LOT LINE ADJUSTMENT FOR WADDELL AND THOMAS
= Thomas property is 14.6 acres created by Parcel Map 82-7, developed with double wide
mobile home, well, septic and overhead utilities. Property is ridge top with many oaks
and brush. A large shop/barn constructed approx. 1987 by Waddell determined to be on
Thomas property. Old agreement to move line never consummated, these owners wish to
add barn to Waddell property.
Waddell parcel is 7.62 acres created by gift deed in 1987 from parcel of the Parcel Map
82-7. Land to be added to Waddell is approx. 0.54 acres including barn and 25' side
Yard. Waddell parcel currently vacant ridge top with horse pasture for Waddell family
members who own adjacent lands.

Mr.Chris Tolley gave a brief summary of the project.
Chair Lambert opened the public hearing.
Mr. Michael Evans asked that Condition 27 be reworded slightly so that applicant cbes not have to
remove all olive trees.
Chair Lambert said she doesn't see a poblem re-wording Condition 27.
Commissioner Leland gave the following wording for the change. Olive trees that are a hazard to
agriculture, as determined by the Agricultural Commission, must be removed from the project area prior to
recordation of the map, unless they are to continue as a commercial agricultural operation'
Chair Lambert asked if a condition should be made to have the dilapidated structures removed.
Commissioner Nelson said it is a condition on the map.
-Chair Lambert closed the public hearing and confined comments to Commission and staff..
It was moved by Commissioner Leland, seconded by Commissioner Wilson, and unanimously carried to
adopt Resolution PC 07-23 approving TPM06-0021 for Mark Solis with the correction to Condition 27to
read as"Olive trees that.are a hazard to agriculture, as determined by the Agricultural Commission, must
be removed from the project area prior to recordation of the map, unless they are to continue as a ,
commercial agricultural.operation."

Mr. Michelena said there has many discussions with the City of Gridley regarding improvements and
realignments.
Commissioner Marin asked if the improvements met with Gridley's standards.
Mr. Michelena said yes.
-Mr.Charles Thistlethwaite asked Mr.Michelenato talk about the letter from Union Pacific dated May 9,2007.
Mr. Michelena spoke about the letter andsaid that most of the letter was information regarding negotiations
between Union Pacific and the City ofGridley.

Mr. David Purvis gave a history of the project site. He commended staff on their work. lie told the
Commission that he did not believe there would be traffic issues and explained what the applicant plans on
doing to mitigate noise from the railroad for the managers residence.
Commissioner Nelson asked if there can be an exit only onto Highway 99.
Mr. Purvis said that Cal Trans did not want an access point onto the highway.
Chair Lambert closed the public hearing and confined comments to Commission and staff.
Mr. Michelena said that Public Works asked to review the letter.from the City of Gridley. There is one
condition that needs to be added regarding what Gridley is requiring regarding curbs,gutters,and sidewalks.
Commissioner Nelson asked if Mr. Purvis wanted to address the new condition.
Mr. Purvis said that he was not aware of such a condition.
Commissioner Nelson asked why sidewalks are required if it only goes in front of the mini storxg
Mr.Michelena said it is a standard condition.
Ms. Jolliffe said the City of Gridley's letter was dated in 2006 and that perhaps Gridley has changed its,
requirements. She suggested the condition be worded that applicant meet city imposed improvements as West
Liberty Avenue is within the City of Gridley's jurisdiction
Mr. Thistlethwaite agreed that it would be appropriate to change the wording.
Chair Lambert asked if traffic issues have been adequately addressed.
Ms. Jolliffe said that by using West Liberty as an access point instead of Highway 99 the traffic issue is.
mitigated. She asked if Public Work Conditions 11,14 should be deleted.
Mr. Eric Schroth said to change language from Butte County to City of Gridley on Conditions 11-13, but
Condition 14 still applies.
Ms.Jolliffe asked if a new Condition 15 should be added stating"Improve West Liberty Road to the standards

"Fire suppression sprinkler systems shall be installed in all new residential dwellings in accordance with NFPA Standard 13D,unless a

STAFF COMMENTS:
The subject property was created on March 19, 1987 by deed contrary to the Subdivision Map Act
and Butte County Subdivision Ordinance. The property is located at the terminus of Lothrop Lane,
on the south side, about one third of a mile south of Stringtown Rd. Because the project parcel
didn't comply with the 20-acre minimum parcel size required by the Unclassified zoning and
Agricultural Residential Land Use designation at the time of creation,the Certificate of Compliance
shall be issued on the legally created "parent" parcel described as Parcel 2 on the parcel map
recorded in Book 82, Page 7 in the Official Records of Butte County and referenced by APNs 072-
570-007&008. Staff recommends approval of the Legal Lot Determination/Conditional Certificate
of Compliance, as amended to add the additional lot, with findings and conditions.
ANALYSIS:
• The project parcel (APN 072-570-008)was illegally created by Gift Deed(Document#87-
10263) recorded in the Official Records of Butte County on March 19, 1987.
• Zoning that existed at the time of parcel creation was U (Unclassified).

• The Butte County General Plan Land Use designation at the time of parcel creation was AR
(Agricultural Residential).
• At the time of creation, both the zoning and Land Use Designation required a minimum
parcel size of 20 acres.
• Because the project parcel didn't comply with the minimum parcel-size required by the
zoning and Land Use designation at the time of creation, a Conditional Certificate of
Compliance(CCOC)cannot be issued for parcel 072-570-008 alone. However,a CCOC can
be issued on the legally created parcel described as Parcel 2(including both 072-570-008 and
072-570-007) in the applicant's title report:
o Parcel 2,as shown on that certain parcel map,recorded in the Office of the Recorder
of the County of Butte, State of California,on March 17, 1981,in Book 82 of Maps,
at page(s) 7.
• Parcel 2,as described above,is referenced by two Assessor's Parcel Numbers: 072-570-007
& 008
• . On May 19, 1989 a Grant Deed was recorded as document number 89-18360 by Sam W.
Waddell and Linda D.Waddell,husband and wife,to Sam W.Waddell,a married man. This
deed's stated intent was to merge APNs 072-260-116 and 072-260-117,the previous parcel
numbers for APNs 072-570-007 & 008.
• The 1989 Grant Deed shows the Waddell's intent to recognize APNs 072-570-008 and 072-
570-007 as one legal parcel. A phone call with Linda Waddell on April 17,2007 confirmed
that this is still their intention and will be accomplished through the issuance of this CCOC.
• APN 072-570-008 is currently undeveloped and 072-570-007 is developed with a single
family residence.
• Access for the parcel is on Lothrop Lane,a private road,which is reached by Stringtown Rd,
a county-maintained road.
• The Butte County Department of Public Works recommends a condition be included to
provide two-way traversable access to the parcel from a publicly maintained road,which is a
standard condition.
CEQA ISSUES:
This project has been determined to be categorically exempt from the California Environmental
Quality Act(CEQA)provisions under Section 15303. The legal lot determination would facilitate
development consistent with the current U (Unclassified) zoning of the property. The U zoning
designation allows limited uses consistent with the new construction or conversion of small
structures as described in section 15303. Use permits, with accompanying environmental review,
would be required for uses inconsistent with this class 3 exemption.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission adopt the attached Resolution with conditions
found in Exhibit A.

A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING
LEGAL LOT DETERMINATION DET07-0002
WHEREAS,the Planning Commission has considered Legal Lot Determination DET07-002
for Sam Waddell,in accordance with Chapter 20,Section 160;Article VII,Violations and Certificate
of Compliance,of the Butte County Code on Assessor's Parcel Numbers 072-570-007 and 072-570-
008; and
WHEREAS, the Planning Commission has determined a Conditional Certificate of
Compliance as categorically exempt in accordance with the California Environmental Quality Act;
and
WHEREAS, said Conditional Certificate of Compliance was referred to various affected
public and private agencies, County departments, and referral agencies for review and comments;
and
WHEREAS, a public hearing was held on May 10, 2007; and
WHEREAS,the Planning Commission has considered public comments and a report from
the Planning Division.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission:
I. Finds this project is categorically exempt from the California Environmental Quality
Act (CEQA) provisions under Section 15303. The U zoning designation allows
limited uses consistent with the new construction or conversion of small structures as
described in section 15303.
A. Because the project is exempt from the provisions of CEQA,the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not
required.
B. The custodian of the record is the Department of Development Services. The
location of the record is 7 County Center Drive, Oroville CA 95965.
II. Makes the following findings and approves Conditional Certificate of Compliance
DET07-0002 with the conditions as set forth in the attachment (Exhibit A) to the
resolution.
A. A parcel size of 7.62 acres was not in conformance with the Butte County
General Plan land use designation and zoning at the time of creation.
Therefore the requested Conditional Certificate of Compliance will apply to
the previously approved Parcel 2 on the parcel map recorded in Book 82,
Page 7 in the Official Records of Butte County and referenced by APNs 072-
570-007 & 008.
B. The Conditional Certificate of Compliance for the parcel will not be

I. CONDITIONS OF APPROVAL:
1. Pay the recording fee in effect at the time the Conditional Certificate of Compliance is
recorded.The current fee is$7.00 for the first sheet plus$3.00 for each additional sheet.
The estimated current cost for recording this Certificate is $10.00 without conditions,
$13.00 with conditions. This cost estimate is based on 1 page notification(first sheet), I
page of legal description attached as Exhibit"A", and 1 page of conditions attached as
- Exhibit"B".
2. Provide two-way traversable access to the parcel from a publicly maintained road or
state highway as defined in the County Code.
