 33" W, 24 feet more or less to a point, said point being the point of
intersection of the easterly lot line of Lot 69 with the northerly lot line of
said Lot 76; thence from said point of intersection in a southeasterly direction
63 feet more or less to the southeasterly lot line of said Lot 76; thence N 24°
47'59" E, 55 feet more or less to the point of beginning.
Said map showing the overhang easement to be abandoned is on file in the Office of
Butte County Department of Public Works, 7 County Center Drive, Oroville, CA.
