Location: at the end of Demetri Place,which is accessed from Damron road,approximately
2,750 feet south of Los Verjeles Road, Bangor.
Proposal: Legal Lot Determination/Conditional Certificate of Compliance.
Mr. Michelena gave a brief summary of the project and deleted"categorically" from Page 1 of the
Resolution and change "Public Works"to "Development Services".
Commissioner Lambert asked why not do a blanket judgment for the entire area.

Mr. Wannenmacher said staff needs to look at each parcel individually.

Mr. Michelena said he has to go out on a site visit for each parcel.
Commissioner Lambert asked what would be a reason to deny one of these.
Mr. Michelena said the County can not deny the request,but they can put conditions on that have to
be met before someone can build on the property.
The hearing was opened to the public.

Mr. Runge said he was here to answer.questions.
The hearing was closed and comments confined to the Commission and staff.
It was moved by Commissioner Leland, seconded by Commissioner Lambert, and unanimously
carried to approve the Legal Lot Determination/Conditional Certification of Compliance,for Henry
T. Runge, Jr, DET 06-05, adopting Resolution.05-16, deleting "categorically" from Page 1 of the
Resolution, change 1. A. from"Public Works"to "Development Services.
There is a 15-day appeal period on all decisions with the Clerk of the Board

Prior to submitting a Legal Lot Determination application, it is requested that the applicant discuss the

Development Services, Public Works and Environmental Health staff. Please note that acceptance of your

The following specific information and material shall accompany a Uniform Application at the time of

LEGAL LOT DETERMINATION 06-05
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-05 for
Henry T. Runge, Jr., in accordance with Chapter 20, Section 160; Article VII, Violations and
Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 028-330-037;and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a public hearing was held on December 22, 2005; and
iWHEREAS, the Planning Commission has considered public comments and a report from
the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I.. Finds this project is exempt from environmental review under the General Rule
exemption Section 15061(b)(3). This section states that CEQA applies only to
projects which have the potential for causing a significant effect on the environment.
Because the project is exempt from the provisions of CEQA, the payment of fees
pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required.

RESOLUTION -
A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-03
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-05 for
Henry T. Runge, Jr., in accordance with Chapter 20, Section 160; Article VII, Violations and
Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 028-330-037;and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a public hearing was held on December 22, 2005; and
WHEREAS, the Planning Commission has considered public comments and a report from
the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project_is Categorically exempt from environmental review under the
General Rule exemption Section 15061(b)(3). This section states that CEQA applies
only to projects which have the potential for causing a significant effect on the
environment. Because the project is exempt from the provisions of CEQA, the
payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is
not required.
A. The custodian of the record is the Department of Public Works. The location
of the record is 7 County Center Drive, Oroville CA 95965.
II. Makes the following findings and approves Conditional Certificate of Compliance
06-05 with the conditions as set forth in the attachment(Exhibit A)to the resolution.
A. The parcel size of 4.88 U acres was in conformance with the Butte County
General Plan land use designation and zoning at the time.of creation.
B. The Conditional Certificate of Compliance for the parcel will not be
detrimental to the health, safety and welfare of the surrounding area.

W EREAS, each of the parties hereto-owns a portion of a parcel of Pages

land described in Exhibit "A" that will be benefitted by the roadways
and drainage facilities on easements described on Exhibit "A" attached
hereto and incorporated herein:
i W14 THEREFORE, it is mu:ua?ly agreed by the Parties hereto as
fallows:
1. For so long as the above mentioned works shall exist ir, private .
i .: o'w'nership, the Parties hereto, their successors and assigns, shall bear
the expenses of maintaining them in good repair. At is agreed that the.
cost of maintaining said works shall be paid by the Parties hereto,,thetr
successors and assigns, in proportion to the number of land parcels owned
by each owner and/or their successors and assigns, and each owner will,
upon written demand, contribute and pay his proportionate share of any
monies paid out by any of the several owners or of any obligation -in-
curred -or the reasonable maintenance or repair of said works.
2. "Reasonable maintenance or repair" shall not include 'the en
largement of said works and this agreement shall not be construed to
require any owner to contribute to the cost of- any enlargement of said
works.
3. Any owner may bring actions in any court of competent juris-
diction in the County of Butte to enforce collection of any monies due
from any ownef as their proportionate share of the cost:of the reasonable
maintenance or repair of said works, and'in any such action-or actions
the prevailing party.or parties shall be entitled to recover a reasonable
�. attorney's fce to be fixed by the court in such actions.
4. For the purposes of-this agreement, the decision of the owners
. of a majority of the parcels to the-effect that specified repair or'
maintenance work is necessary .shall be conclusive on the.remaining owners
and the decision of said majority as to the reasonableness of the cost
of any such repair or maintenance work shall be conclusive on the remain-
ing owners provided that said cost does not exceed the average of three
�. independent cost estimates secured not more than 60 .days prior to com-
mencement of the work.
S. The owners of a majority of the parcels may authorize the
creation of a maintenance and repair account ina savings and loan
association or bark. Monies deposited .therein shall be expended only
for maintenance and ,repair of the above referenced works and the
nuiriber of signatures required to.withdraw monies shall be specified at
the time said account is authorized.

b. Receipts for all minies received a:ni of all expenditures made
shall be preserved and rraie available fol- inspection and copying by ami-
• cwner, in person or by agent, for a period of one year.
-7. The word "owner", as used herein, shall mean one person in whom.
sole title is vested. It shall also mean two or more persons who hold
a unity of interest as joint tenants, ar tenants in common, as .partners,
1 or as husband and wife with title vested "as their CORMmity.prope rty."
For the purpose of determining if the owners of a majority of the.parcels
are in favor of a proposal, the affirmative vote of any spouse,' joint
j tenant, or tenant in cocoon shall constitute approval by that parcel,
irrespective of the number of co-owners of that parcel.
S. This agreement may be terminated at any time by the vote of the '
! ow-vers of two thirds of the parcels.. Upon terni..,ation of this agreement,
any monies remaining unexpended shsil be distributed to the then owners
of all parcels in the same proportions as received.
• 9. This agreement is to be. construed as.a conversant ruining with
the lana, and it is further understood and agreed that this agreement shall
inu-e to and bind rhe.successors in interest of the parcels owned by all
the parties hereto, whether by way. of sale, assignment, inheritance or .
otherwise, and it shall be applicable to such smaller parcels as say
be created by subsequent t divisions of said parcels.
10. This agreement is executed in counterparts; the signature pages
