Proposal: Tentative Subdivision Map to divide Parcel 4 of Map Book 139 Pages 26 through 28 into two parcels of 1.09 acres each. Mr. Michelena gave a brief summary of the project. The hearing was opened to the public. Sherry Collier was here to answer questions. The hearing was closed and comments confined to the Commission and staff. It was moved by Commissioner Leland,seconded by commissioner Nelson,and unanimously carried to approve the Legal Lot Determination for Sherry Collier, subject to the findings and conditions listed below. I. Approve the Legal Lot Determination/Conditional Certificate of Compliance for on APN 065-205-002, File No. DET 05-09, subject to the following findings: A. This project is exempt from environmental review under the General Rule exemption Section 15061(b)(3). This section states that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Because the project is exempt from the provisions of CEQA,the payment of fees pursuant to Fish I and Game Code Section 711.4 and 14 CCR 753.5 is not required. B. The parcel size of 0.7 acres was in conformance with the zoning at the time of creation. C. The Conditional Certificate of Compliance for the parcel will not be detrimental to the health, safety and welfare of the surrounding area. MINUTES - September 8, 2005 Commissioner Wilson said he will be absent for the month of October. Commissioner Lambert submitted her corrections in writing. Commissioner Nelson briefly discussed formatting the minutes. 0 f Commissioner Lambert said she is just asking for corrections and additions to the September 8, 2005, minutes. Commissioner Leland said he would like the minutes brief with comments that are significant to the action requested. Commissioner Lambert pointed out an instance when they had to go back to a previous set of minutes to look and see what occurred at the meeting. Chairman Marin asked if they wanted to continue the approval of the minutes for the corrections to come back to the Commission. It was moved by Commissioner Nelson,seconded by Commissioner Wilson,and unanimous carried to approve the minutes of September 8, 2005, subject to the following changes: Change the header and footer to read"September 8, 2005";Page 2,move Lines 11 & 12 to become Line 37, etc. and change it to read"Commissioner Lambert questioned whether the Real Estate and Limousine service is already in place as indicated in the pictures presented by Mr.Wubbolding,and if so, how are any conditions that mention "prior to occupancy" being met? The Subdivision Map Act requires a Final Map for the creation of five or more contiguous parcels. • The County's requirement for a parcel not created legally is to file a Legal Lot Determination application and receive a Conditional Certificate of Compliance. • The zoning at the time of creation was A-2 Agricultural Residential. • The General land use designation could not be determined for the parcel at the time of creation. • Determination of consistency with Zoning is based on a comparison between the date in which parcel was established,and the zoning regulations existing on that date. The original subdivider created 596 lots by the Fir Haven Subdivision Map. The Subdivision Map Act requires a Final Map for the creation of five or more contiguous parcels. • The County's requirement for a parcel not created legally is to file a Legal Lot Determination application and receive a Certificate of Compliance. • The zoning at the time of creation was A-2 Agricultural Residential. • The General land use designation could not be determined for the parcel at the time of creation. • Determination of consistency with Zoning is based on a comparison between the date in which parcel was established,and the zoning regulations existing on that date. By review of the instruments provided, it appears that your parcel was originally created by a Grant Deed from Clara Leigh to Fir Haven Inc. dated May 8, 1957 and recorded in Book 558 of Official Records, at page 519. This deed was not accepted as a valid creation deed because the Grantor was the original subdivider of the Fir Haven Subdivision Map. The Subdivision Map Act (Government Code §§66410- 66499.58) requires a Final Map for the creation of five or more contiguous parcels. This individual has been informed that she needs to prove the legal status of the parcel before she can obtain the permits . The original parcel is depicted on the Fir Haven Subdivision Map. However, the current configuration of the parcel is only a portion of the original parcel . 1 While you have been given numerous conveyance documents to evaluate, one does not have to look very far to discover the source the of illegal creation. The original parcel was created by Clara J. Leigh on the Fir Haven Subdivision Map, approved May 9, 1955 . In a subsequent grant deed, dated May 8, 1957, Ms . Leigh conveyed this parcel in two parts. Through this deed, she further subdivided this parcel after establishing it by subdivision map. Since she had just created five or more parcels by the map, she could not legally create additional parcels by grant deed. The owner supplied you with numerous subsequent conveyance documents, in the hope that one would legalize the parcel . None did, and none can. once a parcel is illegally created, it remains illegal until the illegality is removed through the certificate of compliance process . You do not need to review any subsequent conveyance documents . You only need to determine when the illegal subdivision occurred. Numerous other counties concur in this approach. I asked participants at a recent County Counsels, Land Use Conference whether anyone took a different approach. None did. Another issue arose in this matter. Several of the parcels in the Fir Haven Subdivision area, although not this parcel, have a blanket certificate of compliance issued on them. You were unsure why the blanket certificate applied to some, but not all , of the parcels . In researching this matter, we discovered that numerous parcels were conveyed to a single individual, Sam Fortino. Mr. Fortino had two records of survey drawn up and recorded: the first on May 12 , 1961; the second on March 12 , 1962 . The first showed the parcels as originally created by the Fir Haven Subdivision Map and conveyed to him. The second showed the parcels as they were subsequently conveyed by him, after he had subdivided many of them. In the process, Mr. Fortino established a record of his violation of the Subdivision Map Act, because he created five or more new parcels without following the Subdivision Map Act . This record was used, fifteen years later, by the Butte County Subdivision Violation Committee to grant a blanket certificate of compliance, as recorded in Book 2202 on Page 110, over all the illegally created parcels depicted on the second record of survey. The Committee was unaware of, and could not have recognized or addressed, other illegally created parcels, even though we now know that there were many others . It would not be appropriate to extend the blanket certificate to any of the other illegally created parcels because all of them were created under different circumstances that would need to be evaluated prior to issuing a certificate of compliance. As a final note, numerous issues concerning the certificate of compliance process are coming to light . It is clear that many individuals, including professionals, are confused about the process . It would be very helpful to develop information that could be shared with individuals who may need to go through the process . The information should discuss the various issues that 2 can arise .
