SERVICES
Prior to submitting a Legal Lot Determination application, it is requested that the applicant discuss the
application requirements, County procedures, zoning provisions and possible conditions of approval with the
Development Services, Public Works and Environmental Health staff. Please note that acceptance of your
application is not an indication of approval.
A.• SPECIFIC INFORMATION
The following specific information and material shall accompany a Uniform Application at the time of
submittal. Applications will not be considered complete nor will they be acted upon until all submittal
requirements have been met. All items, maps and exhibits submitted in support of this application shall become
the property of Butte County.
The following items are required to be submitted at the time of application:
Applicant Planner
1. A completed, signed, Uniform Application. If the application is signed by
an agent for the property owner, an Agent Authorization Form must be
submitted along with the Uniform Application. The application shall not be
accepted unless signed by the owner or authorized agent.
2. ;� Payment of the currently required Application Fee.
3. An application for a Legal Lot Determination must be accompanied by
verification of ownership and/or evidence of how the parcel in question was;?
created. This evidence may be obtained from a Title Company, engineer, or
land surveyor, et al.
4. A plot plan or map giving approximate locations of existing improvements
on the property.

A Legal Lot Detennination is placed on the agenda of the Planning Corrunission for approval. Notice
of the time, date, and place of said hearing is posted in a public place at least 72 hours prior to hearing.
THE PLANNING COMMISSION DECISION IS FINAL UNLESS APPEALED TO THE
BOARD OF SUPERVISORS WITHIN 15 CALENDAR DAYS.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-26
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-26
for James and Debbie Powell, in accordance with Chapter 20, Section 160; Article VII,
Violations and Certificate of Compliance, of the Butte County Code on Assessor's Parcel
Number 061-620-005; and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality
Act; and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and
comments; and
WHEREAS, the Conditional Certificate of Compliance was considered at a public `
meeting held on this 10th Day of August; and.
WHEREAS, the Planning Commission has considered a report from the Planning
Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project has been determined to be categorically exempt from the
California Environmental Quality Act (CEQA) provisions under Section 15303.
The legal lot determination would facilitate development consistent with the
current U zoning of the property. The U zoning designation allows limited uses
consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA, the payment
of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5
is not required.
B. . The custodian of the record is the Department of Development Services.
The location of the record is 7 County Center Drive, Oroville CA 95965.
II. Makes the following findings and approves Conditional Certificate of Compliance.
06-26 with the conditions as set forth in the attachment (Exhibit A) to the
resolution.
A. The parcel size of 2.5 (±) acres was in conformance with the Butte County
General Plan land use designation and zoning at the time of creation.
B. The Conditional Certificate of Compliance for the parcel will not be
detrimental to the health, safety and welfare of the surrounding area.

I. CONDITIONS OF APPROVAL:
1. Pay the recording fee in effect at the time the Conditional Certificate of

EXECUATIVE SUMMARY:
The subject property was created by deed February 2, 1972 contrary to Butte County Code
Chapter 20 and the state Subdivision Map Act. The parcel is located on the north side of
Choctaw Ridge Road, east of Berry Creek, within a Don Mann Judgment Area. The parcel is
undeveloped and was consistent with the Butte County land use designation and zoning in effect
at the time of creation. Staff recommends approval of this request through a conditional
certificate of compliance with the findings and conditions identified below.
ANALYSIS:
• The parcel was illegally created by grant deed (Book 1733, Pages 24 & 25) recorded in
the Official Records of Butte County on February 2, 1972. A Notice of Violation was
filed.
• The parcel is part of an illegal division by Don Mann, and a court decision determined
that all parcels in the judgment area would need to apply for a legal lot determination to
obtain a certificate of compliance or conditional certificate of compliance.

• A legal lot determination is required because the original subdivider(Mann) created more
than four contiguous parcels, without a subdivision map being filed as required by the
Butte County Code Chapter 20 and the state Subdivision Map Act.
• The parcel is not currently developed.
• Determination of consistency with Zoning and General Plan is based on a comparison
between the date in which parcels are established, and the General Plan and Zoning
.regulations existing on that date.
• Zoning at the time of parcel creation was A-2. The size of the parcel was consistent with
the zone's minimum requirements of 8,125 square feet.
• The General Plan Land Use Designation at the time of parcel creation was Timber
Mountainous-Terrain (no minimum parcel size). The size of the parcel was consistent
with the land use designation.
• The current Zoning and General Plan Land Use Designation are Unclassified and
Agricultural Residential, respectively. The parcel does not comply with the current
Zoning and General Plan Designations.
• Access to the property appears to be provided by Choctaw Ridge Road, extending off of
Encina Grande Road. However, there remains a question as to whether the property
owner has rights to use all of the private road system that extends to the Oroville-Quincy
Highway, and if the entire system is two way traversable. Conditions will be placed on
the Conditional Certificate of Compliance requiring verification of approved access (the
proper size and two-way traversable).
The following agencies provided comments and conditions as shown in Exhibit A.
• Butte County Environmental Health Division reviewed the proposal and determined that
the parcel will accommodate both septic and well systems for a single family residence.
• Butte County Public Works Department indicates that conditions be included for two-
way traversable access and a record of survey showing boundaries of the property.
• California Department of Forestry/Butte County Fire Department indicates that an
informational note shall be included that states all new structures meet Fire Safe
Regulations of the Butte County Code and Public Resources Code 4290 and 4291.
• The Butte County Agricultural Commissioners Office reviewed the proposal and
determined that there are no adverse agricultural issues.
CEQA ISSUES:
This project has been determined to be categorically exempt from the California Environmental
Quality Act (CEQA) provisions under Section 15303. The legal lot determination would
facilitate development consistent with the current U (Unclassified) zoning of the property. The U
Zoning allows limited uses consistent with the new construction or conversion of small
structures as described in section 15303. Use permits, with accompanying environmental
review, would be required for uses inconsistent with this class 3 exemption.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-26
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-26
for James and Debbie Powell, in accordance with Chapter 20, Section 160; Article VII,
Violations and Certificate of Compliance, of the Butte County Code on Assessor's Parcel
Number 061-620-005; and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality
Act; and
s WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public .and private agencies, County departments, and referral agencies for review and
comments; and
WHEREAS, the Conditional Certificate of Compliance was considered at a public
meeting held on this I 01 Day of August; and
WHEREAS, the Planning Commission has considered a report from the Planning.

NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project has been determined to be categorically exempt from the
California Environmental Quality Act (CEQA) provisions under Section 15303.
The legal lot determination would facilitate development consistent with the
current U zoning of the property. The U zoning designation allows limited uses
consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA, the payment
` of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5
' is not required.
B. The custodian of the record is the Department of Development Services.
