for Fiscal Year 1999-2000.
Commissioner Lambert asked about pulling the Road and Bridge Construction list off of the consent agenda.
She said she would like to add an item. She said she has requested an item be added for the last two years and
this has not been done.
Chairman Leland said this item is for a consistency finding with the General Plan. He suggested Commissioner
Lambert send a memo to Public Works noting her request.
It was moved by Commissioner Lambert, seconded by Commissioner Cage, and unanimously carried to
approve the Consent Items.

At the regular meeting of the Butte County Planning Commission held May 27, 1999, the
Commission:
I. Determined that this disposal of surplus government land is categorically exempt
under Section 15312 of the CEQA.Guidelines.
II. Determined that this disposal of surplus property, a strip of land approximately 100
feet wide and 2,000 feet in length located between Ophir Road and Kusel Road
south of the City of Oroville, is in conformance with the General Plan and State Law.

Subject: General Plan Consistency Finding for Disposal of Surplus County Property
Date: May 27, 1999
STAFF CONIMENT:
The Butte County General Services Administration requests the Planning Commission determine
that the disposal of county surplus property located between Ophir Road and Kusel Road, south of
the City of Oroville will be in conformance with the General Plan. Government Code Section 65402
requires that before public lands are sold a determination of consistency be made by the Planning
Commission. The finding needs to also consider alternative public uses.
Project Description:
The property to be sold is a strip of land approximately 100 feet by 2,000 feet in size and was
originally acquired for right-of-way purposes. This property is a part of a historic railroad right-of-
way that has been abandoned by the railroad. The County acquired the abandoned right-of-way with
the intention of using the right-of-way as a county road. The property was never used as a road and
the Department of Public Works has determined that the property is no longer needed for a county
right-of-way.
Environmental:
The sale of surplus land falls under a Class 12 categorical exemption under Section 15312 of CEQA
Guidelines.
Analysis:
The right-of-way property is presently zoned Heavy Industrial (M-2) and is designated Industrial on
the General Plan. The property is not a part of a corridor planned for a county road in the General
Plan Circulation Element. Sale of this property by the County creates no inconsistencies with the
Butte County General Plan.
An alternative public use of the property includes the land becoming a part of a trails system. This
property was once owned by the Southern Pacific Railroad. The historic railroad right-of-way
extends north and south of the project. The railroad right-of-way to the south is owned by the

County and contains a county road. The right-of-way to the north is owned by the City of Oroville.
The City of Oroville indicates that the right-of-way is not presently planned for a trail use. The city
also indicates that the old railroad right-of-way through the city is no longer continuous and there
may be some difficulty in establishing a trail on the right-way in the future.
Even if at some time in the future the City of Oroville decided to establish a recreational trial on the
historic railroad right-of-way the property to be abandoned would not be suitable for a trial because:
1) The lands on both sides of this right-of-way to be abandoned are zoned and used for
industrial land uses and as such are not be compatible with a recreational trail.
2) The historic railroad right-of-way lands south of Ophir Road are not suitable for continuing
a trail do to part of this right-of-way now being a county road.
ACTIONS FOR CONSIDERATION:
Staff recommends the Planning Commission take the following actions:
I. Determine that this disposal of surplus government land is categorically exempt under
Section 15312 of the CEQA Guidelines.
II. Determine that this disposal of surplus property, a strip of land approximately 100 feet wide
and 2,000 feet in length located between Ophir Road and Kusel Road south of the City of
Oroville, is in conformance with the General Plan and State Law, with the following
findings:
A. The Department of Public Works has determined that this property is no longer
needed for right-of-way purposes,
B. The property is not shown as a corridor for an existing or planned road in the General
Plan Circulation Element,
C. An alternative public use of the property as a recreational trail is not feasible due to
there being no proposed or planned trail which would require this property,the land
uses and land use designation of the property and surrounding properties are
industrial and are not compatible with a recreational trail, and an extension of a
recreational trail to the south is not possible because the historic railroad right-of-way
has been improved with a county road and is no longer available for the development
of a recreational trail.

pan thereof is applicable thereto,until the location.purpose and extent of such acquisition,disposition,or
such public building or structure have been submitted to and reported upon by the planning agency having
jurisdiction,as to conformity with said adopted general plan or pan thereof.Failure of the planning agency
to report within forty(40)days after the matter has been submitted to it shall be conclusively deemed a futdiag
that the proposed acquisition,disposition,or public building or structure is in conformity with said adopted
general plan or part thereof.The provisions of this paragraph(b)shall notapply to acquisition or abandonment

The County of Butte presently owns a strip of land approximately 100 feet wide and 2,000 feet length
located between Ophir Road and Kusel Road south of Oroville. The property was originally
acquired many years ago for road right of way purposes. No Assessor's parcel number has been
assigned to the property. A map is attached which identifies the property in"yellow".
The Butte County Public Works Department has recently determined that there are no further plans
for use of the property for road right of way purposes. Accordingly, it is our desire to have the
property declared surplus to the needs of the County and to sell it to the highest bidder in accordance
with the provisions of the California Government Code.
Government Code Section 65402 contains a provision that before lands can be sold or acquired by
the County,the Planning Commission first has to make a determination that such sale or purchase is
in conformity with the General Plan. We would appreciate your efforts in presenting this matter to
the Planning Commission at your earliest convenience for such a determination so that we may
proceed with the sale of the property.

The property to^sold is a strip of land approximately 100 feet by 2,000 feet in size and was originally
acquired for right-of-way purposes. The property was never used as a right-of-way and the
Department of Public Works has determined that the property is no longer needed for a county right-
of-way.
Environmental:
The sale of surplus land falls under a Class 12 categorical exemption under Section 15312 of CEQA 4
Guidelines.
Analysis:
The property is presently zoned Heavy Industrial (M-2) and is designated ustrial on the General
Plan. The property is not a part of a corridor planned for a county r own on the General Plan
Circulation Element. Sale of this property by the county to anoth e i reates no inconsistencies
with the Butte County General Plan.
ACTIONS FOR CONSIDERATION:
Staff recommends the Planning Commission take the following actions:
I. Determine that this disposal of surplus government land is categorically exempt under
Section 15312 of the CEQA Guidelines.
II. Determine that this disposal of surplus property,a strip of land approximately 100 feet wide
and 2,000 feet in length located between Ophir Road and Kusel Road south of the City of
Oroville, is in conformance with the General Plan, with the following findings:
A. The Department of Public Works has determined that this property is no longer
needed for right-of-way purposes; and
