application requirements, County procedures, zoning provisions and possible conditions of approval with the
Development Services, Public Works and Environmental Health staff. Please note that acceptance of your
application is not an indication of approval.

The following specific information and material shall accompany a Uniform Application at the time of
submittal. Applications will not be considered complete nor will they be acted upon until all submittal

LEGAL LOT DETERMINATION 06-17
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-17 for _
Samuel and Elaine White, in accordance with Chapter 20, Section 160;Article VII,Violations and
Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 028-340-001;and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as a categorical ekemption in accordance with the California Environmental Quality
Act; and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a the matter was considered at a public meeting on August 10, 2006; and
WHEREAS,the Planning Commission has considered a report from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is categorically exempt from the California Environmental Quality
Act (CEQA) provisions under Section 15303. The A-5 zoning designation allows
limited uses consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA,the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Grants an exception to the 300-foot agricultural setback requirement according to
the following findings.
A. The 300-foot setback is feasible and therefore will be required from the
west property line.
B. The parcel will not support a standard buffer in the north-south direction,
so a reduced setback of 175 feet is accepted from the south property line to
accommodate development of the parcel.
III. Makes the following findings and approves Conditional Certificate of Compliance

and Butte County Subdivision Ordinance and lies within the Culet judgment area. The parcel is
located at the end of Winding Creek Way,approximately 1.9 miles SE of Dunstone Dr.,northwest of
Bangor. The parcel is undeveloped and, with incorporation of the recommended conditions of
approval, will be consistent with the Butte County land use designation and zoning in effect at the
time of creation. Staff recommends approval of unusual circumstances related to a 300'agricultural
buffer and a Legal Lot Determination/Conditional Certificate of Compliance with findings and
conditions.
ANALYSIS:
• The project parcel (APN 028-340-001) was illegally created by Joint Tenancy Deed
(Document# 86-43048) recorded in the Official Records of Butte County on December 4,

1986.
• The parcel was part of an illegal division by Ben Culet..Mr.Culet created by deed more than
four contiguous parcels,which was a violation of the Subdivision Map Act and Butte County
Code. A court decision determined that the parcels in the judgment area would need to apply
for a legal lot determination/certificate of compliance.
• The project parcel is currently undeveloped.
• Determination for consistency with Zoning and General Plan was based on date of creation
of the parcels.
• Determination of applicable conditions was based upon the subdivision ordinance at the time
the parcel was created.
• Zoning at the time of parcel creation was A-5. The size of the parcel (20.7 acres) was
consistent with the zoning requirements (5 acres minimum) at the time of creation.
• The Butte County Land Use Plan designation that existed at the time of parcel creation was
Agricultural Residential (20 acres or larger). The parcel size was consistent at the time of
creation.
• Access for the parcel is on Winding Creek Way via Rossini Pond Road, both private roads
accessed from Mission Olive Road, a county-maintained road.
The following agencies provided comments and conditions as shown in Exhibit A.
• Butte County Environmental Health Department indicates that the parcel has adequate
sewage disposal area and quantities of water. They are requiring a 100-foot sewage disposal
setback from North Honcut Creek and from all wells and a 50-foot setback from all
drainages. ,
• Butte County Public Works Department indicates that conditions be included to provide two-
way traversable access,conforming to County Code,to the parcel from a publicly maintained
road. In addition, they require an informational note on the Certificate of Compliance
stating, "Prior to grading, a Construction Storm Water Permit will be required by the State
Water Resources Control Board if the project results in a disturbance (including clearing,
excavation,filling,and grading)of one or more acres. The Permit must be obtained from the
State Water Resources Control Board prior to construction."
• California Department of Forestry/Butte County Fire Department indicates that an
informational note shall be included on the Certificate of Compliance that states all new
structures meet Fire Safe Regulations of the Butte County Code and Public Resources Code
4290 and 4291.
Agricultural Buffer
• Butte County Agricultural Commissioner is requiring that an note be placed on the
Certificate of Compliance noting a 300-foot agricultural buffer from the west property line
separating the parcel from properties holding Williamson Act contracts and with the General
Plan land use designation of Grazing and Open Land (GOL).

• An exception to the standard 300-foot agricultural buffer is requested so that residential

structures shall be placed not less than 175 feet from the south property line with a property
holding a Williamson Act contract and under the General Plan land use designation of
Grazing and Open Land (GOL).
• The Agricultural Department recommends an exception to the standard 300-foot buffer from
the.south property line due to unusual circumstances. The size and shape of the parcel will
not support a standard buffer in the north-south direction. (See attached exhibits D and E)
CEQA ISSUES:
This project has been determined to be categorically exempt from the California Environmental
Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate
development consistent with the current A-5 zoning of the property. The A-5 zoning designation
allows limited uses consistent with the new construction or conversion of small structures as
described.in section 15303. Use permits, with accompanying environmental review, would be
required for uses inconsistent with this class 3 exemption.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission adopt the attached Resolution, finding unusual
circumstances to allow a 175 buffer on the south property line and approving the legal lot
determination with findings and conditions.

ArRESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-17
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-17 for
Samuel and Elaine White, in accordance with Chapter 20, Section 160; Article VII,Violations and
Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 028-340-001;and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as a categorical exemption in accordance with the California Environmental Quality
Act; and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a the matter was considered at a public meeting on August 10;2006; and
WHEREAS the Planning Commission has considered a report from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: '
I. Finds this project is categorically exempt from the California Environmental Quality
Act (CEQA) provisions under Section 15303. The A-5 zoning designation allows
limited uses consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA,the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services, The
location of the record is 7 County Center Drive, Oroville CA 95965. .
II. Grants an exception to the 300-foot agricultural setback requirement according to
the following findings. '
M A. The 300-foot setback is feasible and therefore will be required from the
west property line.
B. The parcel will not support a standard buffer in the north-south direction,
so a reduced setback of 175 feet is accepted from the south property line to
accommodate development of the parcel.
III. Makes the following findings and approves Conditional Certificate of Compliance
06-17 with the conditions as set forth in the attachment(Exhibit A)to the resolution.

relative compaction. Submit design to Land Development Division for approval prior to
construction. "R" value determination and other data may be required to support the section
design.
❑ 12. Prior to recordation of the Certificate of Compliance,provide approved access to each parcel from
a County maintained road or from a state highway. Improve parcel frontage to RS-8 LD-11 and
access road to parcel being divided to RS-8 LD-I.
❑ 13. Prior to recordation of the Certificate of Compliance,submit road and drainage improvement plans
for the installation and construction of the street frontage improvements on ' to I County
Improvement Standards. Improve parcel I frontage to a '/2+ 12' /full street section on I to an RS-
road standard including,but not limited to curb,gutter and sidewalk for parcels with gross acreage
of one acre or less.

B. DRAINAGE
❑ 1. Prior to recordation of the Certificate of Compliance, a plan for a permanent solution for drainage
shall be submitted to and approved by the Department of Public Works. The drainage plans shall
detail existing drainage conditions and shall specify how drainage waters shall be detained or
retained on- site and/or conveyed to the nearest natural or publicly maintained drainage channel `
or facility and shall provide that there shall be no increase in the peak flow runoff to said channel
or facility.
❑ 2. Prior to final improvement inspection by the Department of Public Works, all new drain inlets
shall be labeled with the county approved drain marker per County Standard S-40. Improvement
plans shall show and/or note the 'requirements for labeling inlets pursuant to Butte County
Standard S-40.
❑ 3. Prior to recordation of the Certificate of Compliance, establish 100 year flood plain elevations and
the lowest floor elevations for any structures, in accordance with Butte County Code §26-25.
Show on the additional map sheet the elevations (by contours) and the location of an accepted
NGVD29(National Geodetic Vertical Datum of 1929)benchmark and a temporary benchmark on-
site.
