2. Cary Schwartz - Abandonment of a portion of Kelly Ridge Road, formerly
named Hillcrest Avenue, approximately 600 feet north of its intersection with
Heritage Drive, adjacent to AP 069-320-012, Oroville. (LPW) (94-03)
Staff said this abandonment will not change the road.
The hearing was opened to the, public.
There was no one present to speak on this matter.
The hearing was closed.
It was moved by Commissioner Ferguson, seconded by Commissioner Lambert, and
unanimously approved as follows:
A. Find that the project is Categorically Exempt from Environmental Review; and
B. Find that the project is in conformance with the Butte County.General Plan; and
�i C. Recommend that the Board of Supervisors approve the abandonment of a
portion of Kelly Ridge Road, adjacent to AP 069-320-012 (Cary Schwartz), subject
to the following condition:
1. The applicant shall reserve the abandoned roadway area as a Public Utility

Dear Mr. Schwartz:
At the regular meeting of the Butte County Board of Supervisors held January 11, 1994,
Resolution No. 94-06 was adopted which abandons a portion of Kelly Ridge Road,
formerly named Hillcrest Avenue, approximately 600 feet north of its intersection with
Heritage Drive, adjacent to AP 069-320-012, Oroville.
To increase administrative efficiency, the statute delegated the collection of filing fees
to the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee for the filing of a Notice of Exemption is the $25.00 documentary
handling fee. A check made payable to the County in the amount of $25.00 should be
submitted to the County by January 18, 1994.

DATE: November 4, 1993
This is a request for an abandonment of a portion of Kelly Ridge Road, formerly named
Hillcrest Avenue, located approximately 600 feet north of its intersection with Heritage
Drive, adjacent to AP# 069-320-012.
The proposed abandonment will not conflict with any adopted or proposed element of
the General Plan. This portion of the roadway is no longer necessary, to the County but
should be maintained as a Public Utility Easement for the continued use of facilities
located within the roadway.
RECOMMENDATION:
A. Find that the project is Categorically Exempt from Environmental Review; and
B. Find that the project is in conformance with the Butte County General plan; and
C. Recommend that the Board of Supervisors approve the abandonment of a
portion of Kelly Ridge Road, adjacent to AP# 069-320-012 (Schwartz), subject
to the following condition:
1. The Applicant shall reserve the abandoned roadway area as a Public Utility
Easement.

named Hillcrest Avenue, located approximately 600 feet north of its intersection with
Heritage Drive, adjacent to AP No. 069-320-012, was recommended for approval.
To increase administrative efficiency, the statuted delegated the collection of filing

This is a request for an abandonment of a portion of.Kelly Ridge Road, formerly named
Hillcrest Avenue, located approximately 600 feet north of its intersection with Heritage
Drive, adjacent to AP# 069-320-012.
The proposed abandonment will not conflict with any adopted or proposed element of
the General Plan. This portion of the roadway is no longer necessary to the County but
should be maintained as a Public Utility Easement for the continued use of facilities
located within the roadway.
RECOMMENDATION:
A. Find that the project is Categorically Exempt from Environmental Review; and
B. Find that the project is in conformance with the Butte County General plan; and
C. Recommend that the Board of Supervisors approve the abandonment of a
portion of Kelly Ridge Road, adjacent to AP# 069-320-012 (Schwartz), subject
to the following condition:

The Department of Water Resources has no objection to Butte
County selling the abandoned portion of Kelly Ridge Road to the
adjoining owner of Assessors Parcel 'No. 69-32-12 . I understand
that this portion of the abandoned road will be merged with the
larger parcel . I also understand that any easements or
encumbrances which may be appurtenant to the parcel would be
retained by the holder of those rights.

Dear Mr. Schwartz:
We have reviewed your proposal for the abandonment of a portion of Kelly Ridge
Road and find that PG&E has existing company facilities within this area. We have
no objection to the abandonment of this area provided that it is retained as a public
utility easement pursuant to Chapter 5, Section 8340 C of the California Street and
Highway Code. We request that the following language be used in the County
resolution:
"Reserving, however, to Pacific Gas and Electric Company the right from time
to time to install, maintain, repair, operate, replace, remove and renew lines of
pipes, wires, poles and other structures, equipment and fixtures, both above
ground and underground, for the operation of said facilities in said Kelly Ridge
Road.
You may use this letter in your further negotiations with the County of Butte. If you
