BUTTE COUNTY BOARD OF SUPERVISORS MINUTES - June 25, 1996 Thomas Poole - Revocation of Use Permit 85-71. AP 025-030-019: A request for revocation of Use Permit to allow a temporary second dwelling on property zoned "U" (Unclassified) for Connie Poole and family, located on the north side of Oakwood Lane, 200 feet east of Highway 70, three miles west of Palermo. (SB) Mr. Hogan gave a brief summary of the request. The hearing was opened to the public. No one, including the property owner, was present. The hearing was closed. It was moved by Commissioner Seegert, seconded by Commissioner Lynch, and unanimously carried to revoke the Use Permit as follows: Revoke Use Permit 85-71 for Thomas Poole for a temporary mobile home on APN 025-030-019 and direct that a certified letter, return receipt requested, be mailed to the applicant informing him of the Commission's findings and requesting removal of the mobile home. ----------- Butte Butte County Planning Commission Minutes August 24, 1995 It was moved by Commissioner Nelson, seconded by Commissioner Cage, and carried unanimously for approval of the Consent Agenda. SB ( )(ABA - N96 05) Pooler Mr. Sanders explained that one area being abandoned is an unimproved right-of-way located at a dead- end street and will be divided up between the adjacent parcels. The other area being abandoned is 10 feet of excess right-of-way on each side of Rice Avenue, which has an 80 foot right-of-way. He said that the Caloro Street area is ARMH zoning and west of Church Street is probably A-5 zoning. Terry Pooler said that the area being abandoned used to be part of a dirt road to Lindale Avenue, until a house was built across it. No agencies had a problem with the abandonment. This area is zoned ARMH and A-5. This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of June 13, 1996. SUMMARY: This is a report for the abandonment of a portion of several public right-of-ways on Rice Ave. and Caloro St., in Richvale. State law requires that the Planning Commission find that the abandonment will not be in conflict with the General Plan. Staff recommends approval of this request. ANALYSIS: This abandonment will effect three separate right-of-ways on portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records. The first is a portion of Lot 113, which is the right-of-way for Caloro St.that extends north of Rice St. to the alley between Church and Calrose Streets. This 81' X 140' section, which consists of an open field, is not needed as a right-of-way. Access to the alley between Church and Calrose Streets will still be accessible from those streets. The next right-of-way to be abandoned is a portion of Lot 152,which is Rice St. This abandonment consists of two separate 360'X 10'sections located on both sides of Rice St. These two easements consists of open fields. A public utility easement is required by Pacific Gas & Electric for these abandonments. A public utility easement will be reserved in the resolution approving this abandonment. The Butte County Department of Public Works and the Butte County Fire Department have no objections to this abandonment. The abandonment will effect seven parcels:APNs 029-141-004, 029-132-002, 029- 131-010 & 011, 029-133-003 &004. The applicant submitted a petition in accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by 11 people, at least two of whom are residents of the road district in which the project is located, requests the abandonment. According to California Government Code Section 65402,the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any adopted or proposed element of the General Plan. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305(d). RECOMMENDATION: Staff recommends that the Planning Commission approve the application for abandonment of portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records and find it in conformity with the Butte County General Plan as follows: Section 1: Environmental Findings. A. The project is categorically exempt from environmental review; and Butte County Department of Development Services-Planning Division 1 Section 2: General Plan Findings. A. The proposed abandonment is in conformance with the Butte County General Plan; and Section 3: Action. A. This area is zoned ARMH and A-5. This project is located in Supervisorial District 1. RELATED ITEMS: None i FOR: Board of Supervisors Meeting of August 13, 1996. SUMMARY: This is a report for the abandonment of a portion of several public right-of-ways on Rice Ave. and Caloro St., in Richvale. The Planning Commission has heard this application and recommends that the Board of Supervisors approve this request. ANALYSIS: This abandonment will effect three separate right-of-ways on portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records. The first is a portion of Lot 113, which is the right-of-way for Caloro St. that extends north of Rice St. to the alley between Church and Calrose Streets. This 81'X 140' section, which consists of an open field, is not needed as a right-of-way. Access to the alley between Church and Calrose Streets will still be accessible from those streets. The second and third right-of-ways to be abandoned is a portion of Lot 152, which is Rice St. This abandonment . consists of two separate 360'X 10'sections located on both sides of Rice St. These two easements consist of open fields. A public utility easement is required by Pacific Gas & Electric for these abandonments. A public utility easement will be reserved in the resolution approving this abandonment. The Butte County Department of Public Works and the Butte County Fire Department have no objections to this abandonment. The abandonment will effect seven parcels: APNs 029-141-004, 029-132-002, 029-131-010 & 011, 029-133-003 & 004. These parcels will still continue to have access to public streets. The applicant submitted a petition in accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by 11 people, at least two of whom are residents of the road district in which the project is located, requests the abandonment. According to California Government Code Section 65402,the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any adopted or proposed element of the General Plan. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305(d). RECOMMENDATION: Staff recommends that the Board of Supervisors concur with the Planning Commission and approve the application for abandonment of portions of Lots 113 and 152 of the Town of Richvale as shown in Book 6 of Map at page 53, Butte County Records for property identified as APNs 029-141-004, 029-132-002, 029-131-010 & 011, 029-133-003 & 004 based upon the following findings: Section 1: Environmental Findings. ■Butte County Department of Development Services ■ 1 I A. A portion of Section 16, Township 19, North, Range 2 East, M.D.M. , Butte County, State of California, and being more particularly described as follows: Being a portion of. lots 152 and 113 of the Town of Richvale, as shown in Book 6 of maps at Page 53, on file in theh office of the Recorder, County of Butte, State of California. Parcel No. 1-A Being the northerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the following described area: Beginning at the northeast corner of said Lot 152; thence southerly along the easterly line of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00 feet southerly of and aprallel with the northerly line of said Lot 152, a distance of 20.00 feet to a point of cusp and beginning of a curve concave to the northwest, having a radius of 20.00 feet and a radial line perpendicular to the said northerly line of Lot 152; thence northeasterly along the arc of said curve to its intersection with said northerly line of Lot 152; thence easterly along said northerly line to the point of beginning. Parcel No. 1B Being the southerly 10 feet of said Lot 152 of the Town of Richvale, excepting therefrom the following described area: Beginning at the southeast corner of said Lot 152; thence northerly along the easterly line of said Lot 152, a distance of 10.00 feet; thence leaving said easterly line, westerly, 10.00 feet northerly of and parallel with the southerly line of said Lot 152, a distance of 20.00 feet to a point of cusp and beginnning of a curve concave to the southwest, having a radius of 20.00 feet and a radial line perpendicular to said southerly line of Lot 152; thence southeasterly along the arc of said curve to its intersection with said southerly line of Lot 152; thence easterly along said southerly line .to the Point of Beginning.
