No minimum lot size given. • Ordinance 1687 adopted March 2, 1976,zoned AR-MH(Agricultural-Residential Mobile Home). • Ordinance 2393 adopted February 28, 1984, zoned the property AR (Agricultural Residential) the current zoning. • The General Plan history is as follows: • The 1966 General Land Use Plan Map designates the area Residential. • The 1971 General Land Use Plan Map designates the area Medium Low Density(5 to 8 Units per acre gross). • The October 29,-1979 General Land Use Plan Map designated the area Low Density Residential (6,500 square feet to 1-acre parcels). • Determination of consistency with Zoning and General Plan is based on a comparison between the date in which parcels are established, and the General Plan and zoning regulations existing on that date. The following is provided: • The General Plan designation from 1979 to date has been LDR (Low Density Residential), 6,500 square feet to 1-acre parcel size. • The size of"lot" 19 (0.62 acres) is consistent with the AR zone minimum parcel size of 6,500 square feet, and equivalent to the R-1 zone listed as a permitted zone in the LDR Land Use Element of the General Plan. • Access to the property is provided by Grand Avenue,which is maintained as a public road by the County. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following action: I. Approve the Legal Lot Determination and Certificate of Compliance for Robert Robichaud on APN 031-251-030, File No. DET 05-04, subject to the following findings: A. This project is exempt from environmental review under the General Rule exemption Section 15061(b)(3). This section states that CEQA applies only to projects which have the potential for causing a significant effect on the enviromnent. Because the project is exempt from the provisions of CEQA,the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. B. PROPOSED Parcel 19 of"Map of Thermalito," filed in the office of the County Recorder June 8, 1887, is consistent with the LDR (Low Density Residential) designation of the General Plan because it exceeds the minimum parcel size of 6,500 square feet. Box 2042 Oroville, CA 95965 RE: Thermalito Parcels AP 031-251-015 Dear Ted: In response to your letter of June 7, 2003, the County has reviewed the status of Assessor's Parcel number 031-251-015 and determined it to be one parcel of land, not four individual lots available for sale, lease or finance. The subject parcel, AP 031-251-015, is described as Lots 16, 17, 18 and 19, of Block 86 as shown on the "Map of Thermalito" filed in the office of the County Recorder June 8, 1887. Although it was past County policy to recotnize "lots" shown on this map, in the recent case of Gardner v. County of Sonoma, 29 Cal.4 990, published February 6, 2003, the California Supreme Court held that subdivision maps recorded prior to 1893 do not lawfully create or establish the lots or parcels depicted on them. In order to be recognized as individual parcels, lots 16, 17, 18 and 19 must have been individually separated from the surrounding property by a method recognized by the Subdivision Map Act and Butte County's Subdivision Ordinance, such as: conveyance by deed prior to March 4, 1972; conveyance by Gift Deed prior to 1993; issuance of a Certificate of Compliance by the County of Butte; or shown as a lot on a Parcel Map or"modern" Subdivision Map. Based upon the county's review of maps, deeds and other documents, the "lots" in question appear to have been owned as one unit until 2002. Starting December 31, 2002, a series of conveyances involving"lots" 16-19 occurred: Greg Felder conveyed "lots" 16, 17, 18 and 19 to Far Holdings (a California limited partnership); Far Holdings conveyed "lots" 16 and 17 to Glen Cosby; Far-Holdings conveyed"lots" 18 and 19 to Henry Runge; Henry Runge conveyed lots 18 and 19 to Robert Robichaud, under two separate transactions; and Glenn Cosby conveyed "lots" 16 and 17 to Rollie White. None of these conveyances instruments can be deemed "legal" subdivision instruments as they do not comply with the present day Subdivision Map Act and local subdivision ordinance. Whether the deeds were recorded before or after the Supreme Court ruling is irrelevant. The Gardner decision interpreted statutes which predated these conveyances, and therefore, exerts a retroactive.effect over those conveyances that took place prior to the published decision. In order to bring these"lots" into compliance with the Subdivision Map Act and local ordinance, allowing the County to issue development permits and making this property legal for sale, lease or finance, you must submit an application for Legal Lot Determination to the Planning Division mfr'!:• w.
