The project is located on the northerly side of Crouch Avenue,between Stevens Avenue and Lone Pine Avenue, southwest of Chico. (LP) (DET 00-01) Mr. Wilson submitted a memo. He said that this land is under a Williamson Act contract with.a minimum of 10 acre parcel size. Chairman Edell said the Land Conservation Act (LCA) Contracts are to lessen taxes and preserve agriculture. He said when the applicant enters into a contract they stipulate that they will not sell or convey lots in a size less than a specified acreage. Mr. Parilo said he was concerned with the Contract language, and this item was continued to check that language to make sure there are no future problems by approving this request. It was moved by Mr. Price, seconded by Mr. Parilo, and unanimously carried to approve the Legal Lot Determination for Bertagna Revocable Living Trust DET 00-01) subject to the following findings and conditions: Findings. A. The project is exempt from environmental review under the General Rule exemption Section 15061(b)(3). B. The parcel size of 20 acres is in conformance with the Butte County General Plan and the Zoning Code. I Conditions: 1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for recording this Certificate is $10.00 without conditions, $13.00 with conditions. This cost estimate is based on 1 page notification (first sheet), 1 page of legal description attached as Exhibit"A", and 1 page of conditions attached as Exhibit`B". 2. Provide an Engineers analysis that there is sufficient useable area for leachfields on the property that is outside of the 100 year flood zone. The project is located on the northerly side of Crouch Avenue, between Stevens Avenue and Lone Pine Avenue, southwest of Chico. APN 039- 190-007 (LP) (DET 00-01) Mr. Wilson gave a brief summary of the project. Chairman Edell said it was his understanding that this.request had been withdrawn on August 9, 1999. Mr. Wilson said there is a later letter in the file rescinding that withdrawal. The hearing was opened to the public. Myles Pustejovsky, NorthStar, said the applicant had no problems with the conditions. Chairman Edell asked if there was a Land Conservation Act Contract on this property. Mr. Pustejovsky said if there is a LCA contract he does not know what the contract minimum is. He said this application was for a little over 20 acres. He said this was for a re-organization of the family. Mr. Price said he wanted to make sure that by approving this Certificate they are not making a problem for the applicant if this is under a LCA contract. He said he would like to continue this hearing. Mr. Parilo asked if this property is under the LCA, is there was a way to put a note on this to alert buyers to the fact that there is a contract. Mr. Pustejovsky said the title company will handle that. Chairman Edell said by approval of a Certificate of Compliance saying this is a legal lot does not violate the LCA contract. Mr. Price said he would like a continuance to check this out.
