Thomas Poole - Revocation of Use Permit 85-71. AP 025-030-019: A request for
revocation of Use Permit to allow a temporary second dwelling on property zoned "U"
(Unclassified) for Connie Poole and family, located on the north side of Oakwood Lane,
200 feet east of Highway 70, three miles west of Palermo. (SB)
Mr. Hogan gave a brief summary of the request.
The hearing was opened to the public.
No one, including the property owner, was present.
The hearing was closed.
It was moved by Commissioner Seegert, seconded by Commissioner Lynch, and unanimously
carried to revoke the Use Permit as follows:
Revoke Use Permit 85-71 for Thomas Poole for a temporary mobile home on APN 025-030-019
and direct that a certified letter, return receipt requested, be mailed to the applicant informing
him of the Commission's findings and requesting removal of the mobile home.

Pooler
Mr. Sanders explained that one area being abandoned is an unimproved right-of-way located at a dead-
end street and will be divided up between the adjacent parcels. The other area being abandoned is 10
feet of excess right-of-way on each side of Rice Avenue, which has an 80 foot right-of-way. He said that
the Caloro Street area is ARMH zoning and west of Church Street is probably A-5 zoning.
Terry Pooler said that the area being abandoned used to be part of a dirt road to Lindale Avenue, until a
house was built across it. No agencies had a problem with the abandonment. No one's access will be
impacted by the abandonment.

REQUEST: Abandonment of Public Right-of-Ways for Terry Pooler for a portion of Lots 113&152 of the
Town of Richvale:This is a request to abandon a portion of public right-of-ways on portions of Lots
113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records,
on Rice Ave. and Caloro St., Richvale. This area is zoned ARMH and A-5. This project is located
in Supervisorial District 1.

FOR: Planning Commission Meeting of June 13, 1996.
SUMMARY: This is a report for the abandonment of a portion of several public right-of-ways on Rice Ave. and
Caloro St., in Richvale. State law requires that the Planning Commission find that the abandonment will not be in
conflict with the General Plan. Staff recommends approval of this request.
ANALYSIS: This abandonment will effect three separate right-of-ways on portions of Lots 113 and 152 of the Town
of Richvale as shown in Book 6 of Map at page 53, Butte County Records. The first is a portion of Lot 113, which
is the right-of-way for Caloro St.that extends north of Rice St. to the alley between Church and Calrose Streets. This
81' X 140' section, which consists of an open field, is not needed as a right-of-way. Access to the alley between
Church and Calrose Streets will still be accessible from those streets. The next right-of-way to be abandoned is a
portion of Lot 152,which is Rice St. This abandonment consists of two separate 360'X 10'sections located on both
sides of Rice St. These two easements consists of open fields. A public utility easement is required by Pacific Gas
& Electric for these abandonments. A public utility easement will be reserved in the resolution approving this
abandonment. The Butte County Department of Public Works and the Butte County Fire Department have no
objections to this abandonment. The abandonment will effect seven parcels:APNs 029-141-004, 029-132-002, 029-
131-010 & 011, 029-133-003 &004.
The applicant submitted a petition in accordance with Section 8321 of the Streets and Highway Code of the State
of California. The petition, signed by 11 people, at least two of whom are residents of the road district in which the
project is located, requests the abandonment.
According to California Government Code Section 65402,the abandonment of property must be in conformance with
the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any
adopted or proposed element of the General Plan.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be
Categorically Exempt under the California Environmental Quality Act Section 15305(d).
RECOMMENDATION: Staff recommends that the Planning Commission approve the application for abandonment
of portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County
Records and find it in conformity with the Butte County General Plan as follows:
Section 1: Environmental Findings.
A. The project is categorically exempt from environmental review; and
Butte County Department of Development Services-Planning Division

Section 2: General Plan Findings.
A. The proposed abandonment is in conformance with the Butte County General Plan; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, approve the Abandonment for
Terry Pooler for a portion of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map
at page 53, Butte County Records, for property identified as APNs 029-141-004, 029-132-002, 029-
131-010&011, 029-133-003 &004.
Conditions.
1. Reserve in the resolution approving the abandonment an easement for public utility purposes over
the property being abandoned.

reviewed by the Planning Commission in regard to conforming with
the General Plan and following that, have it further processed by
County Counsel and submitted to the Board for approval.
The description to be used is as shown on the petition. There is
an easement to be reserved as requested by P.G. and E. and Viacom
Cable. Copies of all letters received from utilities are also
enclosed.

RESOLUTION ABANDONING PUBLIC RIGHTS-OF-WAY
(PORTION OF LOTS 113 AND 152, TOWN OF RICHVALE)
WHEREAS, this matter came on regularly for hearing before the Board
of Supervisors of the County of Butte, State of California, on
August- 13 , 1996, in the Board Chambers, Butte County
Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the
time and place of the hearing on the .petition for the abandonment
of the rights-of-way in question was duly and regularly given as
required by law and at least two of the petitioners are residents
of the road district in which the right-of-way is situated; and,
WHEREAS, testimony and evidence, both oral and
documentary, having been produced at said hearing, from which said
Board now finds that the hereinafter described public rights-of-way
are unnecessary for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public rights-of-way situated in the County
of Butte, State of California, as hereinafter more particularly
described, are hereby abandoned pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Code (commencing
with Section 8320) .
2. That said public rights-of-way so abandoned are
located in the unincorporated area of the County of Butte, State of

California, are identified as portions of public rights-of-way on
portions of Lots 113 and 152 of the Town of Richvale, and are more
particularly described as follows:
A portion of Section 16, Township 19 North, Range 2 East,
M.D.M. , Butte County, State of California, and being more
particularly described as follows:
Being a portion of lots 152 and 113 of the Town of
Richvale, as shown in Book 6 of maps at Page 53, on file
in the Office of the Recorder, County of Butte, State of
California.

Being the northerly 10 feet of said Lot 152 of the Town
of Richvale, excepting therefrom the following described
area:
Beginning at the northeast corner of said -Lot 152; thence
i southerly along the easterly line of said Lot 152, a
distance of 10. 00 feet; thence leaving said easterly
line, westerly, 10.00 feet southerly of and parallel with
the northerly line of said Lot 152, a distance of 20. 00

any existing public service easement and/or rights at any
time, or from time to time, to maintain, operate,
replace, remove, renew and enlarge the existing public
service facilities and facilities incidental thereto,
including access to protect the property from all hazards
in, upon, and over the highway herewith to be abandoned.
3. That a map showing the rights-of-way hereby abandoned is
on file in the Office of Butte County Department of Public Works,
7 County Center Drive, Oroville, California 95965.
4. That the Clerk of this Board shall cause a certified copy
of this Resolution, with the seal of the Board of Supervisors of
the County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.

At the regular meeting of the Butte County Board of Supervisors held August 13, 1996,
Resolution No. 96-96 was adopted which abandons a portion of public right-of-ways on
portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Maps at Page
53, located on Rice Avenue and Caloro Street, Richvale.
To increase administrative efficiency, the statute delegated the collection of filing fees to
the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee for the filing of a Notice of Exemption is the $25.00 documentary
handling fee. A check made payable to the County in the amount of $25.00 should be
submitted to the County by August 19, 1996.

REQUEST: Abandonment of Public Right-of-Ways for Terry Pooler for a portion of Lots 113&152 of the
Town of Richvale:This is a request to abandon a portion of public right-of-ways on portions of Lots
113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records,
on Rice Ave. and Caloro St., Richvale. This area is zoned ARMH and A-5. This project is located
in Supervisorial District 1.

FOR: Board of Supervisors Meeting of August 13, 1996.
SUMMARY: This is a report for the abandonment of a portion of several public right-of-ways on Rice Ave. and
Caloro St., in Richvale. The Planning Commission has heard this application and recommends that the Board of
Supervisors approve this request.
ANALYSIS: This abandonment will effect three separate right-of-ways on portions of Lots 113 and 152 of the Town
of Richvale as shown in Book 6 of Map at page 53, Butte County Records. The first is a portion of Lot 113, which
is the right-of-way for Caloro St. that extends north of Rice St. to the alley between Church and Calrose Streets. This
81'X 140' section, which consists of an open field, is not needed as a right-of-way. Access to the alley between
Church and Calrose Streets will still be accessible from those streets.
The second and third right-of-ways to be abandoned is a portion of Lot 152, which is Rice St. This abandonment .
consists of two separate 360'X 10'sections located on both sides of Rice St. These two easements consist of open
fields. A public utility easement is required by Pacific Gas & Electric for these abandonments. A public utility
easement will be reserved in the resolution approving this abandonment.
The Butte County Department of Public Works and the Butte County Fire Department have no objections to this
abandonment. The abandonment will effect seven parcels: APNs 029-141-004, 029-132-002, 029-131-010 & 011,
029-133-003 & 004. These parcels will still continue to have access to public streets.
The applicant submitted a petition in accordance with Section 8321 of the Streets and Highway Code of the State
of California. The petition, signed by 11 people, at least two of whom are residents of the road district in which the
project is located, requests the abandonment.
According to California Government Code Section 65402,the abandonment of property must be in conformance with
the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any
adopted or proposed element of the General Plan.
ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be
Categorically Exempt under the California Environmental Quality Act Section 15305(d).
RECOMMENDATION: Staff recommends that the Board of Supervisors concur with the Planning Commission and
approve the application for abandonment of portions of Lots 113 and 152 of the Town of Richvale as shown in Book
6 of Map at page 53, Butte County Records for property identified as APNs 029-141-004, 029-132-002, 029-131-010
& 011, 029-133-003 & 004 based upon the following findings:

A. Subject to the findings indicated in Sections 1 and 2 of this report, the Board of Supervisors finds
that the Abandonment for Terry Pooler for a portion of Lots 113 and 152 of the Town of Richvale
as shown in Book 6 of Map at page 53, Butte County Records, for property identified as APNs 029-
141-004, 029-132-002, 029-131-010 & 011, 029-133-003 & 004, is in conformity with the Butte
County General Plan; and,
B. Adopt a Resolution approving the Abandonment for Terry Pooler for a portion of Lots 113 and 152
of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records, for property
identified as APNs 029-141-004., 029-132-002, 029-131-010 & 011, 029-133-003 & 004.
Conditions.
1. Reserve in the resolution approving the abandonment an easement for public utility purposes over
the property being abandoned.

Dear Board Members:
The undersigned, being ten or more freeholders, at least two of whom are
residents of the Road District in which some part of the highway affected is
situated; and who are taxable therein for highway purposes, do hereby
petition your Honorable Board of Supervisors in writing, in accordance with
provisions of Section 8321 of the Streets and Highways Code of the State of
California, to ABANDON the following-described COUNTY HIGHWAY of the COUNTY
OF BUTTE.
A portion of Section 16, Township 19, North, Range 2 East, M.D.M. , Butte County, State of
California, and being more particularly described as follows:
Being a portion of. lots 152 and 113 of the Town of Richvale, as shown in Book 6 of maps at
Page 53, on file in theh office of the Recorder, County of Butte, State of California.
Parcel No. 1-A
Being the northerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the
following described area:
Beginning at the northeast corner of said Lot 152; thence southerly along the easterly line
of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00
feet southerly of and aprallel with the northerly line of said Lot 152, a distance of 20.00
feet to a point of cusp and beginning of a curve concave to the northwest, having a radius
of 20.00 feet and a radial line perpendicular to the said northerly line of Lot 152; thence
northeasterly along the arc of said curve to its intersection with said northerly line of Lot
152; thence easterly along said northerly line to the point of beginning.
Parcel No. 1B
Being the southerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the
following described area:
Beginning at the southeast corner of said Lot 152; thence northerly along the easterly line
of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00
feet northerly of and parallel with the southerly line of said Lot 152, a distance of 20.00
feet to a point of cusp and beginnning of a curve concave to the southwest, having a radius
of 20.00 feet and a radial line perpendicular to said southerly line of Lot 152; thence
southeasterly along the arc of said curve to its intersection with said southerly line of Lot
152; thence easterly along said southerly line .to the Point of Beginning.
Parcel No. 2
Being all of that portion of said Lot 113 of the Town of Richvale lying between the easterly
prolongation of the northerly line of Lot 162 and the easterly prolongation of the southerly
line of Lot 163 of said Town of Richvale.
EXCEPTING AND RESEVING any existing easement and/or rights at any time, or from time to time,
to maintain, operate, replace, remove, renew and enlarge the existing public utility
facilities and facilities incidental thereto, including access to protect the property from
all hazards in, upon, and over the highway herewith to be abandoned.

Dear Mr. and Mrs. Pooler:
We have reviewed your proposal for the abandonment of a portion of Lots 113 and 152 of the
Town of Richvale as shown in Book 6 of Maps at page 53, Butte County Records. We have
determined that PG&E has existing facilities within the area to be abandoned.
We have no objection to this abandonment provided that it is retained as a public utility
easement pursuant to Chapter 5, Section 8340 C of the California Street and Highway Code.
We request that the following language be used in the County resolution:
"Reserving, however, to Pacific Gas and Electric Company the right from time to
time to install, maintain, repair, operate, replace, remove and renew lines of pipes,
wires, poles and other structures, equipment and fixtures, both aboveground and
underground, for the operation of said facilities."
You may use this letter in your negotiations with the County of Butte. If you have any
