Prior to submitting a Legal Lot Determination application, it is requested that the applicant discuss the
application requirements, County procedures, zoning provisions and possible conditions of approval with the
Development Services, Public Works and Environmental Health staff. Please note that acceptance of your
application is not an indication of approval.
A. SPECIFIC INFORMATION
The following specific information and material shall accompany a Uniform Application at the time of
submittal. Applications will not be considered complete nor will they be acted upon until all submittal
requirements have been met. All items, maps and exhibits submitted in support of this application shall become
the property of Butte County.

A Legal Lot Determination is placed on the agenda of the Planning Commission for approval. Notice
of the time, date, and place of said hearing is posted in a public place at least 72 hours prior to hearing.
THE PLANNING COMMISSION DECISION IS FINAL UNLESS APPEALED TO THE
BOARD OF SUPERVISORS WITHIN 15 CALENDAR DAYS.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-10
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-10 for
Daniel Casey,in accordance with Chapter 20, Section 160;Article VII,Violations and Certificate of
Compliance, of the Butte County Code on Assessor's Parcel Number 071-280-015; and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a public hearing was held on December 8, 2005; and
WHEREAS,the Planning Commission has considered public comments and a report from
the Planning Division;
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is Categorically exempt from environmental review under the
General Rule exemption Section 15061(b)(3). This section states that CEQA applies
only to projects which have the potential for causing a significant effect on the
environment. Because the project is exempt from the provisions of CEQA, the
payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is
not required.
A. The custodian of the record is the Department of Public Works. The location

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-10
WHEREAS, the Planning Commission'has considered Legal Lot Determination 06-10
for Dustin Ford, in accordance with Chapter 20, Section 160; Article VII, Violations and
Certificate of Compliance, of the Butte County Code on Assessor's Parcel Number 031-234-026;
and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Enviromnental Quality
Act; and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and
comments; and
WHEREAS, a public hearing was held on November 10, 2005; and
WHEREAS, the Planning Commission has considered public comments and a report
from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is Categorically exempt from environmental review under the
General Rule exemption Section 15061(b)(3). This section states that CEQA
applies only to projects which have the potential for causing a significant effect
on the environment. Because the project is exempt from the provisions of CEQA,
the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR
753 5 is not required.
A. The custodian of the record is the Department of Public Works. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Makes the following Conditional Certificate of Compliance findings:
A. PROPOSED Parcel 9 of Block 25, of "Map of Thermalito," filed in the
office of the County Recorder June 8, 1887, is consistent with the LDR
(Low Density Residential) designation of the General Plan because it
exceeds the minimum parcel size of 6,500 square feet.
B. PROPOSED Parcel 9 of Block 25 of "Map of Thermalito," filed in the
office of the County Recorder June 8, 1887, is consistent,with the AR
(Agricultural Residential) zone because the parcel exceeds the minimum
lot size of 6,500 square feet which is equivalent to the R-1 zone.
III. Approves Conditional Certificate of Compliance 06-10 and the special conditions
found as set forth in the attachment (Exhibit A) to the resolution.

This legal lot determination is for Lot 9 of Block 25 of the"Map of Thermalito, Wall Map No. 6."
filed in the office of the County Recorder June 8, 1887. The parcel is vacant except for foundation
footing forms for a single family dwelling. The parcel is consistent with the Low Density
Residential(LDR)land use designation of the General Plan Land Use Element,and consistent with
the AR(Agricultural Residential)zone. Staff recommends approval of this request for a Legal Lot
Determination/Certificate of Compliance for one parcel with findings.
ANALYSIS:
•. The State Supreme Court, in Garner v Sonoma, determined that maps of this kind did not
subdivide properties into parcels. The Court took this action in 2003. Prior to this time,
parcels shown on the "Map of Thermalito"were considered legal parcels.
• The following activities have affected the establishment of Parcel 9:

• The "Map of Thermalito, Wall Map No. 6." was filed in the office of the County
Recorder June 8, 1887.
• Parcel 9 was sold separately by a deed recorded on January 31, 1991 at 91-003823
transferring the parcel from Michael V. Pierce and Diane D.Monson,to John Fanim. In
following the Garner v Sonoma decision, this deed created the parcel.
• A Record of Survey was recorded on February 28, 1991. The document shows parcel 9
as one of seven parcels against which individual deeds were recorded.
• Donald Moore, Sr. and Alda D.Moore,owners of parcels 9, 10, and 11 as shown on the
recorded Record of Survey, transferred title to Parcel 9 to Jack Dustin Ford on August
26, 2005 at 2005-0051076.
• The Zoning history is as follows:
• Ordinance 475 adopted August 31, 1953, the Enabling Ordinance, established land use
zones for Butte County. This Ordinance zoned the property A-1 with no minimum lot
size.
• Ordinance 522 adopted August 29, 1955,zoned A-2 with standards listed under Enabling
Ordinance 475. No minimum lot size given.
• Ordinance 1687 adopted March 2, 1976,zoned AR-MH(Agricultural-Residential Mobile
Home).
• Ordinance 2393 adopted February 28, 1984, zoned the property AR (Agricultural
Residential) the current zoning.
• The General Plan history is as follows:
• The 1966 General Land Use Plan Map designates the area Residential.
• The 1971 General Land Use Plan Map designates the area Medium Low Density(5 to 8
Units per acre gross).
• The October 29, 1979 General Land Use Plan Map designated the area Low Density
Residential (6,500.square feet to 1-acre parcels).
• Determination of consistency with Zoning and General Plan is based on a comparison
between the date in which parcels are established, and the General Plan and zoning
regulations existing on that date. The following is provided:
• The General Plan designation from 1979 to date has been LDR (Low Density
Residential), 6,500 square feet to 1-acre parcel size.
• The size of"lot" 9 (0.22 acres) is consistent with the AR zone minimum parcel size of
6,500 square feet, and equivalent to the R-1 zone listed as a permitted zone in the LDR
Land Use Element of the General Plan.
• Access to the property is provided by Heinen Drive, which is maintained as a 60-foot wide
private easement which contains the access road.
• The California Department of Forestry/Butte County Fire Department recommends that the
following informational note be placed on the Certificate of Compliance"All new structures

(CEQA) provisions under the General Rule exemption Section 15061(b)(3).

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-10
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-10
for Dustin Ford, in accordance with Chapter 20, Section 160; Article VII, Violations and
Certificate of Compliance, of the Butte County Code on Assessor's Parcel Number 031-234-026;
and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality
Act; and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and
comments; and
WHEREAS, a public hearing was held on November 10, 2005; and
WHEREAS, the Planning Commission has considered public comments and a report
from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is Categorically exempt from environmental review under the
General Rule exemption Section 15061(b)(3). This section states that CEQA
applies.only to projects which have the potential for causing a significant effect
on the environment. Because the project is exempt from the provisions of CEQA,
the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR
753.5 is not required.
A. The custodian of the record is the Department of Public Works. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Makes the following Conditional Certificate of Compliance findings:
A. PROPOSED Parcel 9 of Block 25, of "Map of Thermalito," filed in the
li office of the County Recorder June 8, 1887, is consistent with the LDR
(Low Density Residential) designation of the General Plan because it
exceeds the minimum parcel size of 6,500 square feet.
B. PROPOSED Parcel 9 of Block 25 of "Map of Thermalito," filed in the
office of the County Recorder June 8, 1887, is consistent with the AR
(Agricultural Residential) zone because the parcel exceeds the minimum
Jot size of 6,500 square feet which is equivalent to the R-1 zone.
III. Approves Conditional Certificate of Compliance 06-10 and the special conditions
found as set forth in the attachment (Exhibit A) to the resolution.
