(File 95-198) HEARING OPEN TO THE PUBLIC HEARING CLOSED TO THE PUBLIC Mr. Hunt said the parcel was created on April 29, 1965 without access, but has since obtained legal access, and that Public Works has no conditions. There was a discussion of the procedure for issuing Certificates of Compliance. Mr. Crawford said that there should be a requirement to meet the Fre Safe Regulations of Public Resources Code 4290 and the Butte County regulations if the intention is to build a house on the parcel. Mr. Hunt said that according to the Subdivision Map Act it is only possible to apply conditions that would have been applicable at the time the property was divided, and, in the past, we have only imposed conditions that relate to health, zoning, and access. There was a discussion of what conditions can be imposed upon a Certificate of Compliance. Mr. Crawford said that for property in the state responsibility area, Fire Safe Regulations would have to be met in order to obtain a building permit. The state responsibility area would include the foothill areas, which have the highest fire danger. It was agreed that there could be a note on the Certificate that Fre Safe Regulations must be met in order to obtain a building permit, in order to make the applicant aware of what would be required. It might help the applicant to find out what the requirements would be prior to preparation of a building pad. Public Resource Code 4291 requires clearing around buildings, which would apply in the case of existing homes. PRC 4290 applies to new structures. It was moved by Mr. Erickson, seconded by Mr. Hogan, and carried unanimously, for issuance of a Certificate of Compliance for a parcel owned by James and Marsha Bamford, AP 073-090- 013, finding that available evidence indicates the parcel was created April 29, 1965. The motion is made finding that the parcel meets zoning and Health Dept requirements and the issuance of the Certificate will not be detrimental to the health, safety or welfare of the people of Butte County or other properties in the territory in which the property is situated.
