The following is provided: • The General Plan designation on October 5, 1987,the date the parcel was established, was Agricultural Residential (1-acre to 40-acre parcels). • The Zoning designation on October 5, 1987,the date the parcel was established was A-5 (Agricultural 5-acre minimum)the current zoning, by Ordinance 1629. • The Agricultural Residential General Plan land use designation states that a consistent parcel size is 20 acres or greater in size,but does allow for a parcel size of 5 acres if five conditionally consistent criteria can be met. These five criteria and a staff response is provided as follows: 1. Compatible with neighboring agricultural activities. The project parcel is adjacent to an agricultural use. The subject parcel also contains an agricultural use (Olive Trees). The5- acre parcel and additional dwelling(s) will not impact current agricultural operations because there is sufficient room for setback buffers if needed. 2. Evidence of adequate water and sewage disposal capacity. . The soils on the project site are generally suitable for on-site sewage disposal systems. Usable sewage disposal areas, as required by Appendix VII of the Butte County Subdivision Ordinance, exist on the proposed parcel. Domestic water is proposed to be obtained by private well. 3. Availability of adequate fire protection facilities. The nearest staffed fire station is Bangor Station # SS, located in Bangor, approximately four miles to the northeast of the site. All new dwellings placed on the project site would be required to have interior fire sprinkler systems to help reduce impacts to fire protection services, unless a pressurized community water system with hydrants that meet Fire Department specifications serves the property. 4. Adequately maintained approved road access with sufficient capacity to service area. Pleasant Grove Lane leads to the property from LaPorte Road via Drobish Road. However, Drobish Road, which fronts the property, is a private unimproved road. 'The roads in the project area can safely handle the minor increase, up to 9.55 average daily trips(1 dwelling unitx 9.55 daily trips), in vehicle traffic generated by the project. A condition will be placed on the Certificate requiring that Drobish Road be improved to the appropriate County standard. 5. Reasonable accessibility to commercial services and schools. A small commercial area is located approximately 4 miles to the northeast in the community of Bangor, as is a grade school. Extensive commercial services and schools are located in Oroville, approximately 11 miles north of the project site.- Based ite:Based upon the above responses, the 5-acre parcel can be considered to be conditionally consistent with the Agricultural Residential General Plan land use designation. • The current Butte County General Plan designation(Agricultural Residential)lists single family dwellings and agricultural as a primary uses. • The current zoning (Agricultural, 5-acre minimum) lists agricultural uses, and a single family dwelling,as permitted uses. • The California Department of Forestry/Butte County Fire Department recommends that the following informational note be placed on the.Certificate of Compliance "All new structures must meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291." Evidence of adequate water and sewage disposal capacity. The soils on the project site are generally suitable for on-site sewage disposal systems. Usable sewage disposal areas, as required by Appendix VII of the Butte County Subdivision Ordinance, exist on the proposed parcel. Domestic water is proposed to be obtained by private well. 3. Availability of adequate fire protection facilities. The nearest staffed fire station is Bangor Station # 55, located in Bangor, approximately four miles to the northeast of the site. All new dwellings placed on the project site would be required to have interior fire sprinkler systems to help reduce impacts to fire protection services, unless a pressurized community water system with hydrants that meet Fire Department specifications serves the property. 4. Adequately maintained approved road access with sufficient capacity to service area. Pleasant Grove Lane leads to the propertyfrom LaPorte Road via Drobish Road. However, Drobish Road, which fronts the property, is a private unimproved road. The roads in the project area can safely handle the minor increase, up to 9.55 average daily trips(1 dwelling unit x 9.55 daily trips), in vehicle traffic generated by the project. A condition will be placed on the Certificate requiring that Drobish Road be improved to the appropriate County standard. 5. Reasonable accessibility to commercial services and schools. A small commercial area is located approximately 4 miles to the northeast in the community of Bangor, as is a grade school. Extensive commercial services and schools are located in Oroville, approximately 11 miles north of the project site: • Based upon the above responses, the 5-acre parcel can be considered to be conditionally consistent with the Agricultural Residential General Plan land use designation. • The current Butte County General Plan designation(Agricultural Residential)lists single family dwellings and agricultural as a primary uses. • The current zoning (Agricultural, 5-acre minimum) lists agricultural uses, and a single family dwelling,as permitted uses. • The California Department of Forestry/Butte County Fire Department recommends that the following informational note be placed on the Certificate of Compliance "All new structures must meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291."
