Commissioner Lambert asked why not do a blanket judgment for the entire area. I Mr. Wannenmacher said staff needs to look at each parcel individually. i Mr. Michelena said he has to go out on a site visit for each parcel. Any owner may bring actions in any court of competent juris- diction in the County of Butte to enforce collection of any monies due from any ownef as their proportionate share of the cost:of the reasonable maintenance or repair of said works, and'in any such action-or actions the prevailing party.or parties shall be entitled to recover a reasonable �. attorney's fce to be fixed by the court in such actions. 4. For the purposes of-this agreement, the decision of the owners . of a majority of the parcels to the-effect that specified repair or' maintenance work is necessary .shall be conclusive on the.remaining owners and the decision of said majority as to the reasonableness of the cost of any such repair or maintenance work shall be conclusive on the remain- ing owners provided that said cost does not exceed the average of three �. independent cost estimates secured not more than 60 .days prior to com- mencement of the work. S. The owners of a majority of the parcels may authorize the creation of a maintenance and repair account ina savings and loan association or bark.
