Notice of Violation EXECUATIVE SUMMARY: The subject property was created by deed February 2, 1972 contrary to Butte County Code Chapter 20 and the state Subdivision Map Act. The parcel is located on the north side of Choctaw Ridge Road, east of Berry Creek, within a Don Mann Judgment Area. The parcel is undeveloped and was consistent with the Butte County land use designation and zoning in effect at the time of creation. Staff recommends approval of this request through a conditional certificate of compliance with the findings and conditions identified below. ANALYSIS: • The parcel was illegally created by grant deed (Book 1733, Pages 24 & 25) recorded in the Official Records of Butte County on February 2, 1972. A Notice of Violation was filed. • The parcel is part of an illegal division by Don Mann, and a court decision determined that all parcels in the judgment area would need to apply for a legal lot determination to obtain a certificate of compliance or conditional certificate of compliance. ■Butte County Department of Development Services ■ ■August 10,2006■Agenda Report—Powell DET 06-26■Page 1 of 8 ■ • A legal lot determination is required because the original subdivider(Mann) created more than four contiguous parcels, without a subdivision map being filed as required by the Butte County Code Chapter 20 and the state Subdivision Map Act. • The parcel is not currently developed. • Determination of consistency with Zoning and General Plan is based on a comparison between the date in which parcels are established, and the General Plan and Zoning .regulations existing on that date. • Zoning at the time of parcel creation was A-2. The size of the parcel was consistent with the zone's minimum requirements of 8,125 square feet. • The General Plan Land Use Designation at the time of parcel creation was Timber Mountainous-Terrain (no minimum parcel size). The size of the parcel was consistent with the land use designation. • The current Zoning and General Plan Land Use Designation are Unclassified and Agricultural Residential, respectively. The parcel does not comply with the current Zoning and General Plan Designations. • Access to the property appears to be provided by Choctaw Ridge Road, extending off of Encina Grande Road. However, there remains a question as to whether the property owner has rights to use all of the private road system that extends to the Oroville-Quincy Highway, and if the entire system is two way traversable. Conditions will be placed on the Conditional Certificate of Compliance requiring verification of approved access (the proper size and two-way traversable). The following agencies provided comments and conditions as shown in Exhibit A. • Butte County Environmental Health Division reviewed the proposal and determined that the parcel will accommodate both septic and well systems for a single family residence. • Butte County Public Works Department indicates that conditions be included for two- way traversable access and a record of survey showing boundaries of the property. • California Department of Forestry/Butte County Fire Department indicates that an informational note shall be included that states all new structures meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291. • The Butte County Agricultural Commissioners Office reviewed the proposal and determined that there are no adverse agricultural issues. CEQA ISSUES: This project has been determined to be categorically exempt from the California Environmental Quality Act (CEQA) provisions under Section 15303. The legal lot determination would facilitate development consistent with the current U (Unclassified) zoning of the property. The U Zoning allows limited uses consistent with the new construction or conversion of small structures as described in section 15303.
