PC 06-31 A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING LEGAL LOT DETERMINATION 06-20 WHEREAS, the Planning Commission has considered Legal Lot Determination 06-20 for Diane Renee Laurito, in accordance with Chapter 20, Section 160; Article VII, Violations and Certificate of Compliance,of the Butte County Code on Assessor's Parcel Number 072-350-012;and WHEREAS, the Planning Commission has determined a Conditional Certificate of Compliance as categorically exempt in accordance with the California Environmental Quality Act; and WHEREAS, said Conditional Certificate of Compliance was referred to various affected public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS,the Conditional Certificate of Compliance was considered at a public hearing on August 10, 2006; and WHEREAS,the Planning Commission has considered a report from the Planning Division. Finds this project has been determined to be categorically exempt from the California Environmental Quality Act (CEQA)provisions under Section 15303(a). The legal lot determination would facilitate development consistent with the current M-R zoning of the property. The M-R zoning designation allows limited uses consistent. with the new construction or conversion of small structures as described in section 15303(a). A. CONDITIONS OF APPROVAL: 1. Pay the recording fee in effect at the time the Conditional Certificate of Compliance is recorded.The current fee is$7.00 for the first sheet plus$3.00 for each additional sheet. The estimated current cost for recording this Certificate is $10.00 without conditions, $13.00 with conditions. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained on- site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 6. Place the following informational note on the Certificate of Compliance: "Prior to grading, a Construction Storm Water Permit will be required by the State Water Resources Control Board if the project results in a disturbance (including clearing, ' excavation, filling, and grading) of one or more acres. The Permit must be obtained from the State Water Resources Control Board prior to construction." 7. This Ordinance zoned the property A-1 with no minimum lot size. • Ordinance 522 adopted August 29, 1955,zoned A-2 with standards listed under Enabling r Ordinance 475. No minimum lot size given. • Ordinance 1058 adopted December 9, 1969, zoned the property M-R (Mountain Recreation, 0.5 acre minimum). The property is still zoned M-R, but the minimum parcel size is 5 acres under current Butte County Code Section 24-115(f)(1). • The General Plan history is as follows: • The 1966 General Land Use Plan Map designates the area Open Area/Forest and Grazing.
