The conditions are: 1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for recording this Certificate is $10.00 without conditions. $13.00 with conditions. This cost estimate is based on 1 page notification (first sheet), 1 page of legal description attached as Exhibit "A", and 1 page of conditions attached as Exhibit`B". 2. Place the following informational note on the Certificate of Compliance: "All new structures must meet the Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291, including adequate turnouts which may incorporate existing wide spots in the road and driveway approaches to the satisfaction of CDF." 3. Prove that adequate quantities of domestic water for a single family residence are available to the parcel. 4. Prove that adequate sewage disposal area for a single family residence exists on the parcel. 5. Provide two-way traversable access to the parcel from a publicly maintained road or state highway as defined in the County Code. 6. The property is located on the south side of Crystal Ranch Road, approximately 1,500 feet west of Cochise Drive, Oroville. APN 071-270-038 (LP) (DET 00-07) (Continued open from February 24, 2000) Mr. Wilson gave a brief summary of the project. He said the hearing was continued due to issues over access to the parcel. Chairman Edell said that Mr. Crawford, an inspector from his department,did go out and look at the road, and the road does have a lot of ruts that need to be fixed. He said they have a concern over areas that are over 15% grade and how to handle the problem. He said that under the County Code and Public Resources Code 4290 (PRC 4290) the areas should paved. He said the problem is ' whether to have this one lot pave those areas for the other 70 parcels that are out there. Mr. Crawford said the road conditions are terrible. He said he almost did not make it up off of Cochise turning onto Crystal Ranch Road,because of the grade and the ruts in the road. He said if the road had been wet he probably would not have made it up there. He said the standards say two- way traversable, and PRC 4290 also requires two-way traversable at least 20 foot wide roadway. He said any grade over 16%has to be paved. He said the problem exists almost all the way back to Craig Access Road. He said there-are two or three sections on Cochise that are extremely steep. Mr. Parilo asked what are the limits of the Committee's discretion on this type of project? He said the parcel was created as a remainder parcel. Chairman Edell said the parcel was created as a remainder for sale. He said the Committee can apply conditions under the Map Act that were applicable at the time the parcel was created or at the time the current owner acquired title to the property. He said they should be reasonable on what they do require. Mr. Parilo asked if the Committee can deny this application? Chairman Edell said under the Map Act, the Committee has to approve the request, but can place conditions on that approval. Mr. Crawford said there are 4 sections between Craig Access Road and this property that have well over 15% grade, and two of the sections are on very sharp turns. He said the Code states that any road over 16% grade will be paved. He said the ruts are bad and if you do not drive in the right spot on this road, you can high center a vehicle. Mr. Parilo asked about putting a note on the Certificate warning buyers of the condition of the road? Chairman Edell said the Certificate is going to go with the land. He said the road could improve or get worse over time. ■BC DEVELOPMENT REVIEW COMMITTEE MINUTES ■ MARCH 23, 2000 ■ e Mr. Crawford discussed the problems with just filling the ruts with soft dirt. He said there are a couple of residents beyond this parcel. He said there is a problem with the interchange between Crystal Ranch Road and Cochise, it does not make a left hand turn. He said Cochise goes straight and you have to make a left turn entrance onto Crystal Ranch Road. He said you need to make a sharp 90° turn at this point and this is where if you stopped, you would slide backwards into a ditch. He said he would not want to put a medic unit on this part of the road. Chairman Edell said the Committee has approved a Certificate of Compliance for approximately 10% of the lots in this area. Mr. Parilo asked the history of the subdivisions in this area? How were the lots originally created? Chairman Edell said they were created by deeds without benefit of County review or approval or access to a publicly maintained road. He said that the majority of these conditions were imposed on previous Certificates by the Board of Supervisors. Ms. Lambert was present at this time. Mr. Crawford said there are two very bad sections, one at the intersection of Cochise and Crystal Ranch Road and also just prior to that, about 200 yards, there is another 90° turn going up an embankment. He said the other steep grades are on straightaways. He said the area is mostly brush and Manzanita. Chairman Edell said the Code defines two-way traversable as "being traversable by a standard two- wheel drive sedan." Mr. Crawford asked if the deciding factor was access and getting Department of Water Resources's (DWR) approval for them to use the road? Chairman Edell said it will be based on DWR's reluctance to grant any permission to use Craig Access Road. He said this could be a major problem. Mr. Parilo asked how prior Certificates overcame the issue of using Craig Access Road with DWR? Chairman Edell said in the 80s it was easy to get a letter from DVA'R. He said now, DWR has been denying access on Craig Access Road. Mr. Parilo said how can the Committee approve the Certificate with conditions that can not be met. He said this would constitute a denial. Chairman Edell said the person making the decision at DWR could retire, and the applicant can appeal this condition to the Board. Mr. Parilo asked can a condition be attached that precludes use of the property. He said if DWR is unwilling to provide.access, under the Map Act, could the condition be waived? ■ BC DEVELOPMENT REVIEW COMMITTEE MINUTES ■ MARCH 23,2000 ■ :� ___ CI Chairman Edell said the condition was imposed by the Board of Supervisors. He did not want to waive a condition that was established by the Board. The hearing was opened to the public. Kathy Lovejoy said the only trouble with the roads is after a rain. She said John Bunch takes his equipment over this road. She said the roads are traversable. Chairman Edell told her she would need a letter from the State to get access from Craig Access Road. Ms. Freeman said she sent another letter to the Department of Water Resources (DWR) a couple of months ago and has not gotten an answer. She said there are several places in the area that do have completed Certificates of Compliance on the same road. She said she purchased the property 2 or 3 months ago. She said it does have one bad steep turn. The hearing was closed. Mr. Crawford asked if they do not receive a letter from DWR, can they build? Chairman Edell said they need the letter to receive building permits. Mr. Crawford said he could live with the two bad places being paved and taken care of so they can get emergency vehicles in there as a minimum. He said the parcels were not created legally, and it is a problem the County has allowed to happen. He said the intersection of Cochise and Crystal Ranch Road has to be taken care of and one of the 90° angle curves to the left would have to be taken care of. Chairman Edell said a curve to the south of this intersection that is over 16% also has to be paved. Mr. Crawford said that is correct. Chairman Edell said it would be a recommended condition to pave the curve at the intersection of Cochise and Crystal Ranch Road and the curve to the south of that intersection that is over 16% grade in accordance with County PRC 4290 standards as a minimum. Mr. Parilo said he would also like to see a note on the Certificate that basically would state that the roads leading to this particular parcel are single lane, and may be impassible during certain times of the year, and may be difficult for emergency vehicles providing service in case of a problem. Mr. Crawford said that type of statement should have been on the original subdivision,but its a little late for that. He said it should be presented to all prospective buyers. Ms. Lambert asked if the Committee was required to approve this request? She asked why would they approve a bad situation. ■ BC DEVELOPMENT REVIEW COMMITTEE MINUTES ■ MARCH 23, 2000 ■ Chairman Edell said there are a lot of parcels that were created without benefit of County review, or approval, or. access to a publicly maintained road. He said the parcels exist, they are under separate ownership and under the Government Code if someone makes an application for a Certificate of Compliance, we have to issue the Certificate, but we can apply conditions. Ms. Lambert asked if the Certificate could be conditioned to have a road maintenance agreement or to pay a pro-rata share towards maintaining the road? Chairman Edell said a road maintenance agreement is based on Civil Codes and maintenance is up to the homeowners. Mr. Parilo said the turnouts need to be specific. Mr. Crawford said there are places to pass another car. He discussed the standards of the PRC 4290 regarding turnouts. He said turnouts would be a major undertaking. He said that two cars can pass in some areas of the road. Mr. Parilo said he would like to add language to Condition 2 to state to include adequate turnouts which may incorporate existing wide spots in the road and driveway approaches to the satisfaction of CDF. He said he would move that Condition 2 be modified in that fashion. It was seconded by Ms. Cage. It was moved by Mr. Parilo, seconded by Ms. Cage, and unanimously carried to approve the Legal Lot Determination for John Freeman, DET 00-07, subject to the findings and conditions as stated and as modified; amend Condition 2 to add "Including adequate turnouts which may incorporate existing wide spots in the road and driveway approaches to the satisfaction of CDF." Findings: A. The project is exempt from environmental review under the General Rule exemption 15061(b)(3). B. The parcel sizes of 5 acres was in conformance with the Butte County General Plan and Zoning Code at the time of creation. Conditions: 1. The property is located on the south side of Crystal Ranch Road, approximately 1,500 feet west of Cochise Drive, Oroville. (LP) (DET 00-07) Mr. Wilson gave a brief summary of the project. Mr. Parilo asked on Condition 5, what standard would apply to a two-way traversable access? Chairman Edell said the standard is defined in the Butte County Code and it is sufficient width to allow a two-wheel drive vehicle to go in and out without going off the road. He said no width is specified, but it has to be at least as wide as the vehicle. Mr. Parilo asked how this would meet fire access standards? Chairman Edell said it would not meet those standards. He said fire standard minimums are 20 feet wide. Mr. Parilo asked if this condition would apply to Crystal Ranch Road? Chairman Edell said yes, if that is the road used for access. He said this is a private road. He said this standard would be from the property out to Lumpkin Road. He said most of Craig Access Road does meet this standard. Mr. Crawford said Craig Recreation Road is hard pan and does meet fire accessability, but he did not know about Cochise or Crystal Ranch Roads. Mr. Erickson said one of his inspectors was stuck on the road trying to get to this parcel. Mr. Crawford said if the applicant wants to build a house on this property, he has to improve the road all the way to Craig Access Road. Chairman Edell said at the time the parcels were created,traversable access was all that was required to be able to get in and out on a 60 foot non-exclusive easement to a publicly maintained road. He said zoning is not a problem. He said the 60 foot access to a publicly maintained road is a major problem and that is the primary reason for this request. He said the Development Review Committee normally requires conditions that applied at the time the parcel was created. They can also apply any conditions that would have applied at the time the current owner received title to the property. He said if they add a condition for a 20 foot wide road out to Lumpkin Road for one five acre parcel, there would probably be an appeal. He said he would recommend continuing this hearing to allow the applicant to be present. He said the applicant has to demonstrate that they have the right to use the easement. Mr. Erickson said he was concerned with the fire vehicles. ■ BC DEVELOPMENT REVIEW COMMITTEE MINUTES FEBRUARY 24,2000 ■ Mr. Crawford said primary Public Resource Code(PRC)4290 says that when you build a house you have to have a driveway that is accessible to a 40,000 pound road limit. He said if the fire department can not reach the home, the driveway will not do any good. Chairman Edell discussed the problems with the roads in this area. He said he explains the problems to people when the applications come in. He said if they are going to require a 20 foot road he would recommend a continuance for the applicant to be here. Mr. Parilo asked about having a two-way simultaneous traversal road. Mr. Crawford said according to PRC 4290 the applicant would have to have a turnout every 400 feet if the road is only 10-15 feet wide. There was a brief discussion on the fire risk if the fire department can not get to the property. Chairman Edell said this request can not be denied. He said the County can impose conditions. Mr. Parilo said there are two choices: 1) To meet PRC 4290 requirements to a public road; or 2) Statement or note on the Certificate of Compliance that in times of a wildland fire or a fire at their house, there may be certain times of the year that the road is not traversable for fire fighting and other emergency vehicles. Chairman Edell said someone needs to go look at the road first. Mr. Crawford said he would•go out and look at the road. Mr. Price was absent at this time. Chairman Edell said someone from Public Works would go with him. He said he would recommend this item be continued. Mr. Crawford and Chairman Edell said they would be out of town on March 9.
