RECOGNIZE CRAIG ACCESS ROAD AS APPROVED NON-COUNTY MAINTAINED ACCESS _.� Clay Castleberry, public works director, set out the background ' of the reason for the need to recognize Craig access road as a non-county maintained access road, This is state recreational property. The state acquired the right-of-way to the state recreational property. Over the years many parcels have been created her. The county has approved some land divisions using some of the approved roads. . There have been people coming to the Board asking for-approval of access. The Craig access road is a better road than those approved for access to development. When a building permit is issued it is necessary to show access to a county road. Discussion open to the public. Appearing: Leslie Steidl. I Ms. Steidl asked that the Board delay any decision on this matter. She has talked with Mr. Harold Bradshaw, Department. of Parks .and Recreation. He did not feel that the state had been legally contacted regarding this matter. The stat's position is that the road exists now as egress and F ingress for state parks and the current residents on already approved parcels for implied access rights to the road. However, the state feels these are, the only people who have the right to 'travel the road. Ms. Steidl stated that the area is now under study regarding the zoning. She felt that the decision should be delayed until after the zoning— considerations have been completed. Under the proposed zoning there would be few new parcels, five acre minimum. r ' Matter closed to th,R-public. i BUTTE.:.COUNTTY BOARD. OF SUPERVISORS.KMTES. February, 27,,.1979 799- Supervisor Winston stated that the' Board passed an ordinance describing access requirements. This was the first time that traversable access was defined. It is up to the property owner to prove they have traversable access. . The Craig access road is a state road and any attempt , on the part of the state to give it to the county will be met with resist- ance. This matter was brought up because of a property owner who has asked that the Board acknowledge .that Craig assess road is a traversable v access. It meets the criteria' for the requirements of traversable access. It will be on the burden of the property owners to get written aces.s agreements with the state and the property owner was asked to replace the three-ton bridge and enter into a maintenance agreement. He felt that. the requirements were quite clear. He did not feel that this matter had anything to do with the zoning proposal. Mre Castleberry stated that most of the parcels in the area have access through rights-of-way. Today a property owner could come in and apply for a parcel split if he met the zoning and show proof of a right-of-way down to a county road. This road is in better shape than most of the roads. It is a convenience to those in the area to legally use what. they are using anyway. The state did *do extensive , work on the Craig access road. Supervisor Dolan felt that if there was no urgency in approving this, the .people have asked that this be delayed until after the zoning.., She felt that the Board should delay the matter. On motion of Supervisor.Winston, seconded by Supervisor Wheeler . and carried, Craig a=ess road was recognized as a non-county maintained access providing the conditions set forth by the Director of Public Works is met, namely, that the county recognize Craig access road providing written permission be obtained from the state to use the right-of-way, a road maintenance association agreement be recorded and signed. to the satisfaction of the Department of Public .Works and further that the present three-ton -limited small bridge be replaced in accordance with the Deparment of Public , Works requirements and none of the cost at any time to be from the County j of Butte. I submit that this is an onerous and unfair burden which is impossible to meet. Craig Access Road,the road in question,is a state road and as DPW has recorded is only 15 to 17 feet wide. There is two miles of road from Lumpkin, a county maintained road,to my property. I cannot pay for two miles of road improvements. You asked me to check with'my title company to see if they can find a deed from Theron and Geraldine Thornton to Lawrence and Mary Cheatam before. 1977. This is in order to avoid the road width requirements for Craig Access Road .since 1977, if possible. Otherwise you may have to'call in a road inspector and/or ask for an exception. I did request that deed from Mid Valley Title yesterday and they are going to get back to me next week. I will let you know what they find. You also said that my Legal Lot Determination application is going forward and should get to the planning commission in July. You were going to call me for a meeting in three weeks about the whole plan before it goes to the commission. You said the Lot Line Adjustment would work better if we tried to keep the size of both lots even but I didn't think that was possible because much of the driveway is on property line but you said it could probably also work for the safety reason because CDF is requiring a 30 foot clearance from us on the east side of my west property line (the proposed residence is on my property line) . You assured me that the department will work with us to facilitate the process for a building permit on the adjacent parcel, which is our goal. I appreciated meeting with you.
