(LP) (ABAN 98-02) It was moved by Commissioner Mooney, seconded by Commissioner Cage, and unanimously carried to approve the Consent Agenda. r E BUTTE COUNTY'PLANNING COMMISSION MINUTES - September 25,- 1997 AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Department of Development Services DATE: August 26, 1997 REQUEST: Joseph Chiapella File #ABAN98-02 - Abandonment of Public Service Easements: This is a request to abandon a public utilities easement located on lots 6 & 7 of Castle Rock Subdivision on the south side of Centerville Road approximately 1 mile north of Humbug Road, identified as AP 011-310-012, Chico, in an area zoned FR-2 (Foothill Recreational, 2 acres minimum). This project is located in Supervisorial District 5 RELATED ITEMS: None FOR: Planning Commission Meeting of September 25, 1997. SUMMARY: This is a report for the abandonment of a 6' public utilities,easement running 3' on each side of the property line common to Lots 6 & 7 of Castle Rock Subdivision. Pursuant to Government Code Section 65402 the Planning Commission must find that the abandonment will not be in conflict with the General Plan. - Staff recommends that this request be found to be in conformity with the General Plan. ANALYSIS: The owner of the two parcels has requested the abandonment following the merging of the two parcels, approved by Certificate of Merger. Pacific Gas & Electric has utilities located within the existing easement but has no objection to relocating their facilities subject to approval of this request. Pacific Bell also states no objection to relocating their facilities should this abandonment be approved. The applicant submitted a petition, in accordance with Section 8321 of the Streets and Highway Code of the State of California. The petition was signed by 6 people requesting the abandonment. According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is in conformance with the Butte County General Plan and will not conflict with any adopted or proposed element of the General Plan. ENVIRONMENTAL DOCUMENTATION: This project has been determined by the Secretary of Resources to be Categorically Exempt under the California Environmental Quality Act Section 15305. RECOMMENDATIOW'Staff recommends that the Planning Commission find the application for abandonment of the 6' easement to be categorically exempt from CEQA and to be in conformity ■Butte County Department of Development Services ■ 1 with the Butte County General Plan. The following condition of approval is recommended to the Board of Supervisors: 1. Reserve in the resolution approving the abandonment an easement for public utility purposes (if needed) to be dedicated in the new location. McElr Assistant Director RDM/lt cc: Surveys -'Planning Division,w/Resolution Attn: Lynn Richardson C:\PROJECTS\LINDAWBANDON\CHIAPELA.DOC i 4 Resolufion No. 97152 RESOLUTION ABANDONING A PUBLIC SERVICE EASEMENT (A PUBLIC UTILITY EASEMENT, IN THE CASTLE ROCK SUBDIVISION) WHEREAS,this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on November 10 1997, in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public service easement in question was duly and regularly given as required by law; and WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that: (1) there is no possibility the proposed abandonment of this public service easement may have a significant effect on the environment, and it is therefore not subject to the California Environmental Quality Act; (2) the proposed abandonment is in conformance with the Butte County General Plan; and (3) the public service easement in question, as hereinafter described, is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public service easement situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter.3 of part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public service Basement so abandoned is located in the unincorporated area of the County of Butte, State of California, in the Castle Rock Subdivision, is identified as a portion of Assessor's Parcel Number 011-320-012, and is described as follows: A portion of Lot 6 and Lot 7 as shown on Subdivision No. 89 of the Castle Rock Subdivision which map was filed in the office of the Recorder of the County of Butte, State of California on October 8, 1975, in Book 43 of Maps at Pages 81 and 82; and also being a portion of the Southwest one-quarter of Section 19, Township 22 North, Range 3 East, M.D.M., and being more particularly described as follows: Being an easement 6.00 feet in width, lying 3.00 feet on each side of the property line common to said Lots 6 and 7 and being designated on said map as a Public Utility Easement. Excepting therefrom the existing 10.00 foot Public Utility Easement contiguous to Humbug Road as shown on said map. 3. That a map showing the public service easement hereby abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California. PG&E has no objection to the proposed abandonment provided new rights (if needed) are dedicated in the new location. If any construction activities are proposed within the subject area, please contact the Underground Service Alert(L: S.A.), telephone 1-800-642-2444, at least 48 hours prior to such work. Since it is required that we relocate or rearrange our facilities to accommodate the development of said abandonment area, it is understood that the cost to perform such work will be at the expense of the owner/developer. Any required alteration of our facilities should be coordinated with PG&E as soon as possible so that we can provide adequate lead time with our engineering department.
