Feeney, Legal Lot Determination on property zoned A-R (Agricultural Residential) located on Will T. Road, north of Grand Paririe Road, east of SR 99, in north Chico area. APN 047-100-057 (SH) (DET 01-04) Mr. Hackney gave a brief summary of the project. Chairman Edell asked whether Parcels 55, 56, 57, and 58, were under the same ownership. He explained that when an application was made for one out of four parcel to the west of the subject area, the Committee required the applicant to merge the properties into one parcel. He asked if staff had looked into applying the mentioned approach to the contiguous these four parcels in the subject area. Mr. Reid asked about the Assessor `s Parcel Page indicating that there were Notice of Violations (NOVs) on these parcels. Chairman Edell said NOVs have been issued to most of these parcels. He asked if this issue has been explored at all. Mr. Hackney answered that the only investigation made was through his discussions with the Land Development Division of Public Works. The hearing was opened to the public. Bob Feeney,Engineer, stated that this application transpired because of the possibility of an escrow and mentioned his attempt to settle the Notice of Violation before proceeding with the escrow. He said the pending escrow was for Parcel 57 only. Mr. Reid was concerned that under the Subdivision Ordinance, the County could require conditions that were in effect at the time the current purchaser purchased the property and Public Health has not pursued that to the full extent of the Ordinance. He suggested adding a condition to state "The applicant shall verify sewage disposal before the final certificate is issued." He told the Committee that the sewage disposal area on Parcel 57 is adequate, but if Parcels 55, 56, and 58 or any of them can not be developed because of a lack of soil, there could be a problem with future development. He suggested adding a,condition to have the applicant combine with Parcel 57 any of the other parcels that do not contain a site suitable for development. It was decided to change Condition 3 to read"Prove that adequate sewage disposal area for a single family residence exists on Parcels 55, 56, 57, and 58, and combine with Parcel 57 any parcels that are shown to be unsuitable." The hearing was closed. It was moved by Mr. Reid, seconded by Mr. Meleka, and unanimously carried to approve the Legal Lot Determination for James Conwill subject to the findings and conditions listed below revising Condition 3 to read "Prove that adequate sewage disposal area for a single family residence exists on Parcels 55, 56, 57, and 58, and combine with Parcel 57 any parcels that are shown to be unsuitable." ~�~ BC DEVELOPMENT REVIEW COMMITTEE MINUTES ■ AUGUST 9,2001 ■PAGE 2■ I.
