located 335 feet north of Thorntree Drive, between Vispera Drive and
Whitchurch Lane, identified as AP 040-010-038, 054, 057, and 060, Chico.
-Mr. Hogan said this request is before the Commission to determine if the abandonment
is in conformity with the General Plan. Staff recommends the Commission find the
abandonment in conformity.
The hearing was opened•to the public.
No one, including the applicant, was present to speak on this matter.
The hearing was closed.
It was moved by Commissioner Lynch, seconded by Chairman Lambert, and carried for
approval as follows:
Environmental Findings.
A. The project is categorically exempt from environmental review; and
General Plan findings.
A. The proposed abandonment is in conformance with the Butte County General
Plan; and
Action.

At the regular meeting of the Butte County Board of Supervisors held August 23, 1994, Resolution
No. 94-92 was adopted which abandons Oro Fino Drive right-of-way on property zoned M-1
located 335 feet north of Thorntree Drive, identified as AP 048-010-038, 054, 057, and 060, Chico..
For purposes of the California Environmental Quality Act, a Notice of Exemption must be filed.
The fee for the filing of a Notice of Exemption is the $25.00 documentary handling fee. A check
made payable to the Butte County Treasurer in the amount of$25.00 should be submitted to the
Planning Division by August 30, 1994.

DATE: July 12, 1994
Please prepare the necessary resolutions for the subject abandonment. ' The Board will
be setting a public hearing date on July 26, 1994 for August 23, 1994. The notice must
be to Public Works by August 8, 1994 to be posted.
The legal description is attached.

All that certain real property situate in the County of Butte, State of California, described
as follows;
Being a portion of Parcels 1, 2, 3 and 4 as shown on that certain map filed for record in
Book 81 of Parcel Maps, at Page .54, more particularly described as follows;
A 60 foot wide non-exclusive easement known as Oro Fino Drive for ingress, egress and public
utilities, lying 30 feet on each side of the following described centerline;
Commencing at the Southwest corner of said Parcel 1;
Thence leaving said commencement point along the West line of said Parcel 1 North 000 52' 05"
West, 335.00 feet to the TRUE POINT OF BEGINNING for the following described centerline;
Thence leaving said Point of Beginning and said West line of Parcel 1 North 890 02' 02" East,
1328.48 feet to the East line of said Parcel 4 and the terminus of said centerline.
EXCEPTING THEREFROM that portion of Whitchurch Lane that crosses said Oro Fino Drive as shown
in Book 111 of Parcel Maps, at Page 52 and Book 111 of Parcel Maps, at Page 55.
The following Reservation may be included in the Final Resolution:
EXCEPTING AND RESERVING any existing easements and/or right at any time, or from time to
time, to maintain, operate, replace, remove, renew and enlarge the existing public utility
facilities and facilities incidental thereto, including access to protect the property from
all hazards in, upon, and over the highway herewith to be abandoned.
Said map showing the non-exclusive easement for ingress, egress and public utilities, to be
abandoned is on file in the office of Butte County Department of Public Works, 7 County

REQUEST: Abandonment of Oro Fino Drive-for Thomas Reed: Located between Vispera
Drive and Whitchurch Lane on the north side of Thorntree Drive, approximately 1300 feet east
of Cohasset Road, in the north Chico area. '

FOR: Board of Supervisors Meeting August 23, 1994
ABSTRACT: This is-an application for the abandonment of a right-of-way, 60 feet wide and
1328 feet in length, known as Oro Fino Drive. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: Access to the existing parcels will be via existing right-of-
ways (Viento Drive and Thorntree Drive). The abandonment of Oro Fino Drive will not cause
any circulation problems.
ANALYSIS: According to California Government Code Section 65402, the abandonment of
property must be in conformance with the General Plan. This request is in conformance with
the Butte County General Plan and will not conflict any adopted or proposed element of the
General Plan. This easement is not needed for any County Public Works projects.
The Planning Commission reviewed the above request on July 28, 1994 and found the project
in conformance with the General Plan.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary
of Resources to be Categorically Exempt under the California Environmental Quality Act Section
15305(d).
RECOMMENDATION: Staff recommends that the Board adopt a resolution for abandonment
of Oro Fino Drive, subject to the following findings.

REQUEST: Abandonment of Oro Fino Drive-for Thomas Reed: Located between Vispera
Drive and Whitchurch Lane on the north side of Thorntree Drive, approximately 1300 feet east
of Cohasset Road, in the north Chico area.

FOR: Planning Commission Meeting of July 28, 1994
ABSTRACT: This is an application for the abandonment of a right-of-way, 60 feet wide and
1328 feet in length, known as Oro Fino Drive. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: Access to the existing parcels will be via existing right-of-
ways (Viento Drive and Thorntree Drive). The abandonment of Oro Fino Drive will not cause
any circulation problems.
ANALYSIS: According to California Government Code Section 65402, the abandonment of
property must be in conformance with the General Plan. This request is in conformance with
the Butte County General Plan and will not conflict any adopted or proposed element of the
General Plan. This easement is not needed for any County Public Works projects.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary
of Resources to be Categorically Exempt under the California Environmental Quality Act Section
15305(d).
RECOMMENDATION: Staff recommends that the Commission approve the application for
abandonment of Oro Fino Drive, subject to the following findings.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review; and
