PC 06-61 A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING LEGAL LOT DETERMINATION 06-0031 WHEREAS, the Planning Commission has considered Legal Lot Determination 06- 0031, for Eric and Michelle Nyman, in accordance with Chapter 20, Section 160; Article VII, Violations and Certificate of Compliance, of the Butte County Code on Assessor's Parcel Number 071-290-019; and WHEREAS, the Planning Commission has determined a Conditional Certificate of Compliance for this project to be categorically exempt in accordance with the California Environmental Quality Act; and WHEREAS, said Conditional Certificate of Compliance was referred to various affected public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS,the Conditional Certificate of Compliance was considered at a public meeting on November 9, 2006; and WHEREAS,the Planning Commission has considered a report from the Planning Division. The applicant has obtained an access permit from the Department of Water Resources (see Exhibit D) allowing access to the property via Craig Access Road. I would like permission to build one single-family dwelling consisting of no more that 3 bathrooms (for septic purposes) and roughly 1,500 square feet. The project will not be put up for sale, as it is our intention to live there in the future. Therefore,there are no expected rents of sale prices. 19: At the time of making this application, the applicant does not foresee the necessity for variances, conditional use, rezoning application or development permits, but clearly will differ to Butte County for guidance. I do however have a permit to use the Craig Access Road from the Department of Water Resources and have attached.a copy for review. I worked very closely with Mr. Stewart Edell, Deputy Director of Public Works for Butte County and Marie Buric on behalf of Clifford Winston, Chief, Real Estate Branch of the DWR, to make sure the wording was acceptable Butte County Planning for future permit issuances. 32. I purchased the property in November o 2006 and at that time, there was no vehicular access to the property due to a steep gra a from Craig Access Road. As it sat then, it was untouched with no structures and moderately wooded in areas, but very walkable. There are no known historical, cultural or scenic characteristics of any significance related to this piece of property. There is evidence of local wildlife being active on the property, deer,birds etc. Working with a professional engineering firm, VerTech Engineering in Chico, we devised an access plan with as little impact on the surrounding grades as possible. I also kept Butte County and the DWR informed of my intentions along the way. Once the access plan was made, it was determined that the amount-of cut/fill and the amount disturbed area fell short of requiring a grading permit. VerTech, based on County codes, made these calculations. The DWR was very agreeable to allowing me to create the access onto my property based on the agreement contained in the attached "Permit to Use State Property for Access Purposes" in which I assume all maintenance costs and responsibilities for creating the access onto my property. 33. The surrounding properties are similar in type and normal for the area. The visible ` structures appear to be that of a single dwelling on each property. I know of no special cultural, historical or scenic characteristics as they pertain to the surrounding properties other than their close proximity to the Craig Saddle.
