Scott Ritche -Abandonment of a public utilities easement for property zoned A-5 (Agricultural - 5
acre parcels). The property is located on the north side of rodeo Avenue, approximately 1,200 feet
west of Nord Avenue, Chico. (ABAN 99-01) (SB)
The Planning Commission took the following actions:
I. Determined this project to be Categorically Exempt under the California Environmental Quality Act
Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment for Scott Ritchie of the public
utilities easement, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The public utilities easement is not required by any public utility provider in the County.
It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to
approve the Minor Use Permit(MUP99-06) for Karen Lee Vidauri for a large day care facility subject to the
findings and conditions listed above, and recommend approval of an abandonment(ABAN 99-01) for Scott
Ritchie subject to the findings listed above.

RESOLUTION ABANDONING
A PUBLIC UTILITY EASEMENT
(A PUBLIC UTILITY EASEMENT IN LOT 13, COUNTRY ESTATES SUBDIVISION)
WHEREAS, this matter came on regularly for hearing before the Board of Supervisors
of the County of Butte, State of California, on October 12 1999 , in the Board
Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California;
and
WHEREAS, it appearing to said Board that notice of the time and place of the hearing
on the petition for the abandonment of the public utility easement in question was duly and
regularly given as required by law; and,
WHEREAS, testimony and evidence, both oral and documentary, having been produced
at said hearing, from which said Board now finds that: (1') there is no possibility the proposed
abandonment of this public utility easement may have a significant effect on the environment,
and it is therefore not subject to the California Environmental Quality Act; (2) the proposed
abandonment is in conformance with the Butte County General Plan; and (3) the public utility
easement in question, as hereinafter described, is unnecessary for present or prospective public
use.
NOW,THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public utility easement situated in the County of Butte, State of
California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3
of Part 3 of Division 9 of the California Streets and Highways Code, commencing with Section
8320.
2. That said public utility easement so abandoned is located in the unincorporated
area of the County_ of Butte, State of California, in the Chico area, in the COUNTRY ESTATES
SUBDIVISION, identified as a portion of Assessor's Parcel Number 042-310-013, and is
described as follows:
A portion of Lot 13 as shown on COUNTRY ESTATES SUBDIVISION which map was
filed in the Office of the Recorder of the County of Butte, State of California on January
29, 1957, in Book 22 of ivlaps at Pages 22 & 23, and also being a portion of Lot 52 of the
Third Subdivision of the John Bidwell Rancho; Butte County, California, and being more
particularly described as follows;
Being an easement 8.00 feet in width, lying Easterly of/and parallel with and contiguous
to the most Westerly Lot line of said Lot 13 and being designated on said map as a Public
Utility Easement.
Excepting therefrom the existing 12-foot public utility easement contiguous to the North
line of said Lot 13 as shown on said map.
3. That a map showing the Public Utility Easement hereby abandoned is on file in
the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville,
California 9965.
4. That the Clerk of this Board shall cause a certified copy of this Resolution, with
the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in
the Office of the Recorder of the County of Butte, State of California.

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed
will not be in conflict with a General Plan. Staff has analyzed this request and recommends
approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public utility easement proposed
for abandonment is approximately 8 feet by 220 feet(1,764 sq. ft.) in size. This easement,which
was created in 1956 as part of the Country Estates Subdivision(Map of Records Book 22,Pages 22-
23), has never been utilized for any public utility purposes. -The easement is surrounded by three
parcels ranging in size from .3 to .6 acres that are developed with single family dwellings.
ANALYSIS: Pacific Gas and Electric (PG&E), Pacific Bell, and Chambers Cable commented on
this project and do not object to the abandonment of the utility easement. Abandoning the easement
will not result in any impacts to these utility providers.
According to California Government Code Section 65402, the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted or proposed element of the General Plan.

ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:

Attached is a copy of a petition for abandonment of the Public Service Easement, along with a
plat delineating the subject area, for your staffs review and further action. The abandonment
processing fee of$262.00 has been paid.
Please have the proposed abandonment submitted to the Planning Commission at the earliest
opportunity to be consideration in regard to the findings that the project is categorically exempt
from environmental review and is in conformance with the Butte County General Plan.
Following Planning Commission action, our Department will further.process the abandonment

STAFF COMMENT
State law requires that the Planning Commission find that an abandonment such as proposed
will not be in conflict with a General Plan. Staff has analyzed this request and recommends
approval.
PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public utility easement proposed
for abandonment is approximately 8 feet by 220 feet (1,764 sq. ft.) in size. This easement, which
was created in 1956 as part of the Country Estates Subdivision(Map of Records Book 22,Pages 22-
23), has never been utilized for any public utility purposes. The easement is surrounded by three
parcels ranging in size from .3 to .6 acres that are developed with single family dwellings.
ANALYSIS: Pacific Gas and Electric (PG&E), Pacific Bell, and Chambers Cable commented on
this project and do not object to the abandonment of the utility easement. Abandoning the easement
will not result in any impacts to these utility providers.
According to California Government Code Section 65402, the abandonment of property must be in
conformance with the General Plan. This request is consistent with the Butte County General Plan
because it does not conflict with any adopted or proposed element of the General Plan.

ACTIONS FOR CONSIDERATION
Staff recommends that the Planning Commission take the following actions:
I. Determine this project to be Categorically Exempt under the California Environmental
Quality Act Section 15305.
II. Recommend approval to the Board of Supervisors the Abandonment for Scott Ritchie of the
public utilities easement as shown on Attachment C, subject to the following findings:
A. The proposed abandonment is in conformance with the Butte County General Plan.
B. The public utilities easement is not required by any public utility provider in the
County.
