TSM06-0016 - staff recommended approval Name: Northstar Engineering Project: Tentative Subdivision Map Planner: Mark Michelena APN: 055-540-037, 001 &016 Zoning: FR-40 Location: The parcel is located on the east and south side of Skyway,approximately 1,000 feet south of Bay Tree Drive and Skyway and 3,600 feet south of Bay Tree Drive and Skyway, southwest of the Town of Paradise. Proposal: A tentative subdivision to divide 228-acres into 6 parcels,ranging in size from 25.4 to 42.04 acres. This application is Phase 3 of the Blue Oak Terrace Subdivision(Phase 1 and 2 included 40 parcels). Access to five of the proposed parcels will be through the extension of the existing cul-de-sac of Phase 1. Access to the sixth parcel will be through a private 60-foot easement accessed from the existing entrance road to Phases 1 and 2. Mr. Mark Michelena gave a summary of the project and the reason for the exemption request. Commissioner Nelson arrived during the summary. Commissioner Leland asked what the criteria is for California Department of Forestry(CDF,or Cal Fire) to allow an exemption to the cul-de-sac length. Mr. Michelena explained that there is existing criteria, but Cal Fire looks at many things. He said they look at whether the project is rural or urban, if there are fire hydrants and sprinklers, type of ■BUTTE COUNTY PLANNING COMMISSION■APPROVED MINUTES■OCTOBER 25,2007,■v PAGE 2■ I road improvement, how many lots there are,whether there is an emergency access point,as well as other items. Exceptions are made on a case-by-case basis. Ms. Stacey Jolliffe said CDF has adopted guidelines for implementing their public resources code section that provides alternative guidelines. She said that Public Works preferred there not be another access point onto Skyway. Mr. Charles Thistlethwaite said the findings need to be included in the Resolution. Chair Lambert asked what are the findings that need to be made. Mr. Thistlethwaite said the findings are based on health, welfare, and safety and the improvement requirements in Chapter 24. Commissioner Wilson asked if the lots could be split further. Mr. Michelena said that since the project is zoned A-40 it would limit splitting the lots. Chair Lambert asked if second dwellings would be allowed on the parcels. Mr.Michelena explained this is the third phase of the project. That applicant can only have 51 water connections. The project as proposed has 47 so there is the potential for four more units. However, septic may not be adequate for second units. Commissioner Leland asked if this project is in a study area for the General Plan Update. Mr. Thistlethwaite said yes. Chair Lambert asked about who the authority is for cul-de-sac exceptions. Is it CDF or Public Works? Mr. Eric Schroth said that Public Works defers to CDF on this issue. Chair Lambert asked if the length of the cul-de-sac is based on fire concerns. Mr. Schroth said the primary concern is the ability to access the homes in the event of an emergency. Commissioner Wilson asked if Lot 46 was in a different zone. Mr. Michelena said yes. The lot is zoned AR not AR-40. Commissioner Wilson commented that is the reason the lot 46 doesn't have to meet the 40 acre requirement. Mr. Michelena said that is correct. He said there are two new requirements from Public Health in regards to the public water system. Conditions 37 and 38 are being added to require a note on the ■BUTTE COUNTY PLANNING COMMISSION■APPROVED MINUTES■OCTOBER 25,2007,■v PAGE 3■ map stating that the lots shall connect to community water, and, prior of recordation of the map provide verification that domestic water can be provided that meets minimum standards. Chair Lambert asked what is the total number of parcels the applicant could have. Mr. Michelena said the applicant could have up to 51 water connections.. This is the final phase of the project and the total is only 47 lots. Commissioner Leland asked if, on Phase 1, the cul-de-sac complied with the 500 foot rule. Mr. Michelena said it did not, but applicant put in an emergency access. Mr.Felix Wannenmacher said at the time of.Phase 1 and Phase 2 the project was not in the County's urban area. Commissioner Nelson asked about access to Lot 46. Mr. Michelena said there is a 60-foot easement for access. Chair Lambert opened the public hearing. Commissioner Nelson asked staff, in the future, to show the streets on the smaller maps to give perspective from larger map to smaller map. I Mr. Frank Nichols said he appreciates all the time and help from the staff during the process. He explained to the Commission all the upgrades he has done that are beyond what is required in the conditions. The water system has many upgrades and redundancies. He said there would not be individual wells. Commissioner Nelson asked why the applicant is not developing out more. Mr. Nichols said the AR-40 zoning restricts him. Commissioner Leland noted this is an area he recommended as a study area for the General Plan update. Since the infrastructure is there, it may be a good idea to look into changing the zone. Chair Lambert closed the public hearing and confined comments to Commission and staff. Mr. Thistlethwaite said the findings for the exception need to be included in the Resolution,delete Condition 34 regarding wells,renumber Condition 35 to Condition 34,add Conditions 36 and 37,and renumber subsequent conditions. TSM07-0004 - staff recommended approval Name: M& T Construction Project: Tentative Subdivision Map Planner: Mark Michelena APN: 030-350-095 & 030-350-102 Zoning: AR Location: The parcel is located north of Oro Dam Boulevard(State Route 162)and south of Grand Avenue. The project site is located to the northwest of the intersection of 12th Street and Feather Avenue. Proposal: A Tentative Subdivision Map to subdivide 7.5± acres into 32 new lots. Single-family residential dwelling units would be constructed on 29 of the lots and the remaining three lots (Lots A, B &C on the tentative subdivision map)would be storm drain detention basins. The project would connect with existing sewer and domestic water facilities owned and operated by the Thermalito Irrigation District. Three access points to the subdivision are proposed. The project proposes extending Sierra Avenue to the west, as well as construction of new roads entering the subdivision from 12th Street opposite Nevada Avenue and from Feather Avenue just west of the intersection with 12th Street. Commissioner Leland recused himself from this project due to a conflict of interest. Mr. Michelena gave a summary of the project. He told the Commission that this project would not add to the Thermalito drainage problem because it drains into a different area. Chair Lambert asked if the trees that are on the map are existing trees. Mr. Michelena said yes. Only one of the trees is a protected species, the Blue Oak. He said the applicant would have to mitigate loss of the Blue Oak on site. Commissioner Wilson asked if the drainage goes all the way to Ruddy Creek. Mr. Schroth said the drainage system would connect to the drainage system on 10 which would ultimately drain into Ruddy Creek. Chair Lambert asked if Sierra Avenue would extend to connect to Keko Street. Mr. Schroth said the improvements are only required along the frontage of the parcel. If the parcel fronts Keko Street then improvements would need to be made. . Commissioner Nelson said he is concerned that by breaking the grid,with these tentative subdivision maps, circulation would be affected. Mr. Schroth said it would be a small impact to circulation. ■BUTTE COUNTY PLANNING COMMISSION■APPROVED MINUTES■OCTOBER 25,2007,■v PAGE 5■ n s Commissioner Nelson said he is still concerned with the cumulative effects to circulation with the large number of projects in the area. Mr. Schroth said that Public Works does look at cumulative effects. Chair Lambert said that there was a traffic study done. She wanted to know who did the study. Ms. Jolliffe said there was a traffic study done that looked at the cumulative effects, including this project, for the Alexander map heard in September. Chair Lambert asked if the traffic study had been approved. Ms. Jolliffe said it was approved as part of the adopted Mitigated Negative Declaration for that project. It is not an adopted area wide study. Chair Lambert said that 10th Street and Oro Dam Blvd. was determined to be a problem area regarding traffic impacts related to a previous project. She talked about using pro-rata fair share fees to help offset the traffic impacts and asked about possibly using those fees for 12th Street. Mr. Michelena said that staff determined that traffic impacts would be minimal. Ms. Jolliffe said that Mitigation 8 on the Conditions of approval requires the applicant to pay a pro- rata fair share to offset traffic impacts. She said that she noticed_on the map that the cul-de-sac on Street A is offset by approximately 147 feet from Keko Street. She asked Public Works if an exception to County standards would be required. Mr. Schroth said he would want to analyze that further. Chair Lambert asked that the Draft 2007 Thermalito Drainage Plan be provided at the next meeting for the Commissioners to review. She said that drainage goes into Ruddy Creek in both scenarios discussed. She said that she does like the project and the fact that it connects to several different roads. Commissioner Wilson asked where the detention pond drains. Mr. Schroth said the water is carried through a pipe to Feather Avenue. Commissioner Marin asked if staff was recommending approval or a continuance of the project. Mr. Michelena said staff is recommending approval. Chair Lambert opened the public hearing. Mr. James Renfro from the Engineering Group addressed the Commission. He explained that the drainage plan is to go straight to Ruddy Creek and bypass.the 14th Street drainage system. He said that the circulation patterns would help to slow traffic. Commissioner Wilson said that the map showed that Sierra Avenue was abandoned. Mr. Renfro said that the applicant is conditioned to do improvements to Sierra Avenue. Chair Lambert closed the public hearing and confined comments to Commission and staff. Commissioner Nelson asked if Public Works is comfortable with the circulation patterns of the project. Mr. Schroth said,since there may be a possibility of connecting Sierra Ave and Keko Street,Public Works needs to review the project. It was moved by Commissioner Nelson,seconded by Commissioner Marin,and carried unanimously to continue open TSM07-0004 for M & T Construction, to November 15, 2007. GENERAL BUSINESS -This section of the agenda is to be utilized by the Planning Commission and Director of Development Services on items of interest, general discussion,or items for which staff has been directed to do research and bring back to the Commission. Items A,B,&C may not always be addressed at every hearing,but will always be listed as part of the agenda. A. Directors' Report B. General Plan/Zoning Ordinance Update Mr. Thistlethwaite gave an update of General Plan progress. He handed out information to the Commissioners. He talked about the Economic Summit that was held and said the video would be on the website soon. He said that the Board of Supervisors study session was moved to November 27 at 1:30 pm. C. Update of Board of Supervisors' Actions Mr.Thistlethwaite reported that the Nelson Tentative Subdivision Map was appealed to the Board of Supervisors regarding Condition 12 and the requirement for curbs, gutters, and sidewalks. The Board of Supervisors granted the appeal; but did note that this is a problem. He talked of the possibility of an applicant posting a bond to pay their share of future improvements. If, after a certain period,there has been no other development the bond could be refunded. He said that Public Works was given direction by the Board of Supervisors to do a study on the problem. Commissioner Leland said that he wants to see the improvements done as the projects come in. D. Planning Commission Concerns Chair Lambert said she wants to talk about the drainage and circulation problems in Thermalito. She said that there is a draft drainage plan through 2007. She thinks that something should be done sooner than two years when the General Plan update is finished. Commissioner Wilson asked how complete the previous drainage plans are. He believed that in 1979 there was a drainage plan created. He asked how adequate is the plan and is it being followed. Mr. Felix Wannenmacher said the reason there was a 2007 update of the plan was because the County wanted to go back to look at those issues and do a plan that might be able to utilize current technology. Commissioner Wilson said that Thermalito is a good area for development. The soil is not good for crops or orchard. The utilities should be adequate. Chair Lambert said she agrees, but there needs to be a plan. Commissioner Leland said that plans are good, but these projects come in one at a time. He asked how much does staff analyze cumulative effects. Ms. Jolliffe said that, during the Initial Study process, there is a checklist that is followed. Cumulative effects are on that checklist, including cumulative air quality, traffic, and drainage effects. Staff looks at the project as well as projects that are currently going through the process. She said parcels that could be developed are not part of the study. Commissioner Nelson asked)if Thermalito is one of the study areas for the General Plan update. Mr. Thistlethwaite said yes. Chair Lambert asked if the City of Oroville is considering the annexation of Thermalito. Mr.Thistlethwaite said yes. There was a meeting with Oroville regarding which agency,County or City, should be processing projects in the Thermalito area. Commissioner Nelson asked if, the City of Oroville is ahead of the County on their General Plan update,the County could see what the City of Oroville has in writing. Mr. Thistlethwaite said there is not anything in writing. In addition, since the County and Oroville are using the same consultant there is a confidentiality issue. Commissioner Nelson said that problems in Thermalito would become Oroville's problems. Commissioner Marin said the Commission needs to look at this on a case-by-case basis. He said that the County and the City of Oroville should synchronize the process through the consultant. He said an area study requires a large amount of work. Commissioner Wilson said he agrees Chair Lambert. Mr. Schroth said there is a $1200.00 impact fee for traffic impacts. This fee is paid on smaller projects. The larger projects are required to do a traffic study to ensure that the $1200.00 is sufficient or if a larger fee is required. Commissioner Leland asked if the fee goes into the general fund. Mr. Schroth said yes. Mr. Wannenmacher said that impact fees are not collected for use on a specific project. They are collected and used where needed. Chair Lambert asked if that meant the pro-rata fair share for 10th Street and Oro Dam Blvd. would not go towards fixing that traffic issue. Mr. Wannenmacher said that money would go to the 10th Street/Oro Dam Blvd. intersection. Commissioner Marin asked when the last fee study was done. Mr. Wannenmacher said the last study was three years ago. Typically,a study is done every 4-5 years. Chair Lambert asked if there should be any discussion related to CEQA. Mr. Wannenmacher said CEQA is the forum in which the Commission is identifying potential impacts. Chair Lambert said that when the Commission is looking at projects on a one by one basis it is difficult to see where other areas may be suffering due to cumulative impacts. Ms. Jolliffe said that CEQA is an evaluation tool not a planning tool. She said it is not a substitute for proactive planning. Commissioner Marin said he is concerned with the possible need to increase taxes. Ms.Jolliffe asked if the Commission would like to cancel the November 29,2007 meeting. She said at this time there are not many projects to put on the agenda. It was determined to wait until the November 15, 2007 meeting to decide whether the Commission needs to cancel the meeting. Availability of adequate fire protection facilities. The Butte County Fire Department identified that the project conforms to their requirements and did not idents that there were inadequate fire protection facilities. Subsequent development must conform with Public Resources Code 4290 or 4291, whichever is stricter. 4. Adequately maintained approved road access with sufficient capacity to service area. The parcel fronts on Louis Avenue and the roads conform to Public Works'access requirements. j 5. Reasonable accessibility to commercial services and schools. Commercial services and elementary/middle schools are located within a mile of the property.
