Finds this project has been determined to be categorically exempt from the California Environmental Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate development consistent with the current AR-1 zoning of the property. The AR-1 zoning designation allows limited uses consistent with the new construction or conversion of small structures as described in section 15303. A.' Because the project is exempt from the provisions of CEQA,the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. B. The custodian of the record is the Department of Development Services. The location of the record is 7 County Center Drive, Oroville CA 95965. H. The parcel size of 2 U acres is in conformance with current zoning and in conditional conformance with the following Butte County General Plan Land Use Designation Goals and Policies: 1. Compatible with neighboring agricultural activities. The project site is not located in an intensive commercial agricultural area. The parcel itself contains an orchard that continues onto the neighboring parcel to the east and onto portions of four 1/2 acre parcels to the west. The Butte County Agricultural Commissioner's Office commented that the proposed structure placement appears to be appropriate despite being less than 300 feet from existing orchard operations. 2. Evidence of adequate water and sewage disposal capacity. This parcel has an existing well installed under permit in 1990. The Butte County Environmental Health Division commented that there is adequate area for sewage disposal. 3. Availability of adequate fire protection facilities. The nearest fire station is Station 72,which is located in Palermo. Response time to the project site would be minimal due to the relatively short distance between the project site and Station 72. All development on the project site must comply with Public Resources Code 4290 and 4291. 4. Adequately maintained approved road access with sufficient capacity to service area. Access to the parcel is from Fulton Avenue, a public road classified as a minor roadway. Fulton Avenue and the other roads in the immediate area have sufficient capacity to safely handle vehicular traffic resulting from the development of this parcel. 5. Reasonable accessibility to commercial services and schools. Commercial services and K-12 schools are located in Palermo and/or Oroville, both of which are about a ten to fifteen minute drive from the project site. B. The Conditional Certificate of Compliance for the parcel will not be detrimental to the health, safety and welfare of the surrounding area. C. That given the parcel size,the adjacent land uses and the determination byrthe Agricultural Commissioner,.development of the home site shown on the attached site plan dated 5/15/06(Attachment D)will have no adverse impact on agriculture,unusual circumstances exist. Reasonable accessibility to commercial services and schools. Commercial services and K-12 schools are located in Palermo and/or Oroville, both of which are about a ten to fifteen minute drive from the project site. • The parcel is currently vacant with an existing well installed under permit in 1990. • Butte County Public Works Department applied no conditions as the parcel fronts on a publicly maintained road. . • The Agriculture Commissioner's Office commented that the existing orchard on the parcel extends onto surrounding parcels, and there appears to be adjacent agricultural operations. The size and shape of the parcel will not, however, support a standard 300-foot agriculture buffer in the east-west direction. • The Agricultural Department recommends an exception to the standard buffer due to unusual circumstances and finds the proposed structure placement(193 feet from the west property line and 100 feet from the neighboring parcel to the east,as annotated on the Site Plan dated 5/15/06, Attachment D)to be appropriate. CEQA ISSUES: This project has been determined to be categorically exempt from the California Environmental Quality Act(CEQA)provisions under Section 15303. When the BOS considered this agenda item, they approved the form on the back of the agenda report. That form is also the last document attached. As you will see when you review the agenda report, when a person comes in for a permit to drill an exploratory water well, they sign the acknowledgement form, unless they want to go through the time and expense of a legal lot determination. As we explained to the BOS in the agenda report, the form allows for an inexpensive and streamlined exploratory water well permit process, for those who simply wish to determine whether an adequate water source exists, to determine whether a parcel can potentially be developed.
