(SH) (File #95-65) Mr. Hogan submitted new location maps showing the five parcels involved stating that there are five different owners. It. was moved by Commissioner Lynch, seconded by Commissioner Seegert, and unanimously carried for approval as follows: Section 1 : Environmental Findings. A. The project is Categorically Exempt from environmental review; Section 2: General Plan Findings. A. The proposed abandonment will not conflict with the'Circulation Element of the Butte County General Plan nor any other element of the General Plan; and B. The proposed abandonment of the sanitary sewer easement is not needed for any County Public Works projects or any public utility facilities; and Section 3: Action A. RELATED ITEMS: None FOR: Planning Commission Meeting ABSTRACT: This is an application for the abandonment of a sanitary sewer easement located in the Sterling City area. Staff finds the abandonment request is in conformance with the General Plan. PROJECT CHARACTERISTICS: The sanitary sewer easement is a 20 foot wide sewer easement lying within the Town of Sterling City as described in the deed to Butte County, recorded in Book 1075 of Official Records, at pages 465 through 467. ANALYSIS: According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict with any adopted or proposed element of the General Plan. This easement is not needed for any County Public Works projects. No utility concurrence is required. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305(d). PROJECT CHARACTERISTICS: The sanitary sewer easement is a 20 foot wide sewer easement lying within the Town of Sterling City as described in the deed to Butte County, recorded in Book 1075 of Official Records, at pages 465 through 467. ANALYSIS: According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General.Plan and will not conflict with any adopted or proposed element of the General Plan. This easement is not needed for any County Public Works projects.. No utility concurrence is required.
