BUTTE COUNTY BOARD OF SUPERVISORS MINUTES - JUNE 14, 1994 Butte County Sheriff's Department-Abandonment of a portion of Openshaw Road, on property zoned "U" located at the easterly end of Openshaw Road, northwest of the Highway 149, Highway 70 intersection, identified as AP 041-200-019, 038; 041-160-050, Central Butte County. (File 94-54) (LPW) The Commission waived the reading of the Staff Report. Mr. Hogan said they were recommending approval of this project. Commissioner Ferguson asked what will become of the existing pavement once the road is abandoned? Mr. Hogan said he did not know. Commissioner Ferguson said he was concerned about closure of the road. He wanted to make sure there would be signs telling the public the road was closed. The hearing was opened to the public. John Christofferson, GDA, said there are 5 property owners with public rights to use this portion of the road and they are asking for approval of the abandonment. He said there will be barricades and signs on the road to show the public the road is closed., He asked that Conditions 2 and 3 be,revisedto read as follows: 2. Prior to approval of the abandonment by the Board of Supervisors, the applicant shall provide deeds for the creation of a common easement for road and public utility purposes (delete "exchange") between the five property owners (Butte County Sheriff's Posse, A. Rocha, G&M Ranches, Butte County, and F. Brown) to provide access to the remaining County right-of-way. 3. (Delete "Prior to approval of the abandonment by") The Board of Supervisors shall reserve for (delete "the applicant" and "in deeds of") public utility purposes an easement over that portion of the roadway to be abandoned. Mr. Hogan said the changes were acceptable. Commissioner Bergman asked that the changes be reviewed by County Counsel. He said any time deeds are being changed, County Counsel should go through the document. j Mr. Hogan felt the wording was clear and he did not want to hold up the process. Mr. Christofferson said the legals in the deeds have to be validated through Public Works before they are signed. Commissioner Nelson said he has no problem with the way.the conditions are worded. He said the Sheriff's Posse is not going to want people using the road and he was sure they would take the necessary steps to prevent it. The hearing was closed. It was moved by Commissioner Bergman, seconded by Commissioner Nelson, and unanimously carried for approval of the application for abandonment of the easterly portion of Openshaw Road, subject to the following findings and conditions, and subject to approval by County Counsel: Environmental Findings. A. This project is Categorically Exempt from environmental review;_and General Plan Findings. A. The proposed abandonment is in conformance with the Butte County General Plan; and Action. A. Staff recommends approval of this request. PROJECT CHARACTERISTICS: In 1976 the State of California relinquished to Butte County the right-of-way known as Openshaw Road, formerly State Route 149. This portion of Openshaw Road is the most easterly end, including the'cul-de-sac. ANALYSIS: According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict with any adopted or proposed element of the General Plan. This portion of the easement is not needed for any County Public Works projects. Property owners along this portion of Openshaw Road will continue to have access through the recordation of private easements concurrently with the recordation of the abandonment. Prior to Grey's letter, John D. Christofferson of GDA Engineering and Surveying began the process of obtaining the necessary information required for the abandonment, which was submitted to our department. Enclosed is the following: 1. The February 28, 1994 letter from Mick Grey requesting the abandonment. 2 . The Petition for abandonment, with the required signatures of the petitioners, along with one print of the accompanying exhibit map. Exhibit "A" attached to the petition is the correct and complete description that should be shown on the final resolution for abandonment. 3 . Two letters from utility companies acknowledging the abandon- ment and ::stating their need to reserve rights and uses. These needs are incorporated into the petition. Several deeds must also be furnished, to be recorded at the same time the abandonment is recorded, as follows: 1. A deed to the County for a right of way for a new cul-de-sac. ►vc - lew 2 . Deeds for exchange between the t-h-re� property owners to provide access to the remaining County right of way. The Sheriff's surveyor John Christofferson has requested the abandonment process proceed. He anticipates the deeds will be provided prior to the Board of Supervisors' meeting.
