Chairman Lambert asked if the two parcels to the north would have access if Lake Blvd.
was abandoned?
Mr. Hogan said the parcels.would have access through an extension of Beaver Road.
It was moved by Commissioner Lynch, seconded by Commissioner Seegert, and
unanimously carried for approval as follows:
Section 1: Environmental Findings.
A. The project is Categorically Exempt from environmental review;
Section 2: General Plan Findings.
A. The proposed abandonment will not conflict with the Circulation Element of the
Butte County General Plan nor any other element of the General Plan; and
B. The proposed abandonment of the right-of-way known as Lake Boulevard is not
needed for any County Public Works projects or any public utility facilities; and
Section 3: Action
A. Subject to the findings indicated in Sections 1 and 2 above, the Planning
Commission finds that the Abandonment for Tony Baron is in conformity with the
Butte County General Plan and recommends the following condition to the Board:
1. Applicant shall assure that all parcels have legal access.

FOR: Planning Commission Meeting
ABSTRACT: This is an application for the abandonment of a right-of-way known as Lake
Boulevard located in the Palermo area. Staff recommends approval of this request.
PROJECT CHARACTERISTICS: Lake Boulevard is a 60 foot wide right-of-way as shown on
the amended map of Ross Orchard Tract filed for record in Book 8 of Maps at page 26A, Butte
County Records.
ANALYSIS: According to California Government Code Section 65402, the abandonment of
property must be in conformance with the General Plan. This request is in conformance with
the Butte County General Plan and will not conflict with any adopted or proposed element of
the General Plan. This easement is not needed for any County Public Works projects. Property
owners along this portion of Lake Boulevard will continue.to have access via Beaver Road.
The Oroville Wyandotte Irrigation District has submitted a letter indicating they have no
objections to the proposed abandonment. PG&E has consented to the proposed
abandonment, but has indicated that the applicant should be cautioned that abandoned right-
of-way crosses a 200 ft. wide tower line easement that is building restricted. Pacific Bell has
indicated they have no objections to the proposed abandonment. The applicant has obtained
the required signatures from ten or more property owners in the area.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary
of Resources to be Categorically Exempt under the California Environmental Quality Act Section
15305(d).
RECOMMENDATION: Staff recommends that the Commission approve the application for
abandonment of Lake Boulevard on APN 027-020-063 &064, subject to the following findings.

At the regular meeting of the Butte County Board of Supervisors held December 13, 1994,
Resolution No. 94-142 was adopted which abandons a 60 foot right-of-way known as Lake
Boulevard, situated orth of the intersection of Beaver Road and Cougar Road on property
zoned A-5, identified as AP 027-020-063 and 064, Palermo.
For purposes of the California Environmental Quality Act, a Notice of Exemption must be
filed. The fee for the filing of a Notice of Exemption is the $25.00 documentary handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should
be submitted to the Planning Division by December 20, 1994.

area. The Planning Commission reviewed this application on October 27, 1994 and recommends the Board approve this
request.Lake Boulevard is a 60 foot wide right-of-way as shown on the amended map of Ross Orchard Tract filed for record
in Book 8 of Maps at page 26A, Butte County Records. According to California Government Code Section 65402, the

RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC RIGHT-OF-WAY
(PORTION OF LAKE BOULEVARD, PALERMO AREA)
WHEREAS, this Board has received. a petition from ten or
more free-holders; requesting the abandonment of a public right-of-
way as described below, and at least one of the petitioners is a
resident of the road district in which said right-of-way is
situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of
the California Streets and Highways Code, commencing with Section
8320, this Board shall set a date, hour and place for a hearing on
the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors:
1. That this Board hereby gives notice that at its
regular meeting on December 13 1994, at 10:00 a.m. ,
in the Board Chambers, Butte County Administration Building, 25
County Center Drive, Oroville, California, a hearing shall be held
to hear all persons interested in the abandonment of that certain
right-of-way which is located north of the intersection of Beaver
Road and Cougar Road in the unincorporated area of the County of
Butte, in the Palermo Area, State of California, is on property
identified as AP 027-020-063 and 064, and is more particularly
described as follows:

Being a portion of that certain 60 foot right-of-way known as Lake
Boulevard, as shown on the amended map of Ross Orchard Tract,
recorded in Book 8 Maps of Record, at Pages 31A, 32A and 33A,
County of Butte, State of California located 30 feet on each side
of the following described centerline:
Commencing at the East one quarter corner of Section 2, T 18 N,
R4E, M.D.M. ; thence N 130 19' 09" E. , 845.24 feet to the True
Point of Beginning, said point lying at the intersection of the
said centerline and the lot line common to AP# 27-02-62 and AP#
27-02-64, said point also being on a curve concave to the East,
having a radius of 500 feet and a central angle of 080 40' (the
radial bearing at this point being N 690 34' 50" W) ; thence
Southerly along said centerline and the arc of said curve 75. 62
feet; thence S 110 45' 11" W, 291.50 feet to the beginning of a
curve to the left having a radius of 1,000 feet and a central angle
of 090 351 ; thence along the arc of said curve 167.26 feet; thence
S 02° 10' 11" W, 106. 10 feet more or less to the Southerly end of
said Lake Boulevard and the end of the herein described centerline.
The Basis of Bearings for this description is the same as that as
shown on the Record of Survey recorded in Book 61 of Maps at Page
38, Butte County Recorders Office along the West line of the
Northwest one quarter of said Section 2 taken as North 020 09' 11"
East.
2 . That a map showing the public right-of-way to be
abandoned is on file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oroville, California 95965.
3 . That at the conclusion of said hearing the Board
intends to abandon said public right-of-way.
4. That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with Section 8320) .
5. That this Resolution be posted and published pursuant
to the provisions of Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code.

the following described centerline:
Commencing at the East one quarter corner of Section 2, T 18 N, R4E, M.D.M. ; thence
N 13° 19' 09" E. , 845.24 feet to the True Point of Beginning, said point lying at the
intersection of the said centerline and the lot line common to AP # 27-02-62 and
AP #27-02-64, said point also being on a curve concave to the East, having a radius
of 500 feet and a central angle of 08° 40' (the radial bearing at this point being
N 690 34' 50" W); thence Southerly along said centerline and the arc of said curve
75.62 feet; thence S 11° 45' 11" W, 291.50 feet to the beginning of a curve to the left

WHEREAS, this matter came on regularly for hearing before
the Board of Supervisors of the �County of Butte, State of

This company has no objection to and hereby consents to the abandonment of
the portion of Lake Boulevard lying within the boundary lines of Assessor' s
Parcel No. 27-020-064 and shown on the map of Ross Orchards Tract filed for
record in Book 8 of Maps at page .26A, Butte County Records.
Please bear in mind that Lake Boulevard crosses our 200-foot-wide tower
line easement and the applicant should be cautioned that it is building
restricted.
