IV. ABANDONMENT - John A. Babcock - Abandonment of a portion of Chico
Canyon Road right-of-way from Centennial Avenue westerly,identified as AP 011-
020-048, Chico.
Staff said the right-of-way is 70 feet wide. Staff said the portion proposed to be
abandoned is not' needed for road purposes, but a 20 ft. easement needs to be
maintained for public utilities.
The hearing was opened to the public.
John Babcock asked if this abandonment is granted will he be allowed to move his
fence out by 10 feet?
Staff said yes.
Commissioner Ferguson asked where the 10 ft. strip was in relation to the 20 ft. strip
that is proposed to be kept for public utility easement purposes?
Staff said the 10 ft. strip can not become a building area whereas the 20 ft. PUE strip,
can allow structures such as a fence, but is also an easement for public utilities. If they
have to repair any utility equipment the utility company may enter on this piece of
property.
The hearing was closed.
It was moved by Commissioner Sessions, seconded by Commissioner Ferguson, and
unanimously carried for approval as follows:
A. The Planning Commission finds the abandonment in conformity with the General
Plan and zoning and recommends approval of this request to the Board of
Supervisors subject to the following condition:
1. Reserve a 20 foot wide public utility easement, 10 ft. on either side of the
existing utility pole line.

REQUEST/RECOMMENDATION
John A. Babcock - Abandonment of a portion of Chico Canyon Road right-of-way from
Centennial Avenue westerly, identified as AP 011-020-048, Chico.
Staff recommends the Board concur with the Planning Commission and subject to the
findings listed in this report, approve the request.
ANALYSIS:
This is a request to abandon a 10 foot strip of the Chico Canyon Road right-of-way
along AP 011-020-048 in the Chico area. The existing right-of-way is 70 ft. wide. On
May 11, 1993, the Board of Supervisors approved the abandonment of Chico Canyon
Road, east of Centennial Avenue. The right-of-way is not needed for road purposes.
PG&E requests that a public utility easement be retained for their existing facilities. No
other utilities had requests for easements. Public Works had no comments on the
project. The City of Chico requests this abandonment be denied because this stretch of
road will ultimately become a part of the City and will be needed in order to
accommodate full urban improvements in the future.
PLANNING COMMISSION ACTION:
The Planning Commission heard testimony regarding this project. The Commission took
an action recommending that the Board approve the abandonment. The Planning
Commission minutes are attached.
RECOMMENDED MOTION:
I
A. Find that this project is categorically exempt from environmental review; and
B. Find the abandonment in conformance with the Butte County General Plan; and
C. Adopt a Resolution approving the abandonment of a right-of-way on Chico Canyon
Road from Centennial Avenue westerly identified as AP 011-020-048 (John A.
Babcock), subject to the following condition:
1. Reserve a 20 foot wide public utility easement, 10 feet on either side of the
existing utility pole line.

SUBJECT: Abandonments by County
Tom Lando, City Manager of the City of Chico, has sent me the
enclosed letter expressing concern that the city is not receiving
notice of proposed abandonments of rights of way within the Chico
Urban Area. The city has made prior requests for notice which
apparently have not been successful.
I would appreciate it if the two of you would coordinate the
necessary steps to assure that the City of Chico will receive
timely advance notice of proposed abandonments as they request. I
appreciate your cooperation.

RE: Abandonments within the Chico Urban Area
Dear John:
When reviewing the agenda for the July 27, 1993, Board of
Supervisors meeting I noticed item 3.02, a proposed abandon-
ment of right of way on Chico Canyon Road.
On several occasions in the past, the City of Chico has
requested to be notified in advance regarding proposed
abandonments within the Chico Urban Area so that the City has
an opportunity to review the potential impact of such abandon-
ment on the future plans of the City. I am enclosing copies
of a letter dated January 13, 1984, from Fred Davis to the
Board of Supervisors; a letter dated July 5, 1991, from me to
-Will Randolph; and a memorandum from Will Randolph to the
County Directors of Planning and Public Works requesting
compliance with the City's request.
The City was not notified by County staff of the abandonment
currently under consideration. Therefore, the City is again
requesting to receive advance notice of any proposed abandon-
ment within the Chico Urban Area.

At its December 20, 1983 meeting, the Council asked that it be
informed by the County whenever the County intended to abandon
public streets/highways or public easements that are located in
the Chico urban area.
In accordance with Streets and Highways Code Section 8346 (Request
for notice of vacation. oroceedi^.=s ) . this letter ,:ill serve as the
Citv of Chico ' s recuest that t-_ County provide it with notice of
proceedings to vacate public streets /hi2hways or au--lac easements
in_ the Chico urban area.. Such notices should be addressed to the

J1.1though the above Code section and subsequent sections require
notice after the adoption of the Notice of Intention, it would be
of assistance to the City if the County would provide this office
with a copy of the Notice of Intention when it is to appear on the
Board' s agenda and at the same time that the County forwards its
copies of the Board ' s agenda to the City.
The Council was particularly interested in the recent abandonment
of a portion of Lindo Avenue, behind S & S Produce and adjacent
to Lindo Channel. Rather than having the property revert to
adjacent property owners, the Council felt that it might be in
the public interest to have it reserved for public use such as a
park, greenbelt area or bicycle facility.
In addition, such streets/highways or public easements proposed
for abandonment in the Chico urban area may be necessary for .
future sanitary sewers or storm drainage facilities that may be
desired when property is annexed to the City or provided with
sanitary sewer and/or storm drainage service.
As you know, the County Tax Collector currently notifies the City
whenever the County proposes to sell tai;-deeded properties located
within the City of Chico. The City has taken advantage of this
procedure by acquiring some properties along Little Chico. Creek
in order to enhance creekside greenbelts. The City Council

appreciates the assistance it has received in connection with
these `acquisitions, and believes that notification concerning public
streets`/highways or public easements abandonments will also be of ,
substantial public benefit to the 'Chico urban area.

`G Officer Martin Nichols with a request that he acknowledge the
City' s request as set forth in the second and third paragraphs
above.

I am writing to follow up on the recent action by the County's Board of
Supervisors to abandon the unimproved alley located on the north bank
of Big Chico Creek between State Highway Route 32 and the Southern
Pacific Railroad tracks.
The City of Chico is interested in reviewing County abandonments to
ensure coordination of City and County long-range plans and actions.
The City has previously corresponded with the Board of Supervisors by
letter dated June 13, 1984 (attached as Exhibit "A"). For whatever
reason, notice was not received by the City Manager as set forth in
that letter.
I would like to reemphasize the previous letter and request that notice
be sent directly to the City Manager's office.

Dear Mr. Babcock:
Pursuant to your letter of February 9, 1993, concerning the above-noted abandonment,
please complete the following on.the attached petition for abandonment:
1. Obtain signatures and addresses of adjoining property owners who
may have an interest in said public easement, plus other property
owners in the area,. totaling ten or more.
2. Date petition.
We need letters from all utility companies stating they no longer need said easement..
Submit a check in this office in the sum of One Hundred and Sixty Dollars ($160.00)`
made out to the Butte County- Treasurer.
This proposed abandonment lies within the sphere- of influence of the City of"Chico
and therefore will require their confirmation. By. copy of .this letter.we are
requesting the City to review and comment on the proposed abandonment within 30
days. Should the City not respond within the 30 days, it will be assumed that
they have no objection to the abandonment.

Adjacent to APN 11-020-048
Dear Bill:
The City of Chico has reviewed the subject proposed abandonment.
There presently exists 40 feet of right of way on the north half of
Chico Canyon Road along this portion of street. Current full urban
improvements would require a minimum of 32 feet. However, a
substantial embankment, (up to 6 feet high) , also exists here. As
a result, right of way is needed to make room for a slope from the
road to the adjacent property. The existing 40 feet is barely
enough to accommodate the full urban improvements and an
embankment. While this stretch of road is presently located within
County jurisdiction, it will undoubtedly ultimately become part of
the City.
Therefore, the City requests that this abandonment be denied
because all of the existing right of way will be needed to
accommodate the ultimate road improvements anticipated in the
future. If you wish to discuss this matter further, please call me
at 895 - 4893 .

Dear Mr. Farrar:
We have reviewed your request regarding the abandonment of a portion of the above
referenced public right of way. As with the abandonment request we processed for Jeff Farrah,
Pacific Bell has an existing service facility crossing within that portion of the roadway you have
requested the City of Chico abandon.
We have no objections to the abandonment provided, however, that a public utility easement
be reserved in the final Resolution of Abandonment in accordance with California Streets and
Highways Code, §8340.
We therefore request that the following language be incorporated in the final Resolution of
Abandonment:
"Reserving, however, to Pacific Bell the right from time to time to install,
maintain, repair, operate, replace, remove and renew lines of pipes, wires, poles
and other structures, equipment, equipment, fixtures and appurtenances, for the
operation of said facilities within a strip of land of the uniform width of 20 feet
lying 10 feet on each side of the existing pole line facilities, including rights for
anchors and guy wires extending outside of said strip"

The undersigned, being ten or more freeholders, at least two of whom are residents
of the Road District in which some part of the highway affected .is situated; and who are
taxable therein for highway purposes, do hereby petition your Honorable Board of Supervisors

Commencing at the most northerly corner of Lot 21 as shown on that certain map entitled
"Twenty First Subdivision of the Bidwell Rancho" recorded in the Office of the County
Recorder of the County of Butte, State of California, in Book 7 Maps of Record at Page
49, said corner lies on the southerly right of way line of Centennial Avenue.
Thence leaving said lot corner S 55° 44' 33" E along the easterly lot line of said Lot 21,
a distance of 187.24 feet more or less to a point on the northerly right of way line of
Chico Canyon Road, said point being the True Point of Beginning;
"Thence leaving said easterly lot line and along said right of way line and along a curve to
the right having a radius of 2540.00 feet through a central angle of 06° 30'46", .an arc
length of ?88.72 feet;
Thence leaving said right of way line S 36° 29' 54" E 10 feet to a point ; thence south-
westerly along a curve to the left having a radius 2530 feet through a central angle of

REQUEST/RECOMMENDATION
John A. Babcock - Abandonment of a portion of Chico Canyon Road right-of-way from
Centennial Avenue westerly, identified as AP 011-020-048, Chico.
Staff recommends the Board concur with the Planning Commission and subject to the
findings listed in this report, approve the request.
ANALYSIS:
This is a request to abandon a 10 foot strip of the Chico Canyon Road right-of-way
along AP 011-020-048 in the Chico area. The existing right-of-way is 70 ft. wide. On
May 11, 1993, the Board of Supervisors approved the abandonment of Chico Canyon
Road, east of Centennial Avenue. The right-of-way is not needed for road purposes.
PG&E requests that a public utility easement be retained for their existing facilities. No
other utilities had requests for easements. Public Works had no comments on the
project. The City of Chico requests this abandonment be denied because this stretch of
road will ultimately become a part of the City and will be needed in order to
accommodate full urban improvements in the future.
PLANNING COMMISSION ACTION:
The Planning Commission heard testimony regarding this project. The Commission took
an action recommending that the Board approve the abandonment. The Planning
Commission minutes are attached.
RECOMMENDED MOTION:
A. Find that this project is categorically exempt from environmental review; and
B. Find the abandonment in conformance with the Butte County General Plan; and
C. Adopt a Resolution approving the abandonment of a right-of-way on Chico Canyon -
Road from Centennial Avenue- westerly identified as AP 011-020-048 (John A.
Babcock), subject to the following condition:
1. Reserve a 20 foot wide public utility easement, 10 feet on either side of the
existing utility pole line.
