Runge Location: On the south side of Loretta Lane, approximately 350 feet Owner: John Donovan southwest of Hurleton Swedes Flat Road, east of Oroville. File#: DET 06-09 Supervisor District: 4' Request: Legal Lot Determination/ Project Mark Michelena Conditional Certificate of Planner: Senior Planner Compliance G.P.: AR(Low Density Residential) Attachments: Zoning: M-R(Mountain or A: Resolution with Exhibit A Recreational Subdivision- Residential, 5-acre minimum) B: General Plan/Zoning Map APN: 072-380-005 C: Deed; dated,January 24, 1972; Book 1730 Page 536 Parcel Size: 2.5 acres i Zone Date: December 9, 1969 STAFF COMMENTS: The parcel, at the time of creation, was consistent with the Grazing-Open Land designation of the General Plan Land Use Element and with the M-R (Mountain or Recreational Subdivision- Residential) zone. Staff recommends approval of this request for a Legal Lot Determination/Conditional Certificate of Compliance for one parcel with findings. ANALYSIS: • The project parcel(APN 072-380-005)was illegally created by Deed(Book 1730,Page 536) recorded in the Official Records of Butte County on January 24, 1972. • The parcel was part of an illegal division by Don Mann. A court decision determined the parcels in the judgment area would need to apply for a legal lot determination/certificate of compliance. • The parcel is currently undeveloped. ■BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT■ ■January 26,2006■Donovan DET 06-09 0 Page I of 7 0 • Determination of consistency with Zoning and General Plan is based on a comparison between the date in which parcels are established, and the General Plan and zoning regulations existing on that date. The following is provided: • The General Plan designation at the time was Grazing-Open Land. The size of the parcel was consistent with the 1.0 acre minimum. • The zoning at the time was M-R(Mountain or Recreational Subdivision-Residential). The size of the parcel was consistent with the zoning requirements (0.5 acres) • Access to the property is on Loretta Lane (a private road), which is served by Hurleton Swedes Flat Road(a publicly-maintained road). • The Butte County Department of Public Works required a couple of conditions. One is to provide two-way traversable access to a publicly-maintained road. The other would be to file a record of survey showing the boundaries of the parcel. • The California Department of Forestry/Butte County Fire Department recommends that the following informational note be placed on the Certificate of Compliance that states"All new structures must meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291." • Butte County Environmental Health Department reviewed the proposal and determined that there are adequate soils for leach area and replacement. They also stated that wells in the area produce 10—40 gallons/minute. They also recommend an informational note be placed on the Certificate of Compliance that states"A 50-foot leachline setback is required from the creek." CEQA ISSUES: This project has been determined to be exempt from the California Environmental Quality Act (CEQA)provisions under the General Rule exemption Section 15061(b)(3). ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission adopt the attached Resolution with Exhibit A. ■BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT■ 0 January 26,2006 ■Donovan DET 06-09 0 Page 2 of 7 0 N.E. 1/4 OF S.W. 1/4 3 N.91r. 1/4 OF SSE 1/4 SEC, 36, T.19N. If a payment on account of a claim does not fully cover the loss of the insured claimant, the Company shall be subrogated to these rights and remedies in the proportion which the Company's payment bears to the whole amount of the loss. If loss should result from any act of the insured claimant,as stated above, that act shall not void this policy, but the Company,in that event, shall be required to pay only that part of any losses insured against by this policy which shall exceed the amount,if any, lost to the Company by reason of the impairment by the insured claimant of the Company's right of subrogation. S The parcel is currently undeveloped.
