Mr. Lucas said that there is a condition for the Butte Water District to retain an easement to the canal. '�i ^• "���""�".!"•" �Y t..:..,•''',�T' ���(f �1 /: ':'t �-�k �r�,`�t f i l • 1 AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Stephen Lucas, Planner DATE: May 23, 1996 REQUEST: Abandonment of Fagan Street Road Easement:This is a request to abandon a public right-of-way identified as Fagan Street located on the east side of Larkin Road approximately 2,500 feet south e of the intersection of East Gridly Road and Larkin Road, in Gridley, in an area zoned A-40. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of June 13, 1996. SUMMARY: This is a report for the abandonment of Fagan Street. State law requires that the Planning Commission find that the abandonment will not be in conflict with the General Plan. Staff recommends approval of this request. ANALYSIS: Fagan Street is an approximately half mile long public right-of-way beginning at Larkin Road and terminating at the Sutter-Butte Canal. The abandonment is being sought by the neighboring property owners in order to remove the orchard screened road as a party spot,dumping area, and to reduce vandalism and criminal activity in the area. The three affected property owners who legally use the road at present,Madare Brothers, Butte Water District,and Ken Collins support the abandonment. The conversion of this public right-of-way to a private road would allow for the road to be gated or otherwise restricted from access,thus removing the trespassing/vandalism issue. The parcels located adjacent to this road are zoned A-40 and are not sufficient in size to be further divided. Fagan Street provides access to lots 7, 8 & 9 of the Rio De La Plumas Tract(APN 024-040-045). These lots should be provided a road easement to assure the lots will maintain access to a publicly.maintained road. Parcels to the south of Fagan Street will have access from Kiefer Road. The Butte Water District operates the Sutter-Butte Canal and will require a road easement to provide access to the headgate for Lateral No. 1 which parallels Fagan Street. The District is also concerned that the abandonment map included the Lateral No. 1 canal which remains in use. The final map should either not include the canal or provide an easement for its use. Comments received from Pacific Bell and I Pacific Gas& Electric indicate no objections to the abandonment. The applicant submitted a petition,in accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by 10 people, at least two of whom are residents of the road district in which the project is located, requests the abandonment. According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any adopted or proposed element of the General Plan. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for abandonment of Fagan Street in conformity with the Butte County General Plan with the following condition: 1. Lots 7,8,&9 of the Rio De La Plumas Tract shall retain a road easement along Fagan Street for access to Larkin Road. 2. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320) . 2 . That said public right-of-way so abandoned is located in the unincorporated area of the County of Butte, State of California, is identified as Fagan Street, on the East side of Larkin Road, Gridley, and is more particularly described as follows: Being a portion of the Southeast one quarter of Section 5, T. 17 N. , R. 3 E. , M.D.M. , also being the right-of-way Rof F,-agan Street (formerly Kirk Road) , more particularly described as follows: A strip of land 50 feet wide, lying Southerly of and parallel to the following described line: Commencing at the East one quarter corner of said Section 5; thence West along the East and West centerline of said Section 5 to the Westerly right-of-way line of the Sutter Butte Canal and the TRUE POINT OF BEGINNING of the line herein described; thence West along said East and West centerline of said Section 5 to a point in the Easterly right-of-way line of Larkin Road. Madare) (ABAN96-06): This is a request to abandon a public right-of-way identified as Fagan Street located on the east side of Larkin Road approximately 2,500 feet south of the intersection of East Gridley Road and Larkin Road, in Gridley, in an area zoned A-40. This project is located in Supervisorial District 4. RELATED ITEMS: Planning Commission agenda report of May 23, 1996. FOR: Board of Supervisors Meeting of August 13, 1996. SUMMARY: This is a report for the abandonment of Fagan Street in the east Gridley area. The Planning Commission has heard this application at the June 13,-1996 meeting and found the request to be consistent with the General Plan and recommends that the Board of Supervisors approve this request. ANALYSIS: As indicated in the Planning Commission agenda report, this abandonment is intended to remove Fagan Street as an attractive nuisance, dumping ground and party spot for local persons. Staff has visited the site and found a great deal of debris left behind by users of the dead end street. There will be no practical loss of use for county residents considering the road has no circulation function. The Butte County Department of Public Works and the Butte County Fire Department have no objections to this abandonment. The applicant submitted a petition in accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition, signed by 10 people, at least two of whom are residents of the road district in which the project is located, requests the abandonment. According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict any adopted or proposed element of the General Plan. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305(d). RECOMMENDATION: Staff recommends that the Board of Supervisors concur with the Planning Commission and approve the application for abandonment of Fagan Street based upon the following findings and conditions: Section 1: Environmental Findings. ANALYSIS: Fagan Street is an approximately half mile long public right-of-way beginning at Larkin Road and terminating at the Sutter-Butte Canal. The abandonment is being sought by the neighboring property owners in order to remove the orchard screened road as a party spot,dumping area,and to reduce vandalism and criminal activity in the area. The three affected property owners who legally use the road at present, Madare Brothers, Butte Water District,and Ken Collins support the abandonment. The conversion of this public right-of-way to a private road would allow for the road to be gated or otherwise restricted from access,thus removing the trespassingivandalism issue. The parcels located adjacent to this road are zoned A-40 and are not sufficient in size to be further divided. Fagan Street provides access to lots 7, 8 & 9 of the Rio De La Plumas Tract (APN 024-040-045). These lots should be provided a road easement to assure the lots will maintain access to a publicly maintained road. Parcels to the south of Fagan Street will have access from Kiefer Road. The Butte Water District operates the Sutter-Butte Canal and will require a road easement to provide access to the headgate for Lateral No. 1 which parallels Fagan Street. The District is also concerned that the abandonment map included the Lateral No. 1 canal which remains in use. The final map should either not include the canal or provide an easement for its use. Comments received from Pacific Bell and Pacific Gas& Electric indicate no objections to the abandonment. The applicant submitted a petition,in accordance with Section 8321 of the Streets and Highway Code of the State of California. The area at the end of the road is an attraction to a considerable number of persons using it for alcohol and narcotic parties and who then vandalize and burglarize the surrounding property. There are only three.. parties using the road at present, Butte Water District, Madare Bros. and Ken Collins. In talk:L6g to Ken Collins, I find that he and Jim Sanderson attempted to do this several years ago but ran into the obstacle of the county requiring something like $11, 000. 00 to close this road. This appears to be quite an unreasonable fee and, I am sure, it would kill any chances to close this road if it were still required, however, please send any forms required so we may again attempt to close this road.
