Proposal: Legal Lot Determination/Conditional Certificate of Compliance Mr. Durling gave a brief summary of the project. He changed the date on Pages 7&8 from December 22 to December 8. Commissioner Nelson asked why they didn't do a blanket determination for all the parcels on the map. He asked if all the parcels on the map on Page 5 of the report that are not shaded are going to come in for a determination one at a time. Mr. Durling explained that he made the map to show that.there have been a lot of determinations in the vicinity. He said there was a question of right of access onto Craig Access Road and that is why there is a condition that the applicant has to,prove that they have a right to use the road. Commissioner Nelson still wanted to know if everyone of the parcels that are not shaded are non- complying parcels that need a Certificate of Compliance. Mr. Durling said he did not know. Commissioner Leland said the applicant has to prove his right to use Cochise Drive and Cochise Drive is : . 60 feet. Does the applicant have to prove that he has the right to use all 60 feet or show that he has a prescriptive right-of-way for the.width of his car? Mr. Durling said the applicant has to show that the access is 60 feet in width and he has a right to use it: Commissioner Nelson asked if these parcels were created legally. Mr.Durling said the parcels were not created legally,they were created by deed. The parcels need to meet the conditions that existed at the time the parcels were created by deed. Commissioner Nelson asked why it was recognized back when the parcels were created and now the people have to come in and make the parcels legal. Commissioner Lambert asked what the Commission needs to make an approval, i.e., that the parcel met the zoning at the time,that it met the General Plan designation at the time,and this makes the parcel legal. Mr. Durling said as long as it conforms to the zoning and General Plan and before they can get a building permit the owner has to satisfy the conditions. Commissioner Nelson said there are 30-40 parcels that are potentially created by deed and will need a Certificate of Compliance. He asked why this needs to be done one parcel at a time. ■BUTTE COUNTY PLANNING COMMISSION■MINUTES ■DECEMBER 8,2005 ■ AP GEE 11 i " There was a brief discussion on how these parcels were created. Mr. Wannenmacher said they were created by grant deeds. He said after 1963 access is an issue and so is sewage disposal. He said if people can not meet the access requirements,they can not get a clear Certificate of Compliance to be able to build' on the property. He said sometimes the County knows the property was created illegally and should file a Notice of Violation. He said at the point the County knows the parcels were created illegal there should be a Notice of Violation filed to tell buyers there is a problem with the property. Mr. Durling said if the County finds out someone comes in for a Determination and they own 4 or more lots, they would have to do a subdivision map. Commissioner Nelson questioned if the applicant has access to Cochise Drive. Mr. Durling said the access requirement was satisfied. Mr.Wannenmacher said he has spoken with Land Development and Mr.Calarco to streamline the process on some of the remaining parcels. He said some will still need to come to the Commission. He said some people might come to the Commission asking for exceptions to the conditions. The hearing was opened to the public. No one was present to speak on this item. The hearing was closed and comments confined to the Commission and staff. It was moved by Commissioner Leland, seconded by Commissioner Nelson, and unanimously carried to approve the Legal Lot Determination Conditional for John and Linda Briggs,adopting Resolution PC 05- 10, subject to the conditions in Exhibit A, changing the date in the Resolution from December 22, to December 8, on Pages 7 and 8, Change"1972"to"1974"on Page 1 of the Agenda Report, and twice on Page 2 of the Agenda Report. Delete the last bullet on Page 2 of the Agenda Report.
