Abandonment of a portion of Glen Arbor Way as shown on the attached exhibit map,as a public
road in the recently recorded Orchardcrest Subdivision, Unit X. 017N) (95051)
Mr. Hogan said that a finding of consistency with the General Plan is recommended
There was a discussion of the difference in road standards betweenprivate roads versus public roads.
Commissioner Frisman noted that it is difficult to convey property on a private road without a road maintenance
agreement.
Mr. Hogan said that private road standards could be a future agenda item, with members of the Public Works
Department to be invited to attend
It was moved by Commissioner Seegert,seconded by Commissioner Lambert,and carried unanimously,for approval
of the Abandonment for William L Jaeger,subject to the findings and condition of the Revised Agenda Report dated
May 16, 1995.
There was a consensus that the Planning Commission should require road maintenance agreements as part of the
abandonment process, and the subject could be discussed at the June 22, 1995, Planning Commission meeting.
Florence Dixon said that she has signed a road maintenance agreement for her subdivision. She asked if new
standards are created, if her road would have to be redone?
Mr. Hogan said that new standards are generally not applied to existing situations, and in Mrs. Dixon's case, she
would not.be required to upgrade her road.

Mr. Hogan said that the Commission must decide if the request is in'conformance with the General Plan.
The Agenda Report indicates that the request does comply with the General Plan. The access is being
changed from public to private, although technically it is called an Abandonment.

to approve the application for abandonment of Orcharderest Drive, subject to the following findings and

Orchardcrest Subdivision. Unit #1 for William L. Jaeger: Located between 10th Street and
Middlehoff Lane, approximately 200 feet north of Wells Lane, in the Thermalito area.

ABSTRACT: This is a revised report to clarify the inclusion of a portion of Glen Arbor Way to the application for
the abandonment of the public road known as Orchardcrest Drive. The easement will remain to be utilized as a
private road. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: By abandoning the public roadway, the subdivision will become a private road
subdivision. This will give greater control to the developer/owner, such as allowing a gated entrance, and still
preserve all access rights.
ANALYSIS: According to California Government Code Section 65402, the abandonment of property must be in
conformance with the General Plan. This request is in conformance with the Butte County General Plan and will
not conflict any adopted or proposed element of the General Plan. This public road easement is not needed for
any County Public Works projects. Property owners along this portion of Glen Arbor Way and Orchardcrest Drive
will continue.to have access by the private easement which will replace the public road.
ENVIRONMENTAL DOCUMENTATION:This project has been determined by the Secretary of Resources to be
'Categorically Exempt under the California Environmental Quality Act Section 15305(d).
RECOMMENDATION: Staff recommends that the Commission approve the application for abandonment of
Orchardcrest Drive and a portion of Glen Arbor Way, subject to the following findings and conditions.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review; and
Section 2: General Plan Findings.

SUMMARY OF REQUEST - ACTION REQUESTED:
Proposed is the abandonment and conveyance of fee title of the two streets in Orchardcrest
Subdivision, Unit #1 , Orchardcrest Drive and Glen Arbor Way. The action is requested by the
developer to allow the subdivision to proceed .as a private road development, with controlled
access. The abandonment has been found by the Planning Commission to be categorically exempt
from environmental review and is in conformance with the General Plan. An offer of $238.00 has
been made to purchase the fee title, which is intended to defray costs.
Action Requested: Hold public hearing. Adopt Resolution abandoning public rights-of=way
and authorize Chair to sign. Approve conveyance of fee title for the sum of 5238.00 and authorize
Chair to sign Grant Deed.

went to the Planning Commission.
You request will be considered at the regular meeting of the Planning Commission on
May 25, 1995. This meeting will be held in the Board of Supervisors' Room, 25 County
Center Drive, Oroville, California and is scheduled to begin at 9:00 a.m.
The Planning Commission recommends that the applicant or their authorized
representative be present at the hearing to respond to any questions the Commission

Being all of Orchardcrest Drive lying easterly of the easterly 400
right of way line of 10th Street, and all of Glen Arbor Way, as
shown on the map of Orchardcrest Subdivision, Unit #1 recorded in
Book 130 maps of record at pages 39 to 42 , County of Butte, State
of California.
"In accordance with California Streets & Highways Code, Section
8340, we .-reserve and except from the vacation, an easement and
right at any time, or from time to time, to construct, maintain,
operate, replace, remove, enlarge anti renew lines of pipe,
conduits, cables, wires, poles, and other convenient structures,
equipment and fixtures for the operation of telephone lines,
including access to protect such from all hazards in, upon, and

Attached for your review and further action is a copy of a petition
for abandonment of Orchardcrest Drive, the public roads in the
recently recorded Orchardcrest Subdivision, Unit No. 1. This is
being requested in order for the developer to pursue the unit
development as a private road subdivision.
At your early convenience please have the Planning Commission
review the proposed abandonment in regards to conformity with the
General Plan. The present $262 . 00 abandonment processing fee has
been paid. Along with the abandonment, fee title to the rights of
way will also be conveyed, so we will work with County Counsel to
prepare the necessary resolutions.
Please advise us of the schedule of action to be taken by your
department and address all correspondence to William L. Jaeger,
P.O. Box 1300, Yuba City, CA 95992, with a copy to Ron Graves and

Gentlemen:
It's my understanding that the county is considering the abandonment of Orachardcrest Drive,
within the above mentioned subdivision.
Pacific Bell has underground distribution facilities within that portion of the county right of way
proposed to be abandoned. Therefore,in the event that portion of the right of way is abandoned,in
accordance with California Streets&Highways Code,Section 8340,Pacific hereby requests that
the Final Resolution of Abandonment provide the following reservation:
"In accordance with California Streets&Highways Code,Section 8340,we
reserve and except from the vacation,an easement and right at any time,or
from time to time,to construct,maintain,operate,replace,remove,enlarge
and renew lines of pipe,conduits,cables,wires,poles,and other convenient
structures,equipment,and fixtures for the operation of telephone lines,
including access to protect such from all hazards in,upon,and over the street
or highway proposed to be vacated."
Since it has been suggested that the roads will be eventually gated,I would request that the
language provided above been included rather than the reservation of a PUE as generally provided
by your abandonment resolution.
If,for any reason, a determination is.made that the above reservation is not in the public's interest,
we hereby request that final action be delayed until such time as Pacific Bell may submit a
response.

reference construction project in Thermalito . After speaking with
Mr . Jaeger and conferring with the Sheriff , I find that the Butte
County Sheriff ' s Office would be impacted, but minimally.
It was my suggestion to Mr . Jaeger that if he establish a gated
community in the Thermalito area, that the gate be of the type that
is siren operated, thus , allowing siren equipped emergency vehicles . is +"
to gain rapid access .

REQUEST: Abandonment of Orchardcrest Drive, and a portion of Glen Arbor Way, as a public road, in
Orchardcrest Subdivision, Unit #1 for William L. Jaeger: Located between 10th Street and
Middlehoff Lane, approximately 200 feet north of Wells Lane, in the Thermalito area.

FOR: Planning Commission Meeting
ABSTRACT: This is a revised report to clarify the inclusion of a portion of Glen Arbor Way to the application for
the abandonment of the public road known as Orchardcrest Drive. The easement will remain to be utilized as a
private road. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: By abandoning the public roadway, the subdivision will become a private road
subdivision. This will give greater control to the developer/owner, such as allowing a gated entrance, and still
preserve all access rights.
ANALYSIS: According to California Government Code Section 65402; the abandonment of property must be in
conformance with the General Plan. This request is in conformance with the Butte County General Plan and will
not conflict any adopted or proposed element of the General Plan. This public road easement is not needed for
any County Public Works projects. Property owners along this portion of Glen Arbor Way and Orchardcrest Drive
will continue to have access by the private easement which will replace the public road.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be
Categorically Exempt under the California Environmental Quality Act Section 15305(d).
RECOMMENDATION: Staff recommends that the Commission approve the application for abandonment of
Orchardcrest Drive and a portion of Glen Arbor Way, subject to the following findings and conditions.
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review; and
Section 2: General Plan Findings.
A. The proposed abandonment is in conformance with the Butte County General Plan; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, approve the Abandonment for
