The size of the parcel (20.7 acres) was consistent with the zoning requirements (5 acres minimum) at the time of creation. • The Butte County Land Use Plan designation that existed at the time of parcel creation was Agricultural Residential (20 acres or larger). The parcel size was consistent at the time of creation. • Access for the parcel is on Winding Creek Way via Rossini Pond Road, both private roads accessed from Mission Olive Road, a county-maintained road. The following agencies provided comments and conditions as shown in Exhibit A. • Butte County Environmental Health Department indicates that the parcel has adequate sewage disposal area and quantities of water. They are requiring a 100-foot sewage disposal setback from North Honcut Creek and from all wells and a 50-foot setback from all drainages. , • Butte County Public Works Department indicates that conditions be included to provide two- way traversable access,conforming to County Code,to the parcel from a publicly maintained road. In addition, they require an informational note on the Certificate of Compliance stating, "Prior to grading, a Construction Storm Water Permit will be required by the State Water Resources Control Board if the project results in a disturbance (including clearing, excavation,filling,and grading)of one or more acres. The Permit must be obtained from the State Water Resources Control Board prior to construction." • California Department of Forestry/Butte County Fire Department indicates that an informational note shall be included on the Certificate of Compliance that states all new structures meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291. The legal lot determination would facilitate development consistent with the current A-5 zoning of the property. The A-5 zoning designation allows limited uses consistent with the new construction or conversion of small structures as described.in section 15303.
