PC 06-33 A.RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING LEGAL T LODETERMINATION 06_.14' WHEREAS,the Planning Commission has considered Legal Lot Determination 06-14, for Michael S. Connolly, in accordance with Chapter 20, Section 160; Article VII, Violations and Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 056-120-085;and WHEREAS, the Planning Commission has determined a Conditional Certificate of Compliance for this project to be categorically exempt in accordance with the California. Environmental Quality Act; and WHEREAS, said Conditional Certificate of Compliance was referred to various affected -public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS,the Conditional Certificate of Compliance was considered at a public meeting on August 10,2006; and WHEREAS,the Planning Commission has considered a report from the Planning Division. Finds this project has been determined to be categorically exempt from the California Environmental Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate development consistent with the current FR-5 zoning of the property. The FR-5 zoning designation allows limited uses consistent with the new construction or conversion of small structures as described in section 15303. A. CONDITIONS OF APPROVAL: - 1. Pay the recording fee in effect at the time the Certificate of Compliance is recorded. The current fee is $7.00 for the first sheet plus $3.00 for each additional sheet. The estimated current cost for recording this Certificate is $13.00 with conditions. This cost estimate is based on 1 page notification(first sheet), 1 page of legal description with Note, attached as Exhibit`B". 2. The following informational note shall be placed on the Certificate of Compliance: "All new structures must meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291." Adherence to this requirement is met at building permit stage. 3. The following informational note shall be placed on the Certificate of Compliance: "Any, development on.the site shall meet all requirements of the Cohasset Planning Area adopted May 20, 1986,by Ordinance 2526,including but not limited to a requirement that evidence of adequate and dependable potable water on the parcel be provided prior to the issuance if a building permit. 4. Prior to or concurrently with the recordation of the Certificate of Compliance,provide a fully executed road maintenance agreement and appropriate recordingfees for all non-publicly maintained access roads on the County approved form. 5.` Prior to final road inspection,install all necessary traffic safety signs including stop signs.
