The project is located on Nicalog Road and Cohasset Road,north of Chico. APN 047-230-052 (LP) (DET 00-06) Mr. Wilson gave a brief summary of the project. The hearing was opened to the public. Steve Lotti said he agrees with the conditions. He said on Item 4,Appendix VII,he would like some clarification. Mr. Erickson said this was an application for a Legal Lot Determination on two parcels. He said one of the parcels was created legally back in the 1800s. He questioned being able to place conditions on the parcel that was legally created. Chairman. Parilo said that these were notes that would go on the Certificate of Compliance at such time when an applicant came forward to develop a home and a septic system. Mr. Erickson said he would feel more comfortable not having any conditions placed on the legal lot, but have a note saying that granting of the Certificate does not mean that the property is developable and to consult the County departments for more information. He said he has no problems with the two conditions on the 40 acre parcel. Mr. Lotti said he had the same question on conditions on the legal parcel. He said on Appendix VII there is a soils matrices and asked about,the back page. Mr. Erickson said the sewage disposal would be to provide usable sewage disposal area for a single family dwelling. He said he has no problems with the 40 acre parcel. Chairman Parilo said that all the conditions would apply to the 40 acre parcel as stated and Conditions 1 &2 would apply to the 160 parcel and there would be an additional statement on the ' 160 acre parcels that at the time of development they would have to conform with the County's sewage disposal and water supply requirement. Striking the Appendix VII paragraph. The hearing was closed. It was moved by Mr. Erickson, seconded by Ms. Cage, and unanimously carried to approve the 40 acre parcel for Steve and Carol Lotti as referenced in the Planning report, with Condition 1 & 2 as� stated, Condition 3 would be change to provide evidence that domestic water is available to serve a single family dwelling. Condition 4 would be changed to provide that there is evidence that there is usable sewage disposal area to serve a single family dwelling subject to the findings below. Findings: A. The parcel size of 40 acres is in conformance with the Butte County General Plan and Zoning Code. Conditions: 1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for recording this Certificate is $13.00 without conditions. $16.00 with conditions. This cost estimate is based on page notification(first sheet), 2 page(s) of legal description attached as Exhibit "A", and 1 page of conditions attached as Exhibit `B". 2. Place the following informational note on the Certificate of Compliance: "All new structures must meet the Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291." 3. Provide evidence that domestic water is available to serve a single family dwelling. 4. Provide that there is evidence that there is usable sewage disposal area to serve a single family dwelling. Mr. Erickson said he was not comfortable putting conditions on a parcel that is deemed legal. Mr. Wilson said Condition 1 & 2 would apply anyway. It was moved by Mr. Erickson, seconded by Ms. Cage, and unanimously carried on the 160 acre parcel to approve for Steve and Carol Lotti,with Conditions#1 and Condition#2 being a note, and a 3rd note would say"Compliance with sewage disposal and potable water requirements is necessary prior to development." subject to the following finding. LOTTI, hereinafter referred to as "Declarants", and provides as follows: 1. SUBJECT REAL PROPERTY: The real property which is the subject of this Agreement is that certain property more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference. 2. COVENANTS THAT RUN WITH THE LAND: Declarants hereby declare and say that they are the owners of that certain real property known as LOTTI PROPERTY, described in Exhibit "A" attached hereto. All of the property described herein shall be held, sold, and conveyed subject to the following easements, restrictions, covenants and conditions, which are for the purpose of protecting the value and desirability of such real property,and which shall run with the real property and be appurtenant to the real property, and shall be binding on all parties having any right, title or interest in such property, or any part -1- 1 finish grade elevation. The decisions of the Committee shall be in writing. In he event that the Committee fails to approve or disapprove an application within thirty (30) days after plans and specifications have been submitted to it, approval by the Committee shall not be required, and this Declaration shall be deemed to have been complied with. 19. STORAGE OF VEHICLES: No motor vehicles or mechanical equipment shall be stored or parked within the project, except under the following terms and conditions: A. No abandoned or "junk" vehicles shall be stored or parked within the project except within an enclosed barn or garage. B. All tractors, motor vehicles, or equipment shall only be parked under a garage or carport or other structure having a roof. 20. ROAD WAY MAINTENANCE AGREEMENT: The property described herein shows the Roadway Facilities as sixty (60) feet wide, private access easements which shall be used for ingress and egress and for public utilities purposes within the project. In this regard: A. Said access easements shall be used exclusively for the beneficial use and enjoyment of the real property located within the project. The description contained in Exhibit`B" constitutes an"offer of dedication" to Butte County for said roadway facilities, and said offer of dedication to said County of Butte remains effective. However,such access easements shall not,in any manner,be construed as an implied dedication, or offer of dedication, to the "public at large", or to any adjoining properties, except as to Parcel-No.47=23:m52-. B. As described above,no adjoining lands outside of the project shall have the right to use or enjoy the roadway and access easements described as Nicalog Road so long as said additional properties provide their pro-rata share of the repair and maintenance of said roadways. C. As a condition for allowing the recordation of the project, the Butte County Public Works Department has required that Nicalog Road must be improved to certain Butte County"rural"roadway standards. Declarants represent that they have installed said roadways in the manner required by Butte County Public Works. The owners of the parcels within Parcel Nos. 47-23-129 an-d74-7--13---52 shall repair and maintain said roadway facilities (as well as the culverts, gutters, street signs, and other improvements associated with said roadways), in a manner which is consistent with said standards required by Butte County, and which provide reasonably safe, comfortable access for passenger vehicles, and which avoid unreasonable preserves and protects said Roadway Facilities. However, the term "reasonable repair and maintenance" shall not include the enlargement of the roadway and shall not include the improvement of the roadway beyond the currently existing standard, described above. Further, this Declaration shall not be construed to require any owner to contribute to the cost of any enlargement or improvement of said Roadway Facilities. For so long as the above mentioned works shall exist in private ownership, the parties hereto, their successors and assigns, shall bear the expenses of maintaining them in good repair. It is agreed that the cost of maintaining said works shall be paid by the parties hereto,their successors and assigns,in proportion to the number of land parcels owned by each owner and/or their successors and assigns, and each owner will, upon written demand, contribute and pay his/her proportionate share of any monies paid out by any of the several owners or of any obligation incurred for the reasonable maintenance or repair of said works. Any owner may bring an action in any court of competent jurisdiction in the County of Butte on behalf of all owners to'enforce collection of any monies due from any owner gas their proportionate share of the cost of the reasonable maintenance or repair of said works, and in any such action or actions, the prevailing parties shall be entitled to recover a reasonable attorney's fee to be fixed by the court in such actions. D. In the event that any person (as well as the guests, invitees, contractors, or subcontractors, etc. of that person) unreasonably uses or abuses said Roadway Facilities in any manner which causes unreasonable amounts of wear and tear, or harm or deterioration of said Roadway Facilities, then the owner(s) of said parcels who cause such unreasonable use shall forthwith repair such damages or deterioration, at their expense. For example, sometimes heavy construction vehicles (such as concrete trucks or lumber trucks) or off-road vehicles, or persons installing -9- ` derground utilities, can cause unreasonable amounts of deterioration to the Roadway Facilities; the persons responsible for such'misuse or damage shall forthwith repair such damage, at their expense. Any owner may bring an action in any court of competent jurisdiction in the County of Butte on behalf of all owners to collect the cost of repairing any such damage, and in any such action or actions, the prevailing parties shall be entitled to recover a reasonable attorney's fee to be fixed by the Court in such actions. E. For the purposes of this Agreement,the decision of the owners of a majority of the parcels to the effect that specified repair or maintenance work is necessary shall be conclusive on the remaining owners, and the decision of said majority as to the reasonableness o the cost of any sch repair or maintenance work shall be conclusive on the remaining owners,provided that said cost does not exceed the average of three (3) independent. cost estimates secured not more than sixty (60) days prior to commencement of the work. F. The owners of a majority of the parcels may authorize the creation of a maintenance and repair account in a savings and loan association or bank.
