Determined this project to be Categorically Exempt under the California Environmental Quality Act Section 15305. II. Recommend approval to the Board of Supervisors the Abandonment for Scott Ritchie of the public utilities easement, subject to the following findings: A. The proposed abandonment is in conformance with the Butte County General Plan. B. The public utilities easement is not required by any public utility provider in the County. RECEIVED JAN 1 12390 BUTTE COUNTY PLANNING DIVISION 4 - Resolution No. 99-146 RESOLUTION ABANDONING A PUBLIC UTILITY EASEMENT (A PUBLIC UTILITY EASEMENT IN LOT 13, COUNTRY ESTATES SUBDIVISION) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on October 12 1999 , in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California; and WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public utility easement in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that: (1') there is no possibility the proposed abandonment of this public utility easement may have a significant effect on the environment, and it is therefore not subject to the California Environmental Quality Act; (2) the proposed abandonment is in conformance with the Butte County General Plan; and (3) the public utility easement in question, as hereinafter described, is unnecessary for present or prospective public use. Vicinity Map B: General Plan/Zoning Map C: Correspondence STAFF COMMENT State law requires that the Planning Commission find that an abandonment such as proposed will not be in conflict with a General Plan. Staff has analyzed this request and recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public utility easement proposed for abandonment is approximately 8 feet by 220 feet(1,764 sq. ft.) in size. This easement,which was created in 1956 as part of the Country Estates Subdivision(Map of Records Book 22,Pages 22- 23), has never been utilized for any public utility purposes. -The easement is surrounded by three parcels ranging in size from .3 to .6 acres that are developed with single family dwellings. ANALYSIS: Pacific Gas and Electric (PG&E), Pacific Bell, and Chambers Cable commented on this project and do not object to the abandonment of the utility easement. Abandoning the easement will not result in any impacts to these utility providers. According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan. This request is consistent with the Butte County General Plan because it does not conflict with any adopted or proposed element of the General Plan. Staff has analyzed this request and recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public utility easement proposed for abandonment is approximately 8 feet by 220 feet (1,764 sq. ft.) in size. This easement, which was created in 1956 as part of the Country Estates Subdivision(Map of Records Book 22,Pages 22- 23), has never been utilized for any public utility purposes. The easement is surrounded by three parcels ranging in size from .3 to .6 acres that are developed with single family dwellings. ANALYSIS: Pacific Gas and Electric (PG&E), Pacific Bell, and Chambers Cable commented on this project and do not object to the abandonment of the utility easement. Abandoning the easement will not result in any impacts to these utility providers. According to California Government Code Section 65402, the abandonment of property must be in conformance with the General Plan.
