This recording makes reference to the CHANDON RANCH map. The description of the Canal bisects the south portion of the property as shown on the application map. • Portions of lots 19,20,21,22,and 23 were conveyed by Grant Deed recorded in the Official Records of Butte County at Book 1836,page 441,on May 17, 1973. Said grant deed notes j the exception for the Canal Grant Deed referenced above. This description using said lots as a descriptive reference, describes one parcel of real property, not 5 separate lots. County Code at that time allowed the creation of parcels greater than 40 acres in gross area without County review or approval. • The deed recorded January 26, 1983,in Book 2789 of Official Records at Page 630,left lots 19 and 20 as a remainder single parcel of real property by conveying lots 21, 22 and 23. This conveyance subdivided the above reference single parcel created in 1973, for the purposes of sale, after the State Subdivision Map Act and County Code Changes required County approval of a Parcel Map or Waiver of Parcel Map for the division of property into 40 acre or larger parcels. • Finally,Parcels 19&20 of Chandon Ranch was segregated off by Deed recorded January 26, 1983 at Book 2789 Page 630 to the benefit of the applicant. • The Zoning history is as follows: Ordinance 475 adopted August 31, 1953 is the Enabling Ordinance establishing land use zones for Butte County. This Ordinance zoned the property A-1 with no minimum lot size. Ordinance 522 adopted August 29, 1955, zoned A-2 with standards listed under Enabling Ordinance 475. No minimum lot size given. Ordinance 1438 adopted March 12, 1974, zoned A-20, but lists A-40 standards showing minimum lot size of 40 acres. Ordinance 1589 adopted June 17, 1975, zoned the property A-40. Ordinance 1750 adopted August 31, 1976 was the first codification of zoning regulations for Butte County,and replaced Enabling Ordinance 475. Standards for the A-40 zone remained the same. • The General Plan history is as follows: • The 1966 General Land Use Plan Map designates the area Open and Grazing with no minimum parcel size. Information acquired by this office during the review of the Khangura application for Legal Lot Determination (DET 04-05) indicates that a parcel currently defined as AP 024-200- 054,056 was divided from the adjoining parcel to the west (AP 024-200-053, 055) by Deed recorded January 26, 1983, in Book 2789 of Official Records, at Page 630. A subdivision by deed, such as this, was not allowed per the Subdivision Map Act and County Code in 1983. Prior to that deed, AP 024-200-053, 054, 055, 056 were one parcel of land as evidenced by that Grant Deed recorded May 17, 1973, in Book 1836 of Official Records at page 441. That deed would be accepted as a valid creator of one parcel comprising all of AP 024-200-053, 054, 055, 056. I The following additional information provided by the applicant does not support AP 024- 200-054, 056 as being previously approved for development by the County for the reasons listed below: • The "Septic Tank System Inspection Certificate" was issued in 1961, 22 years prior to the "illegal" split that occurred in 1983. There is no evidence that the County reviewed and approved development in the parcel's present configuration. • The assessor's records indicating the assessment of Labor Housing built in 1945 and 2 steel buildings, used as dehydrators, modified in 1950 do not provide support that the County reviewed and approved development in the parcel's present configuration. AP 024-200-042 was created in its present configuration by a Deed of Trust recorded in 1960. The owner of this parcel applied for a Certificate of Compliance in 1984 and was denied by the Subdivision Violation Committee.' The reason for denial is stated in the attached minutes of that meeting. Under the policies and interpretations we are currently using to review parcel creation, I would accept the 1960 Deed of Trust as a valid creator of AP 024-200-042, and would require no additional information for this parcel. Kr. Mendonsa said it was legal at the.time it was created. The problem is' that it was written all as one. description after it was granted back. The Assessor does show it as a separate parcel, but. that does not mean that it is separate .necessarily. County Counsel has not teen available for an opinion on this situation. Mr. Hironimus said' he thought that it was intended to pu.t the property back into one piece when it was conveyed. Mr. Thiara said he bou"ht the land after the foreclosure. At that time , it showed all the different parcels. At the time he wasn't plar_ning to sell any of it. However, now' he needs a loan. If he. does not get the loan, he will lose the house. There was discussion that. the parcel with the house was separated out for financial reasons and then reconveyed back into the larger parcel. N1r. Hironimus said that one solution would be to go through the Use Permit procedure for segregation of a homesite. Someone may have erred in writing up the description., and 1�y3 failed to exclude out the small parcel when it was reconveyed back. RECESS Mr. Mendonsa said that he had talked to County Counsel about the situation. The opionion of County Counsel is that the deed of trust was secured to' finance construction of the house, originally. Because all the later deeds combined the property, County Counsel's opinion is that the parcel was never created for in the first place, so consequently it no longer exists. According to Public Works this is actually one lot separated by a canal and was created January 26, 1983. Because of the creation date this lot must meet Appendix VII requirements. They have adequate depth of soil, but will have to complete groundwater monitoring before our department would approve the parcel for development. I contacted the owner who said they do not wish to do groundwater monitoring now(they may wish to do it several years from now), and want to keep this parcel for agricultural purposes only at this time. As long as this parcel is for agriculture only our department has no issue, however, if they want to develop it we will require winter groundwater monitoring before approval.
