(CBS) Staff recommended the Commission find this abandonment in conformity with the General Plan. Commissioner Ferguson said the memo mentions reserving a 20 ft. wide public utility easement and also an easement for pedestrian, bicycle, and vehicle access to the pistol range, and he wanted to know what the relationship was between the two easements? Staff said this is a request to abandon the public interest in the right-of-way. Staff said the PUE and the pedestrian, bike, and vehicle paths are the same. Staff said this easement was part of the PUD rezone. It was moved by Commissioner Lambert, seconded by Commissioner Sessions, and unanimously carried to recommend approval as follows: 1. Find the abandonment in conformity with the General Plan and Zoning; 2. Recommend approval of this request of the Board of Supervisors (Jeff Farrar) subject to the following conditions: 1. Reserve a 20 ft. wide public utility easement, 10 ft. on either side of the existing utility pole line. 2. Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January 1, 1991) requires that the Department of Fish and Game impose and collect filing fees as specified to defray the cost of managing and protecting fish and wildlife trust resources. These filing fees are collected during the environmental review process and are to be paid at the time the County files a "Notice of Exemption" with the County Clerk of the County in which the project is located. This procedure is required pursuant to Section 21152 of the Public Resources Code. To increase administrative efficiency, the statute delegated the collection of filing fees to the County Clerk and provided the County authority to collect a $25.00 documentary handling fee. The fee for the filing of a Notice of Exemption is the $25.00 documentary handling fee. A check made payable to the-County in the amount of $25.00 should be submitted to the County by May 17, 1993. Project applicants should be aware Section 21089(b) of the Public Resources Code, provides that any project approved under the CEQA is not operative, vested, or final until the filing fees required under Section 711.4 of the Fish and Game Code are paid. Staff recommended to find this proposal in conformance with the General Plan. ANALYSIS: This is a request to abandon a portion of Chico Canyon Road from Centennial Avenue, easterly to AP 011-030-050. This road was originally intended to be used as a route up Chico Canyon to Forest Ranch. The right-of-way abuts Bidwell Park to the north and dead ends into AP 011-030-059. This portion of the Right-of-way is unimproved, but is used as access to Bidwell park for bicyclists and pedestrians and also provides access to the City of Chico police shooting range. The right-of-way is not needed for road purposes. The City of Chico does not intend to provide road access to the park at this location and has no objection to the proposed abandonment provided an easement is retained for bicycle and pedestrian access and vehicle access to the pistol range. PG&E and Pacific Bell also request that a public utility easement be retained for their existing facilities. No other utilities had requests for easements. Public Works had no comments on the project. PLANNING COMMISSION ACTION: The Planning Commission heard testimony regarding this project. The Commission took an action recommending that the Board approve the abandonment. The Planning Commission minutes are attached. RECOMMENDED MOTION: A. Find that this project is categorically exempt from environmental review; and B. Find the abandonment in conformance with the Butte County General Plan; and C. The easement was originally intended for the extension of Chico Canyon Road in 1936 under a WPA project and was abandoned shortly thereafter. At this point , the easement lies between two of my parcels . The narrow easement has since become an attractive nuisance because of its remote location. It is constantly used for dumping, sexual activities, transient use and late night parties , which have made the area unsafe for my wife and two children. Currently, the city uses the subject easement for access to the pistol range as well as access for mountain bikes to the park. I have scheduled a meeting with the city to discuss their easement needs and will work with the City of Chico in establishing an appropriate easement for their needs , which would include vehicular control .
