Henry T. Runge (Item determined to be a General Rule Exemption from environmental
review),Legal Lot Determination on property zoned A-R(Agricultural Residential. The
property is located on the west side of 7th Street,approximately 456 feet south of River Bluff
Drive, Thermalito. (SH) (File#DET 01-01)
Mr. Wilson gave a brief summary of the project.
The hearing was opened to the public.
Mr. Crawford said they need to revise Condition 2, because this is not in State Responsibility Area
(SRA) and does have to meet the requirements of Public Resource-Code 4290.
Ms. Cage asked if Integrity Court had been built?
Mr. Runge said the road is there.
The hearing was closed.
It was moved by Mr. Parilo, seconded by Ms. Cage, and unanimously carried to approve the Legal
Lot Determination for Henry T. Runge,Jr. (DET 01-01)subject to the findings and conditions listed
below, changing Condition 2 by deleting"4290 and" from the condition.
Findings.
A. The project is exempt from environmental review under the General Rule exemption Section
15061(b)(3).
B. The parcel size of 6.35 acres was in conformance with the Butte County Zoning Code and
the General Plan at the time of creation.
Conditions:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The
current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated
current cost for recording this,.Certificate is $10.00 without conditions, $13.00 with
conditions. This cost estimate is based on 1 page notification (first sheet), 1 page of legal
description attached as Exhibit "A", and 1 page of conditions attached as Exhibit`B".
2. Place the following informational -note on the Certificate of Compliance: "All new
structures must meet the Fire Safe Regulations of the Butte County Code and Public
Resources Code 4291."
3. Provide "will serve" letters from Thermalito Irrigation District verifying the property is
within their district and that they are willing and able to provide sewer&water service.

SUBJECT: HENRY T. RUNGE,JR.,AND TPM 98-13
The tentative Parcel Map to divide a 6.7-acre parcel into four parcels of 1.1+ acres each and one remainder
parcel of 2.2+ has sewer mains on the North side.(Feather Ave.)and the East Side ( h Street). All the parcels
can be gravity sewered with proper placement of new sewer mains and laterals. All parcels will,be required to
hook to T.I.D.sewer collector system.
The parcel map is surrounded on three sides by water mains and all parcels can be serviced easily. A fire
hydrant maybe required by the County Fire Department in the cu-de-sac road. If this is required, an eight.-
inch main will be tied between Middlehoff Lane and Th Street through the cul-de-sac. This will insure
adequate fire flows for the project. Any pipelines installed on private property will have easements deeded to
T.I.D.before T.I.D. will accept the mains into the system.
All water and sewer main line extensions will be deeded to T.I.D.as condition of acceptance.

.At the regular meeting of the Butte County Development Review Committee held on August 24,
2000, the Committee granted a Conditional Certificate of Compliance for the above-referenced
property. The conditions are:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The
current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated
current cost for recording this Certificate is $10.00 without conditions, $13.00 with
conditions. This cost estimate is based on 1 page notification(first sheet), 1 page of legal
description attached as Exhibit"A", and 1 page of conditions attached as Exhibit"B".

STAFF COMMENTS:
This report is for a Legal Lot Determination for a Certificate of Compliance. Staff recommends
approval of this request.
ANALYSIS:
This 2.2 acre parcel was created by Map 148 at pages 10& 11 recorded in the Office of the Recorder
of Butte County on August 20, 1997,Document 97-031181. At the time the parcel was created the
parcel was identified as a remainder of a four parcel land division which was approved and met the
zoning and environmental health criteria.
At the time the parcel was created the zoning was A-R(Agricultural-Residential)which had a parcel
size of 6.35 acres. The size of the parcel is consistent with the Zoning and the General Plan. There
is an existing single family residence on the parcel.
The Public Works Department and Butte County Fire Department have recommended standard
conditions be included in the Certificate of Compliance. The requirements of the Environmental
Health Department are for"will serve" letters from Thermalito Irrigation District for water supply
and septic system.
CEQA ISSUES:
This project has been determined to be exempt from the California Environmental Quality Act
(CEQA) provisions under the General Rule exemption Section 15061(b)(3).

RECOMMENDATION:
Staff recommends that the Development Review Committee approve the Legal Lot Determination
for Henry T. Runge, Jr. (DET 01-01), subj ect to the following findings and conditions.
Findings.
A. The project is exempt from environmental review under the General Rule exemption Section
15061(b)(3).
B. The parcel size of 6.35 acres was in conformance with the Butte County Zoning Code and the
General Plan at the time of creation.
Conditions:
1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The
current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated
current cost for recording this Certificate is $10.00 without conditions, $13.00 with
conditions. This cost estimate is based on 1 page notification (first sheet), 1 page of legal
description attached as Exhibit "A", and 1 page of conditions attached as Exhibit`B".
2. Place the following informational note on the Certificate of Compliance: "All new
structures must meet the Fire Safe Regulations of the Butte County Code and Public

LEGAL LOT DETERMINATION
APPLICATION PACKET CHECKLIST
The following items are required to be submitted at the time of application:
Applicant Planner
1. Q ❑ A completed, signed,Uniform Application. If the application is signed by an agent for the
property owner, an agent authorization form must be submitted along with the Uniform
Application. The application shall not be accepted unless signed by the owner or authorized
agent.
2. ❑ Payment of the currently required Application Fee.
3. ❑ ❑ An Application for a Legal Lot Determination must be accompanied by verification of
ownership and/or evidence of how the parcel in question was created. This evidence may
be obtained from a title company, engineer, or land surveyor, et al.
4. ❑ A plot plan or map giving approximate locations of existing improvements on the property.
5. ❑ ❑ Supplemental application information required. 1:1 YES PTNO

Additional information may be required in order to clarify, amplify, correct or otherwise supplement the above
submittal information or to complete any required environmental review documents, as deemed necessary by
the Department of Development Services, Public Works, Environmental Health Division, Butte County Fire
Department, or Agriculture Commissioner.
