LEGAL LOT DETERMINATION
APPLICATION PACKET CHECKLIST
Prior to submitting a Legal Lot Determination application, it is requested that the applicant discuss the
application requirements, County procedures,'zoning provisions and possible conditions of approval with the
Development Services, Public Works and Environmental Health staff. Please note that acceptance of your
application is not an indication of approval.
A. SPECIFIC INFORMATION
The following specific information and material shall accompany a Uniform Application at the time of
submittal. Applications will not be considered complete nor will they be acted upon until all submittal
requirements.have been met. All items,maps and exhibits submitted in support of this application shall become
the property of Butte County.

The following items are required to.be submitted at the time of application:
Applicant Planner
1: A completed, signed, Uniform Application. If the application is signed by
an agent for the property owner, an Agent Authorization Form must be
submitted along with the Uniform Application. The application shall not be
accepted unless signed by the owner or authorized agent.
3. An application for a Legal Lot Determination must be accompanied`by
verification of ownership and evidence of how the parcel in question was
created. This evidence may be obtained from a•Title Company, engineer, or
land surveyor, et al.
4. A plot plan or map giving approximate locations of existing improvements
on the property.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-27
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-27 for
John Wilder.,in accordance with Chapter 20,Section 160;Article VII,Violations and Certificate of
Compliance, of the Butte County Code on Assessor's Parcel Number 058-680-014; and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and'
WHEREAS,the Conditional Certificate of Compliance was considered at a public meeting
before the Planning Commission on August 10, 2006; and
WHEREAS,the Planning Commission has considered a report from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is categorically exempt from environmental review pursuant to
Section 15303 of the CEQA Guidelines. The FR-5 zoning designation allows limited
uses consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA,the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services. The

STAFF COMMENTS:
-The subject property, located on Raulson Lane in Concow approximately 1000 feet south of the
Highway 70/Yankee Hill intersection, was created by deed on October 30, 1969, contrary to the
Subdivision Map Act and Butte County Subdivision Ordinance as it was one of a number of
contiguous parcels in the area resulting from quartering or"4 x 4" subdividing. It is part of a Ben
Culet Judgment Area. This currently undeveloped parcel was consistent with the General Plan Open
Area Forest and Grazing designation and the A-2(Agriculture 2-Acre Minimum)zone in effect at the y
time of creation. The applicant seeks to build a single family residence with a well and septic field.
Staff recommends approval of this request for a Legal Lot Determination/Conditional Certificate of
Compliance for one parcel with findings and conditions.
ANALYSIS:
• The project parcel(APN 058-680-014)was created by Deed(Book 1590,Page 215)recorded

in the Official Records of Butte County on October 30, 1969.

• APN 058-680-014 is in a Ben Culet judgment area (Yankee Hill Project #13). A court
decision determined that parcels in the judgment area would need to apply for a legal lot
determination/certificate of compliance.
• The parcel,traversed by a dirt road,contains a tool shed,derelict motor home,an abandoned
car and assorted refuse and debris. The previous owner, Exodus From Bondage, received
code violations for junk,unauthorized camping,and overflowing sewage in November,2004.
A code enforcement a site visit revealed no evidence of sewage or anyone living at the site.A
condition of approval requires consistency with Butte County Code Section 24-120 for the
removal of remaining large accumulations of junk.
• Determination of consistency with Zoning and General Plan is based on a comparison
between the date in which parcels are established, and the General Plan and zoning
regulations existing on that date. The following is provided:
o The General Plan designation at the time was Open Area Forest and Grazing, for
which there was no minimum acreage size;
o The zoning at the time was A-2 and the size of the parcel was consistent with the 2
acre minimum.
• Descending from the Yankee Hill Road/Highway 70 intersection(elevation approximately
1,650 feet), access to the property(elevation approximately 1;375 feet) is via the unpaved,
County-maintained Yankee Hill Road to the privately maintained Red Eye Road and Raulson
Lane over a distance of about 3,200 road feet.
The following agencies provided comments and conditions as shown in Exhibit A.
• The Butte County Department of Public Works requires two-way traversable access to the
parcel from a publicly maintained road and payment of a$7.00 recording fee at the time
the Certificate of Compliance is recorded.
• The Butte County Department of Environmental Health has no conditions, commenting:
"Soil depth tests have been performed and area wells show adequate quantities to support
a single family dwelling."
y • The California Department of Forestry/Butte County Fire Department recommends that`
the following informational note be placed on the Certificate of Compliance: "All new
structures must meet Fire Safe Regulations of the Butte County Code and Public
Resources Code 4290 and 4291."
• The Butte County Department of Agriculture requires no conditions or mitigation.
CEQA ISSUES:
This project has been determined to be categorically exempt from the California Environmental
Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate

development consistent with the current FR-5(Foothill Recreational,5-acre minimum)zoning of the
property. The FR-5 zoning designation allows limited uses consistent with the new construction or
conversion of small structures as described in section 15303. Use permits, with accompanying
environmental review, would be required for uses inconsistent with this class 3 exemption.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission adopt the attached Resolution with Exhibit A.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION 06-27
WHEREAS, the Planning Commission has considered Legal Lot Determination 06-27 for
John Wilder.,in accordance with Chapter 20,Section 160;Article VII,Violations and Certificate of
Compliance, of the Butte County Code on Assessor's Parcel Number 058-680-014; and

WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
' WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and ,
WHEREAS,the Conditional Certificate of Compliance was considered at a public meeting
before the Planning Commission on August 10, 2006; and
WHEREAS,the Planning Commission has considered a report from the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: -
I. Finds this project is categorically exempt from environmental review pursuant to
Section 15303 of the CEQA Guidelines. The FR-5 zoning designation allows limited
uses consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA,the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
f - II. Makes the following Conditional Certificate of Compliance findings:
A. The parcel size of 4.5 U acres was in conformance with the Butte County General
Plan land use designation and zoning at the time of creation.
B. The Conditional Certificate of Compliance for the parcel will not be detrimental to
the health, safety and welfare of the surrounding area.
