File#: DET 06-28 Supervisor 1 District: Request: Legal Lot Determination/ Project Meredith Williams Conditional Certificate of Planner: Associate Planner Compliance G.P.: FAR(Foothill Area Zone Date August 17, 1982 Residential) Zoning: FR-5 (Foothill Recreational, 5 Parcel Size: 4.76 acres( acre minimum) APN: 058-630-016/058-680-011 Attachments: A: Resolution with Exhibit A B: General Plan/Zoning Map C: Deed (September 19, 1975; Document# 8242) STAFF COMMENTS: The subject property was created on September 19, 1975 by deed contrary to the Subdivision Map Act and Butte County Subdivision Ordinance; it is part of the Ben Culet judgment area. The parcel lies within two different tax code areas and therefore carries two Assessor Parcel Numbers(APNs). The property is located on Raulson Lane approximately 0.50 miles from the intersection with Red Eye Road in Yankee Hill. The parcel is undeveloped and, with incorporation of the recommended conditions of approval, will be consistent with the Butte County land use designation of Timber- Mountainous Terrain and the A-2 Zoning in effect at the time of creation. Staff recommends approval of this request for a Legal Lot Determination/Conditional Certificate of Compliance with findings and conditions. ANALYSIS: • The project parcel (APNs 058-630-016/058-680-011) was illegally created by Individual Joint Tenancy Deed(Document#8242)recorded in the Official Records of Butte County on September 19, 1975. • The parcel was part of an illegal division by Ben Culet. Mr. Culet created by deed more than four contiguous parcels, which was a violation of the Subdivision Map Act and Butte County ■Butte County Department of Development Services■ ■ September 14,2006 ■Agenda Report—Osbome DET 06-28 ■Page 1 of 7■ Code. A court decision determined that the parcels in the judgment area would need to apply for a legal lot determination/certificate of compliance. • The project parcel is currently undeveloped. • Determination of consistency with Zoning and General Plan was based upon the date of creation of the parcels. • Zoning at the time of parcel creation was A-2. • Determination of applicable conditions was based upon the Subdivision Ordinance(No.974) at the time the parcel was created. The size of the parcel (4.76 acres)was consistent with the subdivision requirements (8,125 sq. feet minimum) at the time of creation. • The Butte County Land Use Plan designation that existed at the time of parcel creation was Timber-Mountainous Terrain with no maximum density requirements. • Access for the parcel is on Raulson Lane approximately 0.50 miles from the intersection with Red Eye Road, both private roads accessed from Yankee Hill Rd.,a county-maintained road. The following agencies provided comments and conditions as shown in Exhibit A. • • The Butte County Department of Public Works indicates that conditions be included to provide two-way traversable access, conforming to County Code, to the parcel from a publicly maintained road. • The Butte County Department of Environmental Health states that prior to obtaining an unconditional COC, the applicant will be required to prove the capability of the parcel to meet the minimum requirements for sewage disposal to the satisfaction of the Environmental Health Division. They also provided the following comment: "Soil mantel tests have been performed and there is adequate soil to support a single family dwelling." • California Department of Forestry/Butte County Fire Department indicates that an informational note shall be included on the Certificate of Compliance that states all new structures meet Fire Safe Regulations of the Butte County Code and Public Resources Code 4290 and 4291. CEQA ISSUES: This project has been determined to be categorically exempt from the California Environmental Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate development consistent with the current FR-5(Foothill Recreational,5-acre minimum)zoning of the property. The FR-5 zoning designation allows limited uses consistent with the new construction or conversion of small structures as.described in section 15303. Use permits, with accompanying environmental review, would be required for uses inconsistent with this class 3 exemption. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission adopt the attached Resolution with conditions . 1 ■Butte County Department of Development Services ■ ■ September 14,2006 ■Agenda Report—Osliorne DET 06-28 ■Page 2 of 7 ■ found in Exhibit A. Compliance, of the Butte County Code on Assessor's Parcel Numbers 058-630-016/058-680-011; and WHEREAS, the Planning Commission has determined a Conditional Certificate of Compliance as categorically exempt in accordance with the California Environmental Quality Act; and WHEREAS, said Conditional Certificate of Compliance was referred to various affected public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS, a public hearing was held on September 14,2006; and WHEREAS,the Planning Commission has considered public comments and a report from the Planning Division. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: I. Finds this project is categorically exempt from the California Environmental Quality Act(CEQA)provisions under Section 15303. The FR-5 zoning designation allows limited uses consistent with the new construction or conversion of small structures as described in section 15303. A. Because the project is exempt from the provisions of CEQA,the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. B. The custodian of the record is the Department of Development Services. The location of the record is 7 County Center Drive, Oroville CA 95965. II. Makes the following findings and approves Conditional Certificate of Compliance 06-28 with the conditions as set forth in the attachment(Exhibit A)to the resolution. A. The parcel size of 4.76 (1) acres was in conformance with the Butte County General Plan land use designation and zoning at the time of creation. B. The Conditional Certificate of Compliance for the parcel will not be detrimental to the health, safety and welfare of the surrounding area. ■Butte County Department of Development Services ■ ■ September 14,2006 ■Agenda Report—Osborne DET 06-28 ■Page 5 of 7 ■ DULY PASSED AND ADOPTED this 14th day of September, 2006,by the following vote: .AYES:. .
