Dear Board Members:
The undersigned, being more than five freeholders, at least one of whom is a
resident of the township in which the easement proposed to be abandoned is situated,
do hereby :petition your Honorable Board of Supervisors, in writing, in accordance with
provisions of Section 8321 of the Streets and Highways Code of the State of California,
to ABANDON the following-described PUBLIC SERVICE EASEMENT of the COUNTY OF BUTTE:
ABANDONMENT OF
20' SEWER EASEMENT - STIRLING CITY
A.P. 59-23-12, 14 AND 15
Being a portion of that certain 20-foot wide Sewer Easement lying
within T 24N, R4E, Section 28, M.D.M. ; also being a portion of Lots
10, 12 and 13 of Block B as shown on the official map of Stirling
City as filed in Book 4 of maps at page 33 on file in the Office of
the Recorder of the County of Butte, State of California August 3 ,
1903 , and also described in a Grand Deed Easement to the County of
Butte, from Diamond National Corporation recorded September 6, 1960
in Book 1075 of Official Records at Pages 470 and 471 and being
more particularly described as follows:
Beginning at a point on the centerline of the 20-foot wide easement
at its Point of Intersection with the northerly lot line of Lot 13
of said Block B, said Point of Intersection lies 54 .feet more or
less easterly of westerly the lot line of said Lot 13 ; thence in a
southerly direction along said centerline parallel to the westerly
lines of Lots 13 , 12 and 10 of said Block B, 132 feet more or less
to a point, said point lies 32 feet southerly of the most northerly
lot line of Lot 10 of said Block B and the end of the portion of
the 20 foot wide sewer easement to be abandoned.
The map showing the said 20 foot wide sewer easement to be
abandoned is on file in the Office of Butte County Department of
Public Works, 7 County Center Drive, Oroville, California.

REQUEST: ABN 96-03-Abandonment of a Sewer Easement for APNs 059-230-012, 014, &015:This is a
request to abandon a sewer easement located on Lots 10, 12, and 13 of Block B, Stirling City,
approximately 300 feet northeast of the intersection of Skyway and Manzanita St., Stirling City. This
project is located in an area zoned Unclassified. This project is located in Supervisorial District 5.

FOR: Planning Commission Meeting of March 28, 1996.
SUMMARY: This is a report for the abandonment of a sewer easement. State law requires that the Planning
Commission find that the abandonment will not be in conflict with the General Plan. Staff recommends approval of
this request.
ANALYSIS: The three affected parcels are connected to the Stirling City Sewer Maintenance District (CSA 82). The
Butte County Department of Public Works has stated that the current sewer easement is not adequate because it runs
under several houses. A new sewer easement will be conveyed to the County in exchange for the abandoned sewer
easement. An exhange agreement and grant deeds will be processed by the Butte County Department of Public
Works.
The abandonment will affect three parcels:APNs 059-230-012,014,and 015. The applicant submitted a petition, in
accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by
five people, at least one of whom is a resident of the township in which the project is located, requests the
abandonment.
According to California Government Code Section 65402,the abandonment of property must be in conformance with
the General Plan.This request is in conformance with the Butte County General Plan and will not conflict any adopted
or proposed element of the General Plan. Sewer service will continue to be provided to the three affected parcels.
ENVIRONMENTAL DOCUMENTATION:This project has been determined by the Secretary of Resources to be
Categorically Exempt under the California Environmental Quality Act Section 15305(d).
RECOMMENDATION: Staff recommends that the Commission approve the application for abandonment of the
sewer easement for Lots 10, 12,and 13, Block B, Stirling City,APNs 059-230-012,014, &015, in conformity with the
Butte County General Plan as follows:

along with plats delineating the subject easement. The present
$262 . 00 abandonment processing fee has been paid.
At your early convenience please have the Planning Commission
review the proposed abandonment in regard to conformance with the
General Plan. In addition to the abandonment, an exchange
agreement and grant deeds must also be processed and recorded, so
following Planning Commission action our department will pursue
further action on the abandonment with County Counsel and the
Board.

SUMMARY: This is a report for the abandonment of a sewer easement. State law requires that the Planning
Commission find that the abandonment will not be in conflict with the General Plan. Staff recommends approval of
this request.
ANALYSIS: The three affected parcels are connected to the Stirling City Sewer Maintenance District(CSA 82). The
Butte County Department of Public Works has stated that the current sewer easement is not adequate because it runs
under several houses. A new sewer easement will be conveyed to the County in exchange for the abandoned sewer
easement. An exhange agreement and grant deeds will be processed by the Butte County Department of Public
Works.
The abandonment will affect three.parcels:APNs 059-230-012,014, and 015. The applicant submitted a petition, in
accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by
five people, at least one of whom is a resident of the township in which the project is located, requests the
abandonment.
According to California Government Code Section 65402,the abandonment of property must be in conformance with
the General Plan.This request is in conformance with the Butte County General Plan and will not conflict any adopted
